Justice K.T.SANKARAN\n\n Dated :08\/04\/2010\n\n O R D E R\n                          K.T.SANKARAN, J.\n             ------------------------------------------------------\n                      B.A. NO. 2124 OF 2010\n             ------------------------------------------------------\n               Dated this the 8th day of April, 2010\n\n\n                                O R D E R\n<\/pre>\n<p>      This is an application for bail under Section 439 of the Code of<\/p>\n<p>Criminal Procedure.       The petitioner is accused No.13           in Crime<\/p>\n<p>No.90 of 2008 of Bekal Police Station, Kasaragod District, which is<\/p>\n<p>now pending as C.P.No.53 of 2009 on the file of the Court of the<\/p>\n<p>Judicial Magistrate of the First Class II, Hosdurg.<\/p>\n<p>      2.    The offences alleged against the accused are under<\/p>\n<p>Sections 143, 147, 148, 332, 324 and 308 read with Section 149 of<\/p>\n<p>the Indian Penal Code, Section 2 of the Prevention of Disturbance of<\/p>\n<p>Public Meeting Act and Section 3(2)(c) of the PDPP Act.<\/p>\n<p>      3. The incident took place on 8.2.2008. After completing the<\/p>\n<p>investigation, charge sheet was filed.            The case is pending as<\/p>\n<p>C.P.No.53 of 2009 on the file of the Court of the Judicial Magistrate<\/p>\n<p>of the First Class II, Hosdurg. The petitioner, who is accused No.13<\/p>\n<p>in the present case, was appearing before the Court in some other<\/p>\n<p>B.A. NO. 2124 OF 2010<\/p>\n<p>                                    :: 2 ::\n<\/p>\n<p>cases. Therefore, the Court remanded the petitioner in the present<\/p>\n<p>case on 27.3.2010. His application for bail was dismissed by the<\/p>\n<p>learned Magistrate by the order dated 29.3.2010.<\/p>\n<p>       4. The learned counsel for the petitioner submitted that the<\/p>\n<p>petitioner is prepared to comply with any condition that may be<\/p>\n<p>imposed by the Court. The learned counsel for the petitioner also<\/p>\n<p>submitted that the petitioner undertakes to appear before Court on<\/p>\n<p>all posting dates without fail, except for reasons beyond his control.<\/p>\n<p>       5. Taking into account the facts and circumstances of the<\/p>\n<p>case and also the assurance made by the learned counsel for the<\/p>\n<p>petitioner, I am inclined to grant bail to the petitioner on stringent<\/p>\n<p>conditions.\n<\/p>\n<\/p>\n<p>       6. The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties for the like amount to<\/p>\n<p>the satisfaction of the Judicial Magistrate of the First      Class-II,<\/p>\n<p>Hosdurg, subject to the following conditions:<\/p>\n<p>B.A. NO. 2124 OF 2010<\/p>\n<p>                                    :: 3 ::\n<\/p>\n<\/p>\n<p>      a)    The petitioner shall appear before Court on all<br \/>\n            posting dates without fail, unless he is prevented<br \/>\n            by sufficient cause from appearing, for reasons<br \/>\n            beyond his control, to the satisfaction of the<br \/>\n            learned Magistrate;\n<\/p>\n<p>      b)    The petitioner shall surrender his passport, if<br \/>\n            any, before the Judicial Magistrate of the First<br \/>\n            Class II, Hosdurg within one week.
