Application No.6 of 2002 before the same Court; namely<br \/>\n\tCivil Judge (S.D.), Gandhidham, Kutch.\n<\/p>\n<p>Mr.Soni,<br \/>\n\tlearned Counsel for the respondent, contended that if the said<br \/>\n\tapplication is made, rights and contentions of his client should<br \/>\n\talso be kept open.\n<\/p>\n<p>Considering<br \/>\n\tthe facts and circumstances, permission is granted with liberty to<br \/>\n\tthe petitioner to make an application for restoration of Civil Misc.<br \/>\n\tApplication No.6 of 2002 before the same Court. However, if such an<br \/>\n\tapplication is made, rights and contentions of both the sides, in<br \/>\n\taccordance with law, shall remain open and the trial Court shall<br \/>\n\texamine the application in accordance with law, without in any<br \/>\n\tmanner influenced by any observations made in this order.\n<\/p>\n<p>Disposed<br \/>\n\tof accordingly.
