Justice K.HEMA\n\n Dated :28\/01\/2011\n\n O R D E R\n                             K.HEMA, J.\n             -----------------------------------------------\n               Criminal Appeal No.659 of 2007\n             -----------------------------------------------\n                   Dated 28th January, 2011.\n\n                          J U D G M E N T\n<\/pre>\n<p>                 This appeal arises from an order of acquittal<\/p>\n<p>passed under Section 256(1) of the Code of Criminal Procedure<\/p>\n<p>(&#8216;the Code&#8217;, for short).\n<\/p>\n<p>           2.   The appellant is the complainant.           He filed a<\/p>\n<p>complaint against first respondent before the Magistrate Court,<\/p>\n<p>alleging  offence under Section            138    of   the Negotiable<\/p>\n<p>Instruments Act. The complaint was filed on 22.6.2004 and it<\/p>\n<p>was taken on file in the year 2004. Thereafter, even before<\/p>\n<p>issuing summons to the accused, the accused was acquitted<\/p>\n<p>under Section 256(1) of the Code, since neither the complainant<\/p>\n<p>nor his counsel was present.\n<\/p>\n<p>           3.    Learned counsel for appellant submitted that<\/p>\n<p>accused was acquitted even before summons was issued. The<\/p>\n<p>complainant was not present due to reasons beyond his control.<\/p>\n<p>He also produced for perusal, a certified copy of the proceeding<\/p>\n<p>sheet. On hearing appellant&#8217;s counsel and on going through<\/p>\n<p>the impugned order and the proceeding sheet, it is clear that<\/p>\n<p><span class=\"hidden_text\">Crl.Appeal No.659\/07               2<\/span><\/p>\n<p>even prior to the appearance of accused, the accused was<\/p>\n<p>acquitted under Section 256(1) of the Code. On a reading of<\/p>\n<p>Section 256(1) of the Code itself, it is clear that such an order of<\/p>\n<p>acquittal is not sustainable.\n<\/p>\n<p>             4.    As per Section 256(1), the accused can be<\/p>\n<p>acquitted under the said section, only on the day to which case<\/p>\n<p>is posted for appearance of accused, in case summons is issued<\/p>\n<p>or on the day to which the case is posted for hearing of<\/p>\n<p>prosecution under Section 254(1). The order under challenge<\/p>\n<p>being passed prior to such days and not on either of the days,<\/p>\n<p>the order of acquittal is not sustainable.<\/p>\n<p>             5. If steps are not taken by complainant, the court is<\/p>\n<p>not empowered to acquit the accused, under Section 256(1) of<\/p>\n<p>the Code. [vide <a href=\"\/doc\/1965090\/\">P.V.Joseph v. State of Kerala<\/a> (2010(4) KLT<\/p>\n<p>697), <a href=\"\/doc\/566283\/\">Joy Abraham v. Jiju Thomas<\/a> (2010(2) KLT 735)].
