A No.132 of 2003\n               ------------------------------------------------\n               Dated this the 29th day of October, 2008\n\n                             JUDGMENT\n<\/pre>\n<p>Balachandran, J<\/p>\n<p>      The     appellant               who         himself       is  an<\/p>\n<p>autorickshaw driver, aged 25 years met with a<\/p>\n<p>motor vehicle accident and sustained injuries<\/p>\n<p>while he was travelling in autorickshaw owned<\/p>\n<p>and driven by the first respondent and insured<\/p>\n<p>by the second respondent. He claimed a total<\/p>\n<p>compensation of Rs.1,50,000\/- as against which<\/p>\n<p>the Tribunal awarded a total compensation of<\/p>\n<p>Rs.40,500\/-. This appeal is filed claiming<\/p>\n<p>enhancement         in       compensation                 and   we are<\/p>\n<p>considering that aspect alone.<\/p>\n<p>      2. It is the case of the appellant that<\/p>\n<p>he is an autorickshaw driver by profession and<\/p>\n<p>is earning a monthly income of Rs.4,000\/-. The<\/p>\n<p>Tribunal estimated his income notionally at<\/p>\n<p><span class=\"hidden_text\">M. A. C. A No.132 of 2003           -2-<\/span><\/p>\n<p>       Rs.2,500\/- for want of proof of the income<\/p>\n<p>       alleged.          Ext.A4  disability  certificate is<\/p>\n<p>       certifying that the appellant has sustained<\/p>\n<p>       permanent disability of 6%. However, without<\/p>\n<p>       adopting any scientific data the Tribunal has<\/p>\n<p>       by    a     rough    and  ready  calculation  awarded<\/p>\n<p>       compensation          of  Rs.15,000\/-  only  to  the<\/p>\n<p>       appellant         towards  permanent  disability and<\/p>\n<p>       loss       of     earning   power.  As  regards   the<\/p>\n<p>       permanent          disability  assessed  at  6%  the<\/p>\n<p>       Tribunal has observed that the said disability<\/p>\n<p>       will adversely affect his earning capacity and<\/p>\n<p>       amenities of life at least to some extent. The<\/p>\n<p>       Tribunal which has discussed the evidence in<\/p>\n<p>       the case was also not of the view that the<\/p>\n<p>       percentage of disability assessed at 6% is<\/p>\n<p>       excessive. We are of the view that the 6%<\/p>\n<p>       disability certified under Ext.A4 disability<\/p>\n<p>       certificate has to be accepted for awarding<\/p>\n<p>       compensation          for  disability  and  loss  of<\/p>\n<p><span class=\"hidden_text\">M. A. C. A No.132 of 2003          -3-<\/span><\/p>\n<p>       earning power. When so assessed taking the<\/p>\n<p>       monthly income as Rs.2,500\/- and multiplier<\/p>\n<p>       17, the compensation due to be paid to the<\/p>\n<p>       appellant for permanent disability and loss of<\/p>\n<p>       earning power will be Rs.30,600\/- (2,500 x 12<\/p>\n<p>       x 6\/100 x 17). The Tribunal has awarded only<\/p>\n<p>       an amount of Rs.15,000\/- under this head.<\/p>\n<p>       Hence,        the  appellant   will  be  entitled to<\/p>\n<p>       additional compensation of Rs.15,600\/- on that<\/p>\n<p>       count. Considering the injuries sustained to<\/p>\n<p>       the appellant which takes in also fracture of<\/p>\n<p>       3rd and 4th        metatarsal and considering also<\/p>\n<p>       the      avocation     of   the   appellant   as  an<\/p>\n<p>       autorickshaw driver, we are of the view that<\/p>\n<p>       over and above the loss of earnings for two<\/p>\n<p>       months        awarded by   the   Tribunal a  sum  of<\/p>\n<p>       Rs.2,500\/- more has to be awarded to him by<\/p>\n<p>       way of loss of earnings for one more month.<\/p>\n<p>       Thus the additional compensation due to the<\/p>\n<p>       appellant is Rs.18,100\/-. The above amount<\/p>\n<p><span class=\"hidden_text\">M. A. C. A No.132 of 2003          -4-<\/span><\/p>\n<p>       shall be deposited by the second respondent\/<\/p>\n<p>       Insurance Company with interest at 7.5% per<\/p>\n<p>       annum from the date of application till the<\/p>\n<p>       date of deposit within two months from today.<\/p>\n<p>       On     such       deposit the  appellant  shall     be<\/p>\n<p>       entitled to withdraw the same.\n<\/p>\n<p>              3.
