 ofppthe suitproperty bearing S.No.38\/2 measuring 2 acres 20<\/p>\n
   Kodathi Village, Varthur Hobli, Bangalore South<\/p>\n
  it is the case of the plaintiff that he purchased the suit<\/p>\n
elproperty under a registered sale deed dated 30.6.1989<\/p>\n

registered as document 1\\\u00a7o.3493\/1989-90 in the office of the<\/p>\n
Sub–Registr3.r Bangalore on 3.7.1989. The copy of the'””:-sale<\/p>\n
deed has been produced at Annexure–L. It is on the V.<\/p>\n
this sale deed that the plaintiff made a request to”‘\u00abt.he.  <\/p>\n
authorities to enter his name in the records. In pu_rsu_ar1C’e7 of’;<\/p>\n
the request made, the Tahsildar passed an order  fa:rot;r*oif<\/p>\n
the plaintiff and the defendant ‘preferrehd ean–.eap_pe’al'””tolithe 98<\/p>\n
Assistant Commissioner in,–RA (BE)–‘*l’10_;4?i’*\/y09–  ‘avnd.-the entry
\nhas been stayed. The matter  pending before the
\nAssistant Commissioiier for’Vconsideration.VV- ~ 2 if 8<\/p>\n
3. As Couldgbeiiiseeia fr_om the rfecordllof rights since from<\/p>\n
the year ofllplurchaself’theasuit property by the plaintiff, his
\nname appearsaboth  and also the Cultivators<\/p>\n
column all along. ‘<\/p>\n
 8′  –  pvetitionertflaims that he is the great grand son of<\/p>\n
  that she had purchased this property under<\/p>\n
  a reg:eieredy’e?eVie’ deed dated 26.6.1961 and she died on<\/p>\n
vbV.g_.42’9h.3.l985hmuch earlier to the sale deed said to have been<\/p>\n
 by her in favour of the plaintiff. It is also his case that<\/p>\n
 ____”the alleged sale deed executed on 80.06.1989 is void abinitio<\/p>\n
 _  that the plaintiff by impersonation of Madduramma has<\/p>\n

got created a false and fictitious document and that it does not<\/p>\n
bind the interest of the defendant in the suit property. Soalso,<\/p>\n
it is his case that Madduramrna his great grand’ V.<\/p>\n
bequeathed the suit property in favour of Laksh\u00a5;i\ufb01;:an’1jina’   <\/p>\n
wife of her son Muniswamy by registered”W.ill <\/p>\n
After the death of Madduramma,  .\n<\/p>\n
possession of the suit property andjtasshehldied’  as
\nthe only heir. he has succeeded  the deceased.
\nTherefore, he claims that he of the suit land.
\nAs there was an   he instituted
\nthe suit in O.S:_.   plaint has been
\nproduced at that the plaintiff sought
\nfor a declaration owner of the suit land<\/p>\n
and also an ‘injunctionl’ restraining the defendant in the said<\/p>\n

said appeal aiso came to be dismissed on merits r.vide..o1*d.-er <\/p>\n
dated 9.4.2010. Aggrieved by the concurrent” _p it<\/p>\n
regard to the grant of temporary injtinctiom the-:<\/p>\n
petition has been filed.\n<\/p>\n
6. I have heard the learnedleounsell fortthe petitioner<\/p>\n
and also the respondent  <\/p>\n
7. it is rele1rarit_ to   petitioner has
\ninstituted the  ,V\/eoos, he has not
\nobtained  injunction. Furthermore, the
\ncopy of the Llsale   site have been executed by
\n_Maddurarn:na    the plaintiff has been produced at<\/p>\n
 there is a reference of the name of
\n executor of the sale deed and there is also
\nl  a reference’  she purchased this property on 26.6.1961<\/p>\n
it tinderp a registered sale deed and _ her name appeared in the<\/p>\n
  rights and she has also made a reference that she
\n  executed a Will on 5.4.1978 and the said Will was registered in<\/p>\n
   the office of the Sub–registrar. She states that she has<\/p>\n

cancelled the said Will and as she is the absolute owner of the
\nsuit property in question, sold the same for a Valuable
\nconsideration of Rs.72,500\/- to the plaintiff in the suit;-.___It is
\nfurther pertinent to note that the daughter of Maddurarri:i_i:a:by
\nname Muniyamma is also an attesting   .\n<\/p>\n
registered sale deed. So in the circunistarices,  lielow if it<\/p>\n

that the plaintiff is in prima facie possession of<\/p>\n
property, I do not think that in the writ jurisdiction ‘<\/p>\n
couid be reappreciated. There are concurrent.’findingsffofflboth if<\/p>\n
