Justice M.SASIDHARAN NAMBIAR\n\n Dated :08\/04\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n          ===========================\n          CRL.M.C.No.1228    OF 2010\n          ===========================\n\n     Dated this the 8th day of April,2010\n\n                     ORDER\n<\/pre>\n<p>    The petitioner the de facto complainant<\/p>\n<p>filed a petition before Judicial First Class<\/p>\n<p>Magistrate&#8217;s Court-I, Ernakulam to commit the<\/p>\n<p>case to the Sessions Court contending that in<\/p>\n<p>addition to the offences charged against the<\/p>\n<p>accused  offences  under  section  3(1)(xi)  of<\/p>\n<p>Scheduled Caste and Scheduled Tribe (Prevention<\/p>\n<p>of Atrocities) Act is attracted.   By Annexure<\/p>\n<p>VI  order,  learned  Magistrate  dismissed  the<\/p>\n<p>petition.  This petition is filed under section<\/p>\n<p>482 of   Code of Criminal Procedure to quash<\/p>\n<p>Annexure VI order.\n<\/p>\n<p>    2.    Learned  counsel  appearing  for  the<\/p>\n<p>petitioner was heard.\n<\/p>\n<p>    3.  The argument of the learned counsel is<\/p>\n<p>that petitioner and the witnesses were examined<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.1228\/2010             2<\/span><\/p>\n<p>and their evidence shows that an offence under<\/p>\n<p>sections 3(1)(xi) of Scheduled Caste and Scheduled<\/p>\n<p>Tribe (Prevention of Atrocities) Act is attracted<\/p>\n<p>and therefore learned Magistrate is bound to commit<\/p>\n<p>the case.       Annexure VI order shows that the learned<\/p>\n<p>Magistrate on the evidence adduced did not find<\/p>\n<p>that     an    offence  under  sections    3(1)(xi)   of<\/p>\n<p>Scheduled Caste and Scheduled Tribe (Prevention of<\/p>\n<p>Atrocities) Act) is attracted.       Learned Magistrate<\/p>\n<p>dismissed the petition holding that &#8220;at this stage<\/p>\n<p>it is not possible to arrive at a conclusion<\/p>\n<p>whether the accused had committed the offence under<\/p>\n<p>section 3(1)(xi) of Scheduled Castes and Scheduled<\/p>\n<p>Tribe (Prevention of Atrocities) Act.       The petition<\/p>\n<p>was dismissed only as premature.          Petitioner is<\/p>\n<p>entitled       to move  an     application  on  adducing<\/p>\n<p>further evidence, if there are sufficient material<\/p>\n<p>to show that an offence under section 3(1)(xi) of<\/p>\n<p>Scheduled Caste and Scheduled Tribe (Prevention of<\/p>\n<p>Atrocities) Act is attracted.
