With the consent of the learned Counsel<br \/>\n\tappearing for both the sides, the matter is finally heard.\n<\/p>\n<p>The<br \/>\n\tshort facts of the case appear to be that the sample of Dextrose<br \/>\n\tInjection I.P. (10% W\/v) was taken by the respondent No.2 belonging<br \/>\n\tto the petitioner, which is a product manufactured by the<br \/>\n\tpetitioner.  As per the provisions of the Drugs and Cosmetics Act,<br \/>\n\t1940 (hereinafter referred to as the &#8216;Act&#8217;) read with the Rules one<br \/>\n\tportion of the sample was given to the petitioner, another was<br \/>\n\tretained by the Inspector for sending it to the laboratory at the<br \/>\n\tState level and third portion was retained for production in the<br \/>\n\tCourt.  It appears that the sample, which was retained by respondent<br \/>\n\tNo.2 has been sent for laboratory testing and it is found that the<br \/>\n\tsame is not meeting with the requisite parameters.  The show-cause<br \/>\n\tnotice has been issued by respondent No.2 to show cause as to why<br \/>\n\tthe prosecution should not be filed.  The petitioner had intimated<br \/>\n\tto respondent No.2 that as per the provisions of Section 25(3) of<br \/>\n\tthe Act, the sample also be tested by the Central Laboratory.  No<br \/>\n\torders are passed by respondent No.2, nor any action for sending the<br \/>\n\tsaid sample to the Central Laboratory for testing.  It is the<br \/>\n\tcontention of the petitioner that the expiry date of the said drug<br \/>\n\tis 31.12.2008.  Under these circumstances, the present petition.\n<\/p>\n<p>The<br \/>\n\tpetitioner has challenged the show-cause notice Annexure &#8216;A&#8217;, which<br \/>\n\tMr.Soparkar, during the course of the hearing, has declared that the<br \/>\n\tpetitioner is not pressing the said relief and the petitioner shall<br \/>\n\tappear before the concerned authority.  However, he submitted that<br \/>\n\the is pressing for prayer 7(A) only for seeking directions to the<br \/>\n\trespondent to send the sample for testing by Central Drug<br \/>\n\tLaboratory, Kolkata.\n<\/p>\n<p>Heard<br \/>\n\tMr.Soparkar, learned Counsel with Mr.Bhatt for the petitioner and<br \/>\n\tMr.Pujari, learned AGP for the State authorities.\n<\/p>\n<p>It<br \/>\n\tappears that as per the Scheme of the Act read with the Rules and<br \/>\n\tmore particularly Section 25 of the Act, the right is provided to<br \/>\n\tthe person concerned to request the Inspector or the Court before<br \/>\n\twhom the proceedings in respect of the contravention are pending if<br \/>\n\the intends to adduce evidence in contravention of the report.<br \/>\n\tSub-section (4) of Section 25 of the Act provides that in such<br \/>\n\tcircumstances if the intention is notified, the Magistrate shall<br \/>\n\tdirect for testing or analysis by or under the authority of the<br \/>\n\tDirector of Central Drug Laboratory.  The said aspect is with the<br \/>\n\texpress provisions of the statute that such report shall be<br \/>\n\tconclusive evidence on the facts stated therein.\n<\/p>\n<p>As<br \/>\n\tthe complaint is not filed in the present case before the learned<br \/>\n\tMagistrate, the petitioner would not be in a position to seek<br \/>\n\tappropriate orders of the learned Magistrate. Considering the<br \/>\n\tpeculiar facts and circumstances, in the present case that the drug<br \/>\n\this to expire on 31.12.2008, if the retesting is not undertaken by<br \/>\n\tthe Central Drug Laboratory, it may not be possible for all time to<br \/>\n\tcome.  Therefore, keeping in view the availability of the right to<br \/>\n\tthe person concerned as provided under Section 25 of the Act and the<br \/>\n\tpeculiar facts and circumstances as referred to herein above, no<br \/>\n\tprejudice will be caused, if the sample, which is in possession of<br \/>\n\tthe Drug Inspector, may be for Court purpose, is sent to the Central<br \/>\n\tDrug Laboratory.  It appears that in the present case no orders are<br \/>\n\tpassed by the Drug Inspector for sending the sample to the Central<br \/>\n\tDrug Laboratory, may be on the ground that there is no order of the<br \/>\n\tlearned Magistrate.  However, if the matter is kept as it is until<br \/>\n\tthe prosecution is filed and is brought before the Magistrate, in<br \/>\n\tthe meantime the drug may expire.   Therefore, the right, if any, in<br \/>\n\tfuture at the prosecution may be lost for all time to come for<br \/>\n\tgetting the drug tested through Central Drug Laboratory.  Hence, it<br \/>\n\tappears that the matter can be considered for sending the sample for<br \/>\n\ttesting through Central Drug Laboratory.\n<\/p>\n<p>It<br \/>\n\tmay be recorded that this Court (Coram: (Ms.) H.N.Devani, J.) in<br \/>\n\tSpecial Criminal Application No.342 of 2007 in case of  Zest<br \/>\n\tPharma v. State of Gujarat and Anr.\n<\/p>\n<p>\tvide its decision dated 28.12.2007 had observed that until  the<br \/>\n\tcomplaint is filed before the Magistrate, such power could not be<br \/>\n\texercised by the Magistrate and, therefore, the application was<br \/>\n\trightly rejected by the Magistrate.  However, in the very decision,<br \/>\n\tthis Court took the view that no prejudice is caused if the drug<br \/>\n\tsent for testing to the Central Drug Laboratory under the provisions<br \/>\n\tof Section 25 of the Act.\n<\/p>\n<p>\tIn<br \/>\n\tview of the above, respondent No.2 is directed to sent the sample<br \/>\n\tfor testing from amongst the samples taken by him for laboratory<br \/>\n\ttesting or for production in the Court, to the Central Drug<br \/>\n\tLaboratory, Kolkata under the provisions of Section 25 of the Act<br \/>\n\twithin two weeks from the date of receipt of the order of this Court<br \/>\n\tat the cost of the petitioner.\n<\/p>\n<p>\tIt<br \/>\n\tis also clarified that it would be open to the respondents to<br \/>\n\tproceed in pursuance of the show-cause notice in accordance with law<br \/>\n\tand the present order shall not operate as a bar in taking decision<br \/>\n\tas to whether the proceedings should be launched based on the report<br \/>\n\tof the State Laboratory or not.\n<\/p>\n<p>\tThe<br \/>\n\tpetition is allowed to the aforesaid extent. Rule made absolute<br \/>\n\taccordingly.
