No.11416 OF 1998\n                   --------------------------\n                   Dated this the 28th July, 2008.\n\n                             JUDGMENT\n<\/pre>\n<p>      This Original Petition was admitted on 19.6.1998.      By an<\/p>\n<p>interim order passed on 19.6.1998 on CMP No: 19750 of 1998 this<\/p>\n<p>Court directed the first respondent to see that if no shed has been<\/p>\n<p>put up by respondents 2 and 3 as on that date, the first respondent<\/p>\n<p>shall see that they shall not put up the shed until further orders.<\/p>\n<p>Later the petitioner filed CMP No: 37533 of 2002 to implead the<\/p>\n<p>Assistant Engineer, National Highway 208, Market Junction,<\/p>\n<p>Kottarakkara    as the additional 4th respondent in the Original<\/p>\n<p>Petition and CMP No: 37534 of 2002 for an interim order directing<\/p>\n<p>the additional 4th respondent to prevent the third respondent or<\/p>\n<p>anyone else from putting up a shed or bunk in the road puramboke<\/p>\n<p>in front of her building. By an interim order passed on 7.8.2002,<\/p>\n<p>the relief prayed for in CMP No: 37534 of 2002 was granted.<\/p>\n<p>Later, the third respondent moved for vacating the said order by<\/p>\n<p>filing C.M.P.No: 48416 of 2002. By order passed on 12.12.2002,<\/p>\n<p>this Court directed that the interim direction passed earlier on<\/p>\n<p><span class=\"hidden_text\">O.P.No: 11416\/98                  2<\/span><\/p>\n<p>7.8.2002 will not adversely affect the claims or rights of the third<\/p>\n<p>respondent to get any other land allotted without creating<\/p>\n<p>disturbance to the petitioner, at the instance of the Kottarakkara<\/p>\n<p>Grama Panchayat.\n<\/p>\n<p>      2.    The learned counsel for the petitioner submitted that the<\/p>\n<p>bunk run by the third respondent has since been removed. This is<\/p>\n<p>not disputed by the counsel appearing for the third respondent or<\/p>\n<p>the official respondents. Since the third respondent is no longer<\/p>\n<p>running the bunk shop in front of the petitioner&#8217;s building,        the<\/p>\n<p>Original    Petition has become infructuous.          Accordingly it is<\/p>\n<p>dismissed as infructuous.\n<\/p>\n<p>      3.
