IInd Bail Application No. 26324 of 2009\n             Pushpendra Vs. State of U.P.\n\nHon. Ravindra Singh, J.\n<\/pre>\n<p>     Heard Sri P.N. Mishra, Senior Advocate assisted by Sri<br \/>\nApul Mishra, learned counsel for the applicant, learned<br \/>\nA.G.A. for the State of U.P., Sri I.M. Khan, learned counsel<br \/>\nfor the complainant and perused the record.\n<\/p>\n<p>     This is second bail application moved by the applicant<br \/>\nPushpendra with a prayer that he may be released on bail<br \/>\nin case crime no. 562 of 2007 under section 302 IPC, P.S.<br \/>\nDeoband, District Saharanpur. The Criminal Misc. First Bail<br \/>\nApplication No. 3984 of 2008 has been rejected by this court<br \/>\non 18.2.2008 after considering the merits of the case.\n<\/p>\n<p>     It is contended by learned counsel for the applicant that<br \/>\napplicant is in jail since 15.9.2007. The applicant is facing<br \/>\nthe sessions trial No. 723 of 2007 connected with S.T. No. 2<br \/>\nof 2008 and 3 of 2008 in which all the witnesses have been<br \/>\nexamined, the matter was listed for arguments, then the<br \/>\nfirst informant of this case moved the transfer application<br \/>\nNo. 419 of 2009 before this court in which the proceedings<br \/>\nof the trial have been stayed by the another bench of this<br \/>\ncourt vide order dated 30.7.2009. The above mentioned<br \/>\ntransfer application is not likely to be disposed of in the near<br \/>\nfuture. The applicant remained in jail for the last two years.<br \/>\nIn such circumstances, it is not proper to keep the applicant<br \/>\nin jail without any conviction. The first informant has<br \/>\nadopted all efforts so that the applicant may be kept in jail<br \/>\nfor a longer period without conviction.\n<\/p>\n<p>     In reply of the above contention, it is submitted by<br \/>\nlearned A.G.A. and learned counsel for the complainant that<br \/>\n the grounds taken on the merits of the case in the second<br \/>\nbail application have already been considered at the time of<br \/>\ndisposal of first bail application. So far as the the pendency<br \/>\nof the transfer application No. 419 of 2009 in which the<br \/>\ninterim dated 30.7.2009 have been passed staying the<br \/>\nproceedings of the trial is concerned, the applicant may<br \/>\nmove stay vacation application along with counter affidavit<br \/>\nso that    the   transfer   application   may    be   disposed   of<br \/>\nexpeditiously.\n<\/p>\n<p>     Considering the submissions made by learned counsel<br \/>\nfor the applicant, learned A.G.A, learned counsel for the<br \/>\ncomplainant and from the perusal of the record it appears<br \/>\nthe grounds taken in the second bail application touching the<br \/>\nmerits of the case have already been considered at the time<br \/>\nof disposal of first bail application. So far as the detention of<br \/>\nthe applicant is concerned, he is in jail since 15.9.2007 as<br \/>\nalleged by the counsel for the applicant, the proceedings of<br \/>\nthe trial have been stayed vide order dated 30.7.2009 which<br \/>\nhave been passed on the Criminal Misc. Transfer Application<br \/>\nNo. 419 of 2009 moved the first informant Smt. Brijesh, in<br \/>\nwhich the proceedings of the trial have been stayed, on this<br \/>\nground alone the applicant may not be released on bail<br \/>\nbecause it is open to the applicant to move the stay vacation<br \/>\napplication along with counter affidavit so that the transfer<br \/>\napplication may be disposed of expeditiously.
