A Pasayat<\/div>\n<div class=\"doc_bench\">Bench: Dr. Arijit Pasayat, Lokeshwar Singh Panta<\/div>\n<pre>           CASE NO.:\nAppeal (civil)  2094 of 2008\n\nPETITIONER:\nState of U.P. and Anr.\n\nRESPONDENT:\nPramod Kumar Shukla and Anr.\n\nDATE OF JUDGMENT: 25\/03\/2008\n\nBENCH:\nDr. ARIJIT PASAYAT &amp; LOKESHWAR SINGH PANTA\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<br \/>\n(Arising out of SLP (C) No. 19890 of 2005)<br \/>\n(With C.A. 2095\/08 @ SLP (C) No. 11752\/2006)<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tThese two appeals arise out of a common judgment of the<br \/>\nAllahabad High Court allowing the Writ Petition (Civil Misc.<br \/>\nWrit Petition No.33291\/2004) and holding that no further<br \/>\norder need be passed in the connected Writ Petition (Civil<br \/>\nMisc.W.P.37610\/2004) in view of the order of the former case.\n<\/p>\n<p>3.\tChallenge in the first writ petition was to the order<br \/>\npassed by the District Magistrate, Allahabad dated 2.8.2004<br \/>\nholding that respondent-Pramod Kumar Shukla had received<br \/>\ngrant in aid to the tune of Rs.21,27,551.13 between 2.4.1990<br \/>\nto 1.4.1995 under Government Order dated 21.7.1986 by<br \/>\nconcealing facts and by practicing fraud. It was pointed out<br \/>\nthat he had concealed the fact that he was not the owner and<br \/>\nwas not, therefore, entitled to receive the grant in aid.<br \/>\nTherefore, in exercise of powers conferred under Section 5(3) of<br \/>\nthe U.P. Cinema Regulation Act, 1955 (in short the Cinema<br \/>\nAct) order of recovery was given and grant in aid sanctioned to<br \/>\nhim vide office order No.299 dated 10.4.1990 was set aside.<br \/>\nApplication for renewal dated 1.7.1994 submitted by said<br \/>\nPramod Kumar Shukla was rejected in exercise of powers<br \/>\nconferred under Section 21 of the U.P. General Clauses Act,<br \/>\n1904 (in short General Clauses Act). Further order was<br \/>\npassed under Section 12(1) of the U.P. Entertainment Tax Act,<br \/>\n1979 (in short Entertainment Act) directing him to deposit the<br \/>\namount of entertainment tax collected by such cheating and<br \/>\nfraud during 2.4.1990 and 1.4.1995 amounting to<br \/>\nRs.21,27,551.13.\n<\/p>\n<p>4.\tBackground facts which are almost undisputed run as<br \/>\nfollows:\n<\/p>\n<p>     Respondent-Pramod Kumar Shukla is the son of Shri<br \/>\nSatya Prakash Shukla who is the appellant in appeal arising<br \/>\nout of SLP (C) No.11752\/2006.  A Cinema Hall named Girija<br \/>\nChitralaya was granted temporary permit for six months.<br \/>\nUndisputedly, on 10.11.1986 the original owner Shri Girija<br \/>\nShankar Shukla had executed a Power of Attorney appointing<br \/>\nhis grandson Pramod Kumar Shukla as the Power of Attorney<br \/>\nholder. The said Power of Attorney was executed on<br \/>\n10.11.1986 and was registered with the Sub-Registrar,<br \/>\nFarukkhabad on 14.11.1986.  On 31.10.1988 permission was<br \/>\ngranted to construct a permanent cinema hall. Pramod kumar<br \/>\nShukla had made an application on 6.9.1988 suppressing the<br \/>\nfact that Girija Shankar Shukla had expired on 31.3.1987. In<br \/>\nthe application filed, Pramod Kumar Shukla described himself<br \/>\nas the owner of Cinema Hall and indicated in the application<br \/>\nthat he was running a temporary cinema hall and wanted to<br \/>\nconstruct a permanent cinema building on the concerned plot<br \/>\nof land. Interestingly, he did not apply as a Power of Attorney<br \/>\nholder but stated that he was the owner. Permission was<br \/>\ngranted on certain conditions by the District Magistrate,<br \/>\nAllahabad.\n<\/p>\n<p>     It is the stand of the appellants that Pramod Kumar<br \/>\nShukla falsely represented himself as the owner and the<br \/>\nlicence was granted on the premises that Pramod Kumar<br \/>\nShukla was the owner of the Cinema Hall. His father Satya<br \/>\nPrakash Shukla made a representation and, therefore, there<br \/>\nwas no renewal of the licence which operated from 30.3.1990<br \/>\nto 31.3.1993 both days inclusive.  