JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 26\/09\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled, with the following prayers:\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordship may be pleased to Admit and Allow this petition;\n<\/p>\n<p>(B)\tYour<br \/>\nLordship may be pleased to issue a writ of mandamus or a writ in the<br \/>\nnature of mandamus or any other appropriate writ, order or direction<br \/>\ndirecting the respondents to confer the powers of a Special Court<br \/>\nunder Section 153 of the Electricity Act, 2003 upon the Additional<br \/>\nDistrict and Sessions Judge at Veraval, in the interest of justice;\n<\/p>\n<p>(C)\tPending<br \/>\nadmission, hearing and final disposal of this petition, Your Lordship<br \/>\nbe pleased to direct the respondents to consider the decide the<br \/>\nrepresentations made by the petitioner Association as  expeditiously<br \/>\nas possible;\n<\/p>\n<p>(D)\tYour<br \/>\nLordship be pleased to pass such other and further orders as may be<br \/>\ndeemed fit, just and proper in the peculiar facts and circumstances<br \/>\nof the present case.&#8221;\n<\/p>\n<p>\tBriefly<br \/>\nstated, the facts of the case are that, the petitioner is an<br \/>\nAssociation of Advocates practicing in the Civil and District Courts<br \/>\nat Veraval. The issue pertains to the constitution of the Special<br \/>\nCourt under Section 153 of the Electricity Act, 2003. It is the case<br \/>\nof the petitioner-Association that, there is only one such Court<br \/>\nfunctioning in the entire District of Junagadh, which has 14 Talukas.<br \/>\nIn view of the fact that though there are other<br \/>\nAdditional Sessions Judges functioning in the Sub-Divisions of<br \/>\nVeraval and Una, and who have not been vested with power under<br \/>\nSection 153 of the Electricity Act, 2003, and as the distance between<br \/>\nJunagadh and other Talukas of the said District is considerable, the<br \/>\nAdvocates and public at large, are facing<br \/>\ngreat inconvenience.\n<\/p>\n<p>\tWhen<br \/>\nthe matter is taken-up, today, Mr.Hriday Buch, learned advocate for<br \/>\nthe petitioner, states that the petitioner may be permitted to make a<br \/>\nfresh representation to the Registrar General, High Court of Gujarat<br \/>\n(respondent No.3), who may be directed to consider the same and take<br \/>\nappropriate action thereupon, as expeditiously as possible.\n<\/p>\n<p>\tMr.N.V.\n<\/p>\n<p>Anjaria, learned advocate for respondent No.3, states that if such a<br \/>\nrepresentation is made by the petitioner, it shall be considered, in<br \/>\naccordance with law and be placed before the Competent Authority, for<br \/>\nnecessary action.\n<\/p>\n<p>\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed:\n<\/p>\n<p>The<br \/>\npetitioner may make a fresh representation to respondent No.3, within<br \/>\na period of two weeks from today.
