No.113 of 2004 on<\/p>\n<p>the file of the court of the Additional District Judge of<\/p>\n<p>Alappuzha, dissatisfied with the compensation awarded by<\/p>\n<p>the Kerala State Electricity Board, on account of the trees<\/p>\n<p>cut from the property of the respondent for drawing<\/p>\n<p>Punnapra-Edathua 110 KV line.\n<\/p>\n<p>     2.   The court below relied on the decision reported in<\/p>\n<p>Kumba Amma vs. KSEB (2000 (1) KLT 542) and<\/p>\n<p>enhanced the compensation for the trees cut. As regards<\/p>\n<p>the claim for diminution of land value, the court below<\/p>\n<p>enhanced the compensation amount even after finding that<\/p>\n<p>there is no injurious affection as contended by the<\/p>\n<p>respondent. It was also found that an extent of 10<\/p>\n<p>cents was injuriously affected. Fixing the market value<\/p>\n<p><span class=\"hidden_text\">CRP No.398\/2008                    2<\/span><\/p>\n<p>at ` 10,000\/- per cent, compensation was awarded for the<\/p>\n<p>diminution     of   land   value    as well.   The total enhanced<\/p>\n<p>compensation awarded is ` 23,195\/-.\n<\/p>\n<p>     3.     <a href=\"\/doc\/1541957\/\">In Kerala State Electricity Board vs. Livisha and<\/p>\n<p>others<\/a> (2007 (6) SCC 792), the Supreme Court held thus :<\/p>\n<blockquote><p>                  &#8220;10. The situs of the land, the distance<\/p>\n<p>            between the high voltage electricity line laid<\/p>\n<p>            thereover, the extent of the line thereon as also<\/p>\n<p>            the fact as to whether the high voltage line<\/p>\n<p>            passes over a small tract of land or through the<\/p>\n<p>            middle of the land and other similar relevant<\/p>\n<p>            factors in our opinion would be determinative.<\/p>\n<p>            The value of the land would also be a relevant<\/p>\n<p>            factor. The owner of the land furthermore, in a<\/p>\n<p>            given situation may lose his substantive right to<\/p>\n<p>            use the property for the purpose for which the<\/p>\n<p>            same was meant to be used.\n<\/p><\/blockquote>\n<blockquote><p>                  11.  In so far as the compensation in<\/p>\n<p>            relation to fruit-bearing trees are concerned the<\/p>\n<p>            same would also depend upon the facts and<\/p>\n<p>            circumstances of each case.&#8221;<\/p><\/blockquote>\n<p><span class=\"hidden_text\">CRP No.398\/2008                 3<\/span><\/p>\n<p>     4.     In view of the principles laid down in <a href=\"\/doc\/1541957\/\">Kerala State<\/p>\n<p>Electricity Board vs. Livisha and others<\/a> (2007 (6) SCC 792),<\/p>\n<p>I am of the view that the matter requires fresh consideration<\/p>\n<p>by the court below. Accordingly, the order impugned is set<\/p>\n<p>aside and the matter is remitted back to the court below for<\/p>\n<p>fresh disposal in accordance with law. Both the parties will<\/p>\n<p>have an opportunity to produce documents and to adduce<\/p>\n<p>such other evidence.