A show cause notice was<br \/>\nissued on 19.6.2004 alleging that the permission granted for<br \/>\noperating the permanent Cinema Hall was obtained by<br \/>\nsuppressing the factual position by Pramod Kumar Shukla<br \/>\nmis-representing himself to be the owner. Notice was given to<br \/>\nshow cause as to why the amount of grant in aid which was<br \/>\nobtained by fraud and by concealing the facts shall not be<br \/>\nrecovered under Section 12(1) of the Entertainment Act and<br \/>\nthe grant in aid sanctioned by order No.299 dated 10.4.90<br \/>\nshould not be cancelled and the application for renewal of<br \/>\nlicence should not be rejected.\n<\/p>\n<p>     In grant in aid order dated 10.4.1990, Pramod Kumar<br \/>\nShukla was indicated to be the licensee. The order passed by<br \/>\nthe District Magistrate was challenged in the Writ Petitions.<br \/>\nThe High Court after referring to the factual scenario came to<br \/>\nhold that the order was passed without applying mind and<br \/>\nwith undue haste. It was noted that the authorities should<br \/>\nhave taken appropriate legal help to understand how far such<br \/>\nexecutive authority can go to determine the issue. It was not a<br \/>\ncase of fraud between an individual and the State by which<br \/>\nthe revenue exchequer would suffer but was a dispute<br \/>\nbetween the father and the son and without ascertaining the<br \/>\nposition either by Civil Court  having appropriate jurisdiction<br \/>\nin respect of right, title and interest of the property and<br \/>\naccounts or by Criminal Court as regards proof of fraud and<br \/>\ndetermination in respect of forgery taking help of appropriate<br \/>\nmechanism, the order impugned was passed which was illegal.\n<\/p>\n<p>5.\tLearned counsel for the appellants has submitted that<br \/>\nthe High Court completely mis-construed the nature of the<br \/>\ndispute. It lost sight of the fact that Pramod Kumar Shukla<br \/>\nhad fraudulently projected himself to be the owner which<br \/>\nadmittedly he was not. The fact that the executor of the Power<br \/>\nof Attorney had died in 1987 much before the application for<br \/>\nrenewal and\/or application for permanent Cinema Hall was<br \/>\nfiled was not disputed.\n<\/p>\n<p>6.\tLearned counsel for the respondent-Pramod Kumar<br \/>\nShukla on the other hand supported the judgment of the High<br \/>\nCourt stating that in a case of this nature the Collector should<br \/>\nnot have passed the impugned order. His claim was that there<br \/>\nwas a family settlement and certain documents executed by<br \/>\nhis father Satya Prakash Shukla clearly established that he<br \/>\nwas the owner of the Cinema Hall.\n<\/p>\n<p>7.\tThe High Court seems to have completely lost sight of the<br \/>\nnature of the controversy and the dispute. Whether there was<br \/>\nany fraud practiced could not have been decided in the Writ<br \/>\nPetition. Under Section 7 of the Cinema Act the power to<br \/>\nrevoke and cancel the license is available to the appropriate<br \/>\nauthority.  It appears that the High Court has not examined<br \/>\nthe question as to what is the effect of Girija death. It has also<br \/>\nnot examined the acceptability of the claim of Pramod kumar<br \/>\nShukla that he was the owner of the Cinema Hall in which<br \/>\ncapacity he had applied for the permanent licence. These have<br \/>\nconsiderable bearing on the subject matter of dispute. The<br \/>\nHigh Court has come to an abrupt conclusion without<br \/>\nanalyzing the factual and applicable legal position. That being<br \/>\nso, we set aside the impugned order of the High Court and<br \/>\nremit the matter to it for fresh disposal in accordance with<br \/>\nlaw. We request the High Court to dispose of the matter within<br \/>\n4 months from today.\n<\/p>\n<p>8.\tThe appeals are allowed to the aforesaid extent with no<br \/>\norder as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of U.P.
