Mr.Lakhani read FIR as well as so called<br \/>\nsuicide note and order passed by the learned Judge and vehemently<br \/>\nargued that to establish prima facie case of offence punishable under<br \/>\nSection 306 of the IPC three ingredients are required to be<br \/>\nestablished, namely, (1) abettor (2) provocator and (3) instigator.<br \/>\nMr.Lakhani has argued that in this case three ingredients of Section<br \/>\n306 of IPC are prima faciely not established. He has read contents of<br \/>\nthe note of the suicide and also contended that even from the<br \/>\ncontents of suicide note present applicants are not prima faciely<br \/>\ninvolved in this case. He submitted that co-accused of the same<br \/>\noffence, have been released by this Court. He has, therefore,<br \/>\ncontended that present applicant are required to be enlarged on bail.\n<\/p>\n<p>3.\tHeard<br \/>\nMs. Shah learned APP for the respondent State vehemently opposed the<br \/>\npresent application.\n<\/p>\n<p>4.\tHaving<br \/>\nheard the learned Counsel for both the sides and looking to the facts<br \/>\nand circumstances of the case, statement of the witnesses, gravity of<br \/>\nthe offence and quantum of punishment and the fact there is no<br \/>\ndefinite allegation made against the applicant, I am inclined to<br \/>\ngrant bail to the applicant.\n<\/p>\n<p>5.\tConsidering<br \/>\nthe above, this Application is allowed. The applicant is ordered to<br \/>\nbe released on bail in connection with CR No.I-30 of 2011 registered<br \/>\nwith Meghaninagar Police Station for the offence alleged against him<br \/>\nin this Application on his executing a Bond of Rs.10,000\/- (Rupees<br \/>\nten thousand only) with one solvent surety of the like amount to the<br \/>\nsatisfaction of the trial Court and subject to the conditions that he<br \/>\nshall-\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurise the prosecution witnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the Investigating Officer;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>e)\tnot<br \/>\nleave the country without the prior permission of the concerned<br \/>\nSessions Judge;\n<\/p>\n<p>f)\tfurnish<br \/>\nthe address of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change the residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>g)\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week.\n<\/p>\n<p>6.\tIf<br \/>\nthe breach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>7.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>8.\tRule<br \/>\nis made absolute.
