No.28123 of 2011\n                          Anil Yadav son of Sri Amirak Yadav\n                                        Versus\n                                  The State Of Bihar\n                                       -----------\n<\/pre>\n<p>2\/   29.08.2011                   Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                  The petitioner seeks bail in a case instituted for the<\/p>\n<p>                      offence under sections 147, 149, 435, 342 and 379 of the Indian<\/p>\n<p>                      Penal Code.\n<\/p>\n<p>                                  Considering that the petitioner was member of unruly<\/p>\n<p>                      mob of 200-150 persons, who were protesting against the murder of<\/p>\n<p>                      one Pappu Yadav, and committed excesses, but there is no specific<\/p>\n<p>                      overt act alleged against him, let the petitioner, above named, be<\/p>\n<p>                      released on bail on furnishing bail bond of Rs.5,000\/- (five<\/p>\n<p>                      thousand) with two sureties of the like amount each or any other<\/p>\n<p>                      surety to be fixed by the court below to the satisfaction of the<\/p>\n<p>                      Additional Chief Judicial Magistrate, Hilsa, in connection with<\/p>\n<p>                      Karai Parsurai P.S. Case No.34 of 2011, subject to the conditions (i)<\/p>\n<p>                      That one of the bailors will be a close relative of the petitioner, who<\/p>\n<p>                      will give an affidavit giving genealogy as to how he is related with<\/p>\n<p>                      the petitioner. The bailors will undertake to furnish information to<\/p>\n<p>                      the court about any change in the address of the petitioner, (ii) That<\/p>\n<p>                      the affidavit shall clearly state that the petitioner is not an accused in<\/p>\n<p>                      any other case and, if he is, he shall not be released on bail, (iii)<\/p>\n<p>                      That the bailors shall also state on affidavit that they will inform the<\/p>\n<p>                      court concerned if the petitioner is implicated in any other case of<\/p>\n<p>                      similar nature after his release in the present case and thereafter the<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>       court below will be at liberty to initiate the proceeding for<\/p>\n<p>       cancellation of bail on the ground of misuse, (iv) That the petitioner<\/p>\n<p>       will give an undertaking that he will receive the police papers on the<\/p>\n<p>       given date and be present on date fixed for charge and if he fails to<\/p>\n<p>       do so on two given dates and delays the trial in any manner, his bail<\/p>\n<p>       will be liable to be cancelled for reasons of misuse, and (v) That the<\/p>\n<p>       petitioner will be well represented on each date and if he fails to do<\/p>\n<p>       so on two consecutive dates, his bail will be liable to be cancelled.<\/p>\n<pre>JA\/-                                           (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Anil Yadav vs The State Of Bihar on 29 August, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
