He is having certified copies of all the awards<br \/>\nand he places the same on record.\n<\/p>\n<p>\tIn<br \/>\nview of the above, Mr.Soni, learned<br \/>\nAGP, seeks leave to bring on record the legal heirs of the<br \/>\ndeceased concerned as per the amended awards. He is permitted to do<br \/>\nso. Leave granted.\n<\/p>\n<p>\tThe<br \/>\npresent application is for condonation of delay of 413 days in<br \/>\npreferring the first appeals against the judgment and award passed by<br \/>\nthe<br \/>\nReference Court, which is impugned in the first<br \/>\nappeals.\n<\/p>\n<p>\tMr.Yatin<br \/>\nSoni, learned counsel appears for the original claimants including<br \/>\nthe legal heirs of the concerned deceased claimants, who are<br \/>\npermitted to be joined as parties, and states that the original<br \/>\nclaimants have no objection if delay is condoned and the original<br \/>\nclaimants are not insisting for costs. However,<br \/>\nhe submitted that in respect of the very village certain lands were<br \/>\nacquired by very notification<br \/>\nand in those cases awards were passed by the<br \/>\nReference Court, which came to be carried before this<br \/>\nCourt in First Appeal No.1509 of 2011 and allied matters, which were<br \/>\ndecided by this Court on 23.06.2011. Hence, in his submission the<br \/>\nmain first appeals are covered by the said decision of this Court<br \/>\nand, therefore, he submitted that the appeals may be heard at an<br \/>\nearly date.\n<\/p>\n<p>\tConsidering<br \/>\nthe facts and circumstances<br \/>\nand in view of the declaration made by the learned counsel for the<br \/>\nclaimants, the delay deserves to be condoned and, therefore, is<br \/>\ncondoned.\n<\/p>\n<p>\tThe<br \/>\napplications are allowed to the aforesaid extent. Rule made absolute.\n<\/p>\n<p>\tAmendment<br \/>\nshall be carried out on<br \/>\nor before 14.10.2011.
