    Petitioner   is  the   respondent  and  the   first<\/p>\n
respondent the petitioner in M.C.26\/2009 on the file of<\/p>\n
Judicial    First     Class    Magistrate     Court-II,<\/p>\n
Thiruvananthapuram who filed  a petition under section<\/p>\n
12 of Protection of Women from the Domestic Violence<\/p>\n
Act, 2005 claiming protection order under section 18<\/p>\n
and    monetary relief under section 20 and damages<\/p>\n
under section 22 of the Act.    This petition is filed<\/p>\n
under section 482 of Code of Criminal Procedure to<\/p>\n
quash   the   proceedings   contending   that   marital<\/p>\n
relationship with the petitioner and first respondent<\/p>\n
were dissolved by Annexure 2 order of Family Court,<\/p>\n
Thiruvananthapuram in O.P.755\/1999 and therefore first<\/p>\n
respondent is not an aggrieved person or  petitioner, a<\/p>\n
respondent as defined under the Act and therefore the<\/p>\n
petition filed under section 12 of the Act is not<\/p>\n
maintainable.    It  is  also  contended  that  as  per<\/p>\n
Annexure 1 affidavit filed along with the petition in<\/p>\n
the prescribed forum before the Magistrate, petitioner<\/p>\n
Crl.M.C.1034\/2009              2<\/span><\/p>\n
and first respondent were living separately from 24.5.1990<\/p>\n
onwards and in such circumstances, the alleged domestic<\/p>\n
violence if any was prior to the coming into force of the<\/p>\n
Act and therefore learned Magistrate has no jurisdiction to<\/p>\n
grant the relief and therefore the proceeding is to be<\/p>\n
quashed.\n<\/p>\n
      2.    Learned counsel appearing for the petitioner and<\/p>\n
first respondent were heard.\n<\/p>\n
      3.     Petitioner is the respondent before the learned<\/p>\n
Magistrate, in a petition filed by the respondents under<\/p>\n
section 12 of the Act.       Though by Annexure 2 order the<\/p>\n
marriage was dissolved, it is admitted fact that M.F.A<\/p>\n
5\/2002 is pending before this court challenging that order<\/p>\n
and therefore Annexure 2 order of dissolution has not<\/p>\n
become final.\n<\/p>\n
      4. The question whether the first respondent is an<\/p>\n
aggrieved person as defined under the Act or the petitioner<\/p>\n
is a respondent as defined under the Act are all matters to<\/p>\n
be decided by the learned Magistrate in the proceedings.<\/p>\n
It is to be borne in mind that petitioner is not an accused<\/p>\n
in a proceeding being tried by the learned Magistrate.   On<\/p>\n
the other hand, the Act itself provides that the petitioner<\/p>\n
is a respondent before the Magistrate.     Though a petition<\/p>\n
filed under section 12 is to be tried          following the<\/p>\n
Crl.M.C.1034\/2009             3<\/span><\/p>\n
procedure     provided in the Code of  Criminal  Procedure,<\/p>\n
essentially the proceedings is    not criminal in nature,<\/p>\n
except in a case where cognizance is taken as provided<\/p>\n
under section 31 of the Act, which provides that    on the<\/p>\n
breach of an interim order or a protection order passed<\/p>\n
under the Act cognizance could be taken.   The proceedings<\/p>\n
before the learned Magistrate pending is not on taking<\/p>\n
cognizance of an offence under section 31 of the Act.    In<\/p>\n
such circumstances, I do not find that this court has to<\/p>\n
invoke the extra ordinary powers under section 482 of Code<\/p>\n
of Criminal Procedure to quash the proceedings.  Petitioner<\/p>\n
is    at liberty to approach    the learned Magistrate to<\/p>\n
consider the maintainability of the petition either on the<\/p>\n
ground that he is not a respondent as defined under the Act<\/p>\n
or first respondent is not an aggrieved person as defined<\/p>\n
under    the   Act  or the Act is  not  applicable to  the<\/p>\n
allegations raised in the petition filed before the learned<\/p>\n
Magistrate. With that liberty the petition is dismissed.<\/p>\n
