Against the same, the petitioner made a<br \/>\nrepresentation dated 24.01.2002 to respondent no.2 asking the reasons<br \/>\nfor such remarks. Thereafter, he submitted his detailed explanation<br \/>\nto the said remarks vide representation dated 05.02.2002. Pursuant<br \/>\nthereto, the respondent-authority passed the order dated 14.09.2004<br \/>\nby which the adverse remarks entered in the C.R. of the petitioner<br \/>\nwere expunged and the petitioner was graded as  an Average Officer<br \/>\nfor the said year. However, immediately thereafter, vide impugned<br \/>\norder dated 14.10.2004, the respondent-authority cancelled the<br \/>\nearlier order dated 14.09.2004. Being aggrieved by the same, the<br \/>\npetitioner has preferred the present petition.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. The main contention of the petitioner is that the impugned<br \/>\norder dated 14.10.2004 came to be passed without affording any<br \/>\nopportunity to the petitioner to present his case and therefore, the<br \/>\nsame is bad in law and deserves to be quashed and set aside. Having<br \/>\ngone through the record, I find substance in the said contention<br \/>\nraised by the learned counsel for the petitioner. There is no<br \/>\nmaterial on record to show that before passing the impugned order<br \/>\ndated 14.10.2004, the respondent-authority has afforded any<br \/>\nopportunity to the petitioner to present his case. Learned AGP Mr.<br \/>\nShah is also not in a position to show from the record that any such<br \/>\nopportunity was afforded to the petitioner. Thus, on the ground of<br \/>\nviolation of the principles of natural justice, the impugned order<br \/>\ncannot be sustained in the eyes of law and deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, the petition is allowed. The impugned order dated<br \/>\n14.10.2004 passed by the respondent-authority is quashed and set<br \/>\naside. Rule is made absolute.
