Shah, learned<br \/>\nAssistant Government Pleader waives service of notice of Rule on<br \/>\nbehalf of respondent Nos.1 and 2 and Shri Dipen Desai, learned<br \/>\nadvocate waives service of notice of Rule on behalf of respondent<br \/>\nNo.4.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case and with the consent<br \/>\nof learned advocates appearing for respective parties, present<br \/>\npetition is taken up for final hearing today.\n<\/p>\n<p>[2.0]\t\tPresent<br \/>\nSpecial Civil Application under Article 226 of the Constitution of<br \/>\nIndia has been preferred by the petitioner &#8211; Agriculture<br \/>\nProduce Market Committee, Dhanduka to quash and set aside the<br \/>\nimpugned order dated 24.07.2000 (Annexure A to the petition) and the<br \/>\norder dated 17.01.2000 (Annexure B to the petition) passed by<br \/>\nrespondent Nos.1 and 2 respectively.  Considering the fact that the<br \/>\nimpugned order has been passed by respondent No.2 directing the<br \/>\npetitioner not to compel the Traders trading in vegetable and fruits<br \/>\nto obtain the licence and restraining the Market Committee from<br \/>\nrecovering the market cess from them is passed without following due<br \/>\nprocedure as required under Sections 5 and 6 of the Gujarat<br \/>\nAgriculture Produce Market Act, the impugned order confirmed by the<br \/>\nRevisional Authority cannot be sustained and the same deserves to be<br \/>\nquashed and set aside.  However, it is to be noted that as<br \/>\nsubsequently the competent authority has issued notification under<br \/>\nSections 5 and 6 of the Act, which is the subject matter of Special<br \/>\nCivil Application No.12302\/2000, learned advocates appearing for<br \/>\nrespective parties have requested to make suitable observations that<br \/>\nthe impugned order be quashed and set aside without prejudice to the<br \/>\nrights and contentions of the respective parties in aforesaid Special<br \/>\nCivil Application No.12302\/2000.\n<\/p>\n<p>[3.0]\t\tIn<br \/>\nview of the above and for the reasons stated above, petition succeeds<br \/>\nand the impugned order dated 17.01.2000 (Annexure<br \/>\nB) passed by respondent No.2 confirmed by respondent No.1 by order<br \/>\ndated 24.07.2000 (Annexure A) passed in Revision Application<br \/>\nNo.38\/2000, are hereby quashed and set aside.  However, the same<br \/>\nshall be without prejudice to the rights and contentions of the<br \/>\nrespective parties in Special Civil Application No.12302\/2000.  Rule<br \/>\nis made absolute to the aforesaid extent.
