Ms.Archna Raval.\n<\/p>\n<p>2.\tAfter<br \/>\nreading out the F.I.R. to this Court, learned advocate Mr.Qureshi<br \/>\ntried to canvass that none of the offences lodged can be said to have<br \/>\nbeen constituted from the F.I.R. It is, however, not possible to<br \/>\nagree with him. The charges are for the offences punishable under<br \/>\nSections 420, 120B, 504, 506 and 511 of the Indian Penal Code.\n<\/p>\n<p>3.\tOn<br \/>\nreading of the F.I.R., it can be said that Mr.Qureshi is right to the<br \/>\nextent that the offence punishable under Section 420 of I.P.C. is not<br \/>\nconstituted. There is no ingredient emerging from the F.I.R. to<br \/>\nconstitute the offence punishable under Section 420 of I.P.C. and,<br \/>\ntherefore, the complaint, so far as it relates to offence punishable<br \/>\nunder Section 420, deserves to be quashed.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Mr.Qureshi has also drawn attention of this Court to the<br \/>\norder passed in Criminal Misc. Application No.7047 of 2003 dated<br \/>\n09.03.2005 wherein, same view is taken in respect of co-accused ?<br \/>\nUmesh R. Rao.\n<\/p>\n<p>5.\tIn<br \/>\nview of above, F.I.R. being C.R. No.I-494 of 2003 registered with<br \/>\nPradyuman Nagar Police Station, Rajkot is quashed qua the<br \/>\napplicant-accused No.1 so far as it relates to accusation for the<br \/>\noffence punishable under Section 420 of I.P.C. The Investigating<br \/>\nOfficer is free to proceed further with the investigation in respect<br \/>\nof the other offences. Rule is made absolute to the aforesaid extent.<br \/>\nInterim relief granted earlier would stand vacated.
