G.P., appearing for the applicants.<br \/>\nThough served, no one has entered appearance for the respondent.\n<\/p>\n<p>\tThis<br \/>\napplication under Section 5 of the Limitation Act is filed for<br \/>\ncondonation of delay of 541 days caused in filing the above first<br \/>\nappeal.\n<\/p>\n<p>\tHaving<br \/>\nregard to the averements made in the application and upon taking into<br \/>\nconsideration the submissions made by the learned Addl. G.P. for the<br \/>\napplicants, it emerges that the applicants cannot be said to be<br \/>\nnegligent in filing the appeals and that the delay which has occurred<br \/>\nin filing the appeal, occurred on account of reasons mentioned in the<br \/>\napplication. The applicants have tendered sufficient explanations<br \/>\nregarding the delay caused in filing the appeals which, in the facts<br \/>\nof the case, is sufficient for the purpose on hand. It also comes out<br \/>\nfrom the applications that the delay is not result of any malafide or<br \/>\nextraneous reason. Furthermore, though served opponent has not<br \/>\nentered appearance and has not opposed the application or disputed<br \/>\nthe explanation given in the application and the explanation has<br \/>\nremained uncontroverted. Sufficient cause has also been made out by<br \/>\nthe applicants, in support of the relief prayed for. Hence, there is<br \/>\nsatisfactory explanation coupled with sufficient cause and absence of<br \/>\nany malafide or extraneous reasons. Therefore, relief prayed for in<br \/>\nparagraph 5(a) deserves to be granted.  Hence, the delay of 541 days<br \/>\ncaused in filing the appeal is condoned.
