JUSTICE SATISH KUMAR MITTAL\n\n\nPresent:    Ms. Abha Rathore, Advocate, for the petitioner.\n\n            Mr. Mohnish Sharma, Advocate, for the respondents.\n\n                         ***\n\nSATISH KUMAR MITTAL , J.\n<\/pre>\n<p>            The petitioner has retired as Assistant Lineman from the<\/p>\n<p>services of Uttar Haryana Bijli Vitran Nigam Limited (hereinafter referred<\/p>\n<p>to as `the respondent Nigam&#8217;). In the present petition, he is claiming for<\/p>\n<p>counting of his work charge service for the purpose of pensionary benefits.<\/p>\n<p>The petitioner is also claiming grant of increments after his completing 8\/18<\/p>\n<p>years of service, higher standard scale, revision of his pensionary benefits<\/p>\n<p>and arrears of pension, after adding his work charge service period.<\/p>\n<p>            During the course of hearing, counsel for the petitioner states<\/p>\n<p>that she confines the prayer only to the counting of the work charge service<\/p>\n<p>of the petitioner for the purpose of pensionary benefits, and for the<\/p>\n<p>remaining benefits, the petitioner will approach the concerned authorities.<br \/>\n<span class=\"hidden_text\"> CWP No. 19441 of 2008                                                 -2-<\/span><\/p>\n<p>            The respondent Nigam has not counted the said service on the<\/p>\n<p>ground that in spite of the instructions issued vide circulars dated 6.8.1993<\/p>\n<p>and 9.8.1994, the petitioner did not exercise the option within the stipulated<\/p>\n<p>period. On the other hand, it is the case of the petitioner that he was not<\/p>\n<p>aware of the aforesaid instructions, as the same were not got noted from<\/p>\n<p>him. This issue has been considered and decided by a Division Bench of<\/p>\n<p>this Court in CWP No. 8573 of 2004, titled as Sh. Bharpoor Singh (Retired<\/p>\n<p>A.F.M.) versus Dakshin Haryana Bijli Vitran Nigam Ltd. and others,<\/p>\n<p>decided on 16.9.2005, while observing as under :\n<\/p>\n<blockquote><p>                   &#8220;It has been categorically pleaded by the petitioner that<br \/>\n            being an illiterate person and working in the field he did not<br \/>\n            have any knowledge about the instruction dated 6.8.1993<br \/>\n            (Annexure P-1). Nothing has been brought on record by the<br \/>\n            respondents that the aforesaid instructions were got noted from<br \/>\n            the petitioner by any official\/officer of the respondent-<br \/>\n            Corporation. As per para 4 of the instructions dated 6.8.1993<br \/>\n            (Annexure P-1), the instructions had to be got noted from all<br \/>\n            the employees and receipt of the letter had to be acknowledged,<br \/>\n            but no such acknowledgment has been placed on the record.<br \/>\n            Learned counsel for the petitioner brought to our notice that the<br \/>\n            issue involved in the present writ petition has been specifically<br \/>\n            dealt with by a Division Bench of this Court in the case of Lilu<br \/>\n            Ram Vs. State of Haryana and others, C.W.P. No. 2476 of<br \/>\n            1994, decided on 9.10.1997. A copy of the said judgment has<br \/>\n            been annexed with the writ petition as Annexure A-1. On<br \/>\n            perusal of the judgment in Lilu Ram&#8217;s case (supra), we are<br \/>\n            satisfied that the petitioner&#8217;s case is squarely covered by that<br \/>\n<span class=\"hidden_text\"> CWP No. 19441 of 2008                                                 -3-<\/span><\/p>\n<p>            judgment.&#8221;\n<\/p><\/blockquote>\n<p>In view of the said observations, rejection of the claim of the employee for<\/p>\n<p>not counting the work charge service was set aside. Dakshin Haryana Bijli<\/p>\n<p>Vitran Nigam Ltd. challenged the said decision of the Division Bench, by<\/p>\n<p>filing SLP (Civil) No. 7284 of 2006, which was taken up with Civil Appeal<\/p>\n<p>No. 4903 of 2009 (arising out of SLP (Civil) No. 23708 of 2005), titled as<\/p>\n<p>Dakshin Haryana Bijli Vitran Nigam and others Versus Bachan Singh, and<\/p>\n<p>has now been dismissed by the Hon&#8217;ble Supreme Court, while observing as<\/p>\n<p>under :\n<\/p>\n<blockquote><p>                  &#8220;In view of the law as has been articulated in a large<br \/>\n            number of cases where this court has observed that any<br \/>\n            discriminatory action on the part of the Government would be<br \/>\n            liable to be struck down. Hence, in this case, it would be totally<br \/>\n            unreasonable and irrational to deny the respondent the<br \/>\n            pensionary benefits under the scheme particularly when the<br \/>\n            appellants have failed to produce any record showing that the<br \/>\n            instructions dated 6.8.1993 and 9.8.1994 were actually got<br \/>\n            noted in writing by the respondent. In the absence of any such<br \/>\n            material it can well be inferred that the respondent had no<br \/>\n            knowledge about the options called by the appellants.&#8221;\n<\/p><\/blockquote>\n<p>In view of the aforesaid legal position, learned counsel for the respondents<\/p>\n<p>is not in a position to show any record, whereby the aforesaid instructions<\/p>\n<p>were ever got noted from the petitioner. In view of this conceded factual<\/p>\n<p>position, this writ petition is allowed and the respondents are directed to<\/p>\n<p>allow the petitioner to exercise his option in accordance with the<br \/>\n instructions dated 6.8.1993 and 9.8.1994, within a period of three months<\/p>\n<p><span class=\"hidden_text\">CWP No. 19441 of 2008                                                  -4-<\/span><\/p>\n<p>from today, and thereafter, the work charge service of the petitioner be<\/p>\n<p>counted towards the pensionary benefits.
