Petitioner is the first accused in the case. The<\/p>\n<p>alleged offences are under Sections 27(1)(e)(iv) of the Kerala<\/p>\n<p>Forest Act and Sections 2(1), 2(15), 2(16), 2(17), 2(35), 2(36), 2<\/p>\n<p>(37), 9, 27, 29, 31, 39, 50, 51, 52, 57 and 59 of the Wild Life<\/p>\n<p>Protection Act.   According to prosecution, he has shot down an<\/p>\n<p>Indian wild gaur on 4.12.2009.       The meat was removed and<\/p>\n<p>shared.   Petitioner was     arrested on 27.3.2010 and he is in<\/p>\n<p>custody for the past 54 days.\n<\/p>\n<p>           3. Learned Public Prosecutor submitted that he has no<\/p>\n<p>objection in granting bail on stringent conditions.<\/p>\n<p>           4. On hearing both sides, I am satisfied that bail can<\/p>\n<p>be granted to the petitioner on stringent conditions. Hence, the<\/p>\n<p>following order is passed :\n<\/p>\n<blockquote><p>          Petitioner shall be released on bail on his executing a<\/p>\n<p>          bond for Rs.50,000\/- (Rupees fifty thousand only) with<\/p>\n<p>          two solvent sureties each for the like sum to the<\/p>\n<p><span class=\"hidden_text\">BA NO. 2559\/10                    2<\/span><\/p>\n<p>          satisfaction of the Magistrate concerned on the<\/p>\n<p>          following conditions :\n<\/p><\/blockquote>\n<blockquote><p>                (i) Petitioner shall report before the Investigating<\/p>\n<p>                    Officer on every Monday and Thursday<\/p>\n<p>                    between 10 a.m. and 1 p.m.<\/p>\n<\/blockquote>\n<blockquote><p>                (ii) Petitioner shall not commit similar offence<\/p>\n<p>                    while on bail and in case he is involved in any<\/p>\n<p>                    similar offence, bail is liable to be cancelled.<\/p>\n<\/blockquote>\n<blockquote><p>                            Petition is allowed.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                              K.HEMA, JUDGE.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><\/blockquote>\n<p>tgs<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court George V.S. vs The State Of Kerala on 19 May, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 2559 of 2010() 1.
