The applicants are<br \/>\n\tpermanent residents of Village : Paatvagam, Taluka, Jetaran, Dist.<br \/>\n\tPali, Rajasthan. He has contended that the applicants have their<br \/>\n\tfamilies at Rajasthan.  So far as Condition No.&#8221;8(e)&#8221; is<br \/>\n\tconcerned, he has contended that the applicants have been released<br \/>\n\ton bail by order dated 4.3.2010 and since then, as per the<br \/>\n\tcondition, they are regularly marking their presence before the<br \/>\n\tconcerned Police Station. He has contended that the applicants were<br \/>\n\tserving at Chennai and their business is at Chennai. However,<br \/>\n\tbecause of condition No.8(e) the applicants are unable to attend<br \/>\n\ttheir business and thereby incurring huge loss and, therefore, it is<br \/>\n\tvery difficult for them to remain present for marking their presence<br \/>\n\tat the police station. He has also assured this Court that the<br \/>\n\tapplicant will remain present during the trial. He, therefore, prays<br \/>\n\tthat the condition No. &#8220;8(e)&#8221; may be deleted.\n<\/p>\n<p>Having<br \/>\n\theard the learned advocates for the parties and looking to the facts<br \/>\n\tand circumstances of the case, I am of the opinion that the<br \/>\n\tcondition No. &#8220;8(d)&#8221; is required to be modified and<br \/>\n\tcondition No.&#8221;8(e)&#8221; imposed by this Court is required to<br \/>\n\tbe deleted.\n<\/p>\n<p>Hence,<br \/>\n\tcondition No. &#8220;8(d)&#8221;, viz. &#8220;not leave the State<br \/>\n\tof Gujarat without the prior permission of the Sessions Court<br \/>\n\tconcerned&#8221;,  imposed by this Court vide order dated<br \/>\n\t4.3.2010 passed in Criminal Misc. Application No.537 of 2010 is<br \/>\n\tmodified to the extent, &#8220;not leave India without the prior<br \/>\n\tpermission of the Sessions Court concerned&#8221;. So far as<br \/>\n\tcondition No.8(e), viz. &#8220;mark their presence at the<br \/>\n\tconcerned Police Station on any day of every first week of English<br \/>\n\tcalender month between 9:00 AM and 2;00 PM. Till the trial is over&#8221;,<br \/>\n\timposed by this Court vide order dated 4.3.2010 passed in Criminal<br \/>\n\tMisc. Application No.537 of 2010, is hereby deleted. Application is<br \/>\n\tallowed to the aforesaid extent. Rule is made absolute accordingly.<br \/>\n\tD.S.
