SDM (VV) is directed to provide the\nrequisite reply immediately within 2 days.\"\n\nGround of the Second Appeal:\nNon compliance of FAA's order. No information had been provided to the Appellant.\n\nDecision dated 8 January 2010:\nIt appeared that no information had been provided to the appellant. Even after the order of the\nFirst Appellate Authority on 28\/10\/2009 no information was provided to the appellant. Hence it\nappeared that the FAA's order had also not been implemented.\n\nThe appeal was allowed.\n\nThe PIO was directed to provide the complete information to the appellant before\n30 January 2010.\nAs the issue before the Commission was of not supplying the complete, required information by\nthe PIO within 30 days as required by the law and the PIO had further refused to obey the orders\nof his superior officer, which raised a reasonable doubt that the denial of information may also\nhave been malafide, it appeared that the PIO's actions attracted the penal provisions of Section\n20 (1).\nA showcause notice was issued to him, and he was directed give his reasons to the Commission\nto show cause why penalty should not be levied on him.\n\nHe was further directed to present himself before the Commission at the above address on\n9 February 2010 at 10.00am alongwith his written submissions showing cause why penalty\nshould not be imposed on him as mandated under Section 20 (1). He was also directed to\nsubmit proof of having given the information to the appellant.\n\nRelevant facts arose during the show cause hearing held on 09\/02\/2010\n\"The following persons were present:\nRespondent: Mr. B L Meena on behalf of the PIO Mr Vivek Kr Tripathy.\nMr B L Meena states that the person responsible for the delay in providing information was Mr\nVivek Kr Tripathy, SDM, Vasant Vihar. He says that Mr V K Tripathy is on leave and is joining\nwork on 10 February. Mr BL Meena is directed to inform Mr VK Tripathy to appear before the\nCommission to show cause why penalty under section 20 (1) should not be levied on him. Mr\nVK Tripathy is directed to present himself before the Commission on 15 February 2009 at 4.30\npm along with his written submission. In case any other officer is responsible for the delay Mr\nTripathy will bring proof of this and get the officer along with him to show cause why penalty\nshould not be levied on him.\"\n\nRelevant Facts<\/pre>\n
 emerging during Showcause Hearing on 15 February 2010:
\nThe following were present:\n<\/p>\n

Respondent: Mr. B L Meena on behalf of the PIO Mr Vivek Kr Tripathy;\n<\/p>\n
              Mr. Ombir, LDC and Deemed PIO;\n<\/p>\n

         The RTI application sent on 30\/07\/2009 was received on 10\/08\/2009 and marked to the
\ndealing assistance Mr. Ombir, LDC & deemed PIO. The information should have been provided
\nto the Appellant by 10\/09\/2009. The PIO shows that the information was sent to the Appellant on
\n30\/10\/2009. Thus there was a delay in sending the information of 50 days. This delay is due to
\nMr. Ombir LDC whose assistance has been sought by the PIO under Section 5(4) of the RTI Act.
\nHence the liability under Section 20(1) of the RTI Act is on Mr. Ombir whose assistance had
\nbeen taken. The Commission asked Mr. Ombir LDC to give reasons for the delay in providing
\nthe information. He says that the papers probably got mixed up since he also issues the caste
\ncertificates for SC\/ST, OBC and others. He apologizes for this mistake.\n<\/p>\n
       The Commission cannot accept this as a reasonable cause for the delay and therefore
\npenalized Mr. Ombir UDC and Deemed PIO for the delay of 50 days under Section 20(1) of the
\nRTI Act. The Commission penalizes Mr. Ombir Rs.250 X 50 Days = Rs. 12500\/-\n<\/p>\n
Decision:\n<\/p>\n
        As per the provisions of Section 20 (1), the Commission finds this a fit case for levying
\npenalty on Mr. Ombir, LDC and Deemed PIO. Since the delay in providing the information has
\nbeen 50 days the Commission is passing an order penalizing Mr. Ombir, LDC Rs. 12500\/- which
\nis the maximum penalty under the Act.\n<\/p>\n
        The Chief Secretary, Govt. National Capital Territory, Delhi is directed to recover the
\namount of Rs. 12500\/- from the salary of Mr. Ombir, LDC and remit the same by a demand draft
\nor a Banker’s Cheque in the name of the Pay & Accounts Officer, CAT, payable at New Delhi
\nand send the same to Shri Pankaj K.P. Shreyaskar, Joint Registrar and Deputy Secretary of the
\nCentral Information Commission, 2nd Floor, August Kranti Bhawan, New Delhi – 110066. The
\namount may be deducted at the rate of Rs.2500\/- per month every month from the salary of Mr.
\nOmbir, LDC from March 2010. The first payment will be made before 10 March 2010 and the
\nlast payment will be made before 10 July 2010.\n<\/p>\n
This decision is announced in open chamber.\n<\/p>\n
Notice of this decision be given free of cost to the parties.
\nAny information in compliance with this Order will be provided free of cost as per Section 7(6) of RTI Act.\n<\/p>\n
