They had given irrevocable<br \/>\n\tpower of attorney to deal with the suit land in favour of<br \/>\n\trespondents No. 1 and 2 herein, original defendants No. 1 and 2 by a<br \/>\n\tdeed dated 14.2.1995. They had also entered into an agreement to<br \/>\n\tsale the said property in favour of the said parties by creating<br \/>\n\tdocument on 13.3.1995. They filed a Civil Suit for permanent<br \/>\n\tinjunction and declaration by filing exh.5 application seeking<br \/>\n\tinterim injunction.\n<\/p>\n<p>Defendants<br \/>\n\tNo. 1 and 2 opposed the suit and contended inter-alia that<br \/>\n\tirrevocable power of attorney was coupled with full payment of sale<br \/>\n\tprice of land in question. This irrevocable power of attorney was<br \/>\n\tcoupled with consideration. Such power of attorney could not have<br \/>\n\tbeen cancelled and acting on the basis of power of attorney, they<br \/>\n\thave already sold the land in question to defendant No.3.\n<\/p>\n<p>Defendant<br \/>\n\tNo.3 also opposed the suit and filed application exh.18 seeking<br \/>\n\tcounter injunction against the plaintiffs disturbing his possession<br \/>\n\tand  enjoyment of the land in question.\n<\/p>\n<p>Learned<br \/>\n\tJudge by detailed judgement dated 12.2.2008, as already noted,<br \/>\n\trejected exh.5 application of the plaintiffs but allowed exh.18<br \/>\n\tapplication filed by defendant No.3. In the impugned order, learned<br \/>\n\tJudge has discussed at length the manner in which the power of<br \/>\n\tattorney came to be created. Learned Judge has noted that on<br \/>\n\t13.3.1995, an agreement to sale was also created by the plaintiffs.<br \/>\n\tIt was observed that the plaintiffs had not disclosed fully all<br \/>\n\tparticulars. Learned Judge also came to the conclusion that<br \/>\n\tirrevocable power of attorney was coupled with creation of interest<br \/>\n\tand in view of provisions contained in Section 202 of the Contract<br \/>\n\tAct, same could not have been revoked. Learned Judge therefore, came<br \/>\n\tto the conclusion that between the plaintiffs and defendants No. 1<br \/>\n\tand 2 there is not a simple relation of mere principal and agent,<br \/>\n\tbut the plaintiffs are sellers and defendants are purchasers of land<br \/>\n\tin question. He also came to the conclusion that the defendant No.3<br \/>\n\tenjoys valid and legal possession of the disputed property since<br \/>\n\t13.7.2004 which was sold to him on the basis of power of attorney.<br \/>\n\tIt was observed that defendant No.1 had handed over the possession<br \/>\n\tof suit land to defendant No.3. Learned Judge has also observed that<br \/>\n\tmodus operandi applied by the plaintiffs was to circumvent the<br \/>\n\tprovisions of Urban Land Ceiling Act.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Shri S.M. Shah however, vehemently submitted that the<br \/>\n\tlearned Judge has not given any reasons to come to the conclusion<br \/>\n\tthat possession of the land in question was handed over by the<br \/>\n\tplaintiffs to the defendants No. 1 and 2 which in turn could have<br \/>\n\tbeen handed over to defendant No.3.\n<\/p>\n<p>Learned<br \/>\n\tJudge has in paragraph-31 turned down the contention of the Counsel<br \/>\n\tfor the plaintiffs that they are still in possession of the suit<br \/>\n\tland. Simultaneously, learned Judge observed that defendant No.3 is<br \/>\n\tin valid and legal possession of the disputed property since<br \/>\n\t13.7.2004 handed over to him by defendant No.1. At paragraph-42 of<br \/>\n\tthe order, learned Judge further recorded that defendant No.3 has<br \/>\n\tbecome absolute owner of the suit land and as per the findings of<br \/>\n\tearlier portion of the order, he has valid and legal possession of<br \/>\n\tthe suit land.\n<\/p>\n<p>It<br \/>\n\tis true that learned Judge may not have recorded elaborate reasons<br \/>\n\tto link the possession of defendant No.3 with that of defendants No.<br \/>\n\t1 and 2, however, only for this purpose, it would not be appropriate<br \/>\n\tto disturb otherwise valid order, particularly, when I find that in<br \/>\n\tthe document creating irrevocable power of attorney dated 14.2.1995,<br \/>\n\tit is clearly mentioned that plaintiff while giving irrevocable<br \/>\n\tpower of attorney in favour of defendants No. 1 and 2 with respect<br \/>\n\tto the land in question, permitted the said defendants to take all<br \/>\n\tappropriate procedure for the land in question and also authorised<br \/>\n\tthe said attorneys to either convert the land into nonagricultural<br \/>\n\tland or to continue the land to put in agricultural use. This would<br \/>\n\tclearly indicate that by virtue of this very same document,<br \/>\n\tpossession was handed over to defendants No. 1 and 2. When the<br \/>\n\tdefendants No. 1 and 2 in turn created a registered sale deed in<br \/>\n\tfavour of respondent No.3 and decided that possession be handed over<br \/>\n\tto the said defendant, I do not find that the conclusion of the<br \/>\n\tlearned Judge that defendant No.3 is in valid possession thereof<br \/>\n\tneed to be interfered at this stage.\n<\/p>\n<p>In<br \/>\n\tthe result, I do not find that the learned Judge committed any<br \/>\n\terror.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Shri S.M. Shah for the appellants relied on decision of the<br \/>\n\tApex Court in case of <a href=\"\/doc\/23337\/\">Daya Ram v. Raghunath &amp; ors.<\/a><br \/>\n\treported in 2007(8) Scale 552 to contend that order which is not a<br \/>\n\treasoned order cannot be allowed to sustain. In the present case,<br \/>\n\thowever, I find that order passed by the learned Judge is not devoid<br \/>\n\tof reasons.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances, the appeal is dismissed. Needless to add all the<br \/>\n\tobservations made in this order as well as those made by the learned<br \/>\n\tJudge in the impugned order are purely prima facie in nature and<br \/>\n\twill not come in way of either sides in pursuing the pending civil<br \/>\n\tsuit.\n<\/p>\n<p>Appeal<br \/>\n\tstands disposed of accordingly.\n<\/p>\n<p>Civil<br \/>\n\tApplication also stands disposed of.\n<\/p>\n<p>Further<br \/>\n\tdealing of land in question by defendant No.3 shall also be subject<br \/>\n\tto the outcome of the civil suit.\n<\/p>\n<p>(Akil<br \/>\n\tKureshi,J.) <\/p>\n<p>(raghu)<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Ajawaliben vs Bhanubhai on 5 September, 2008 Author: Akil Kureshi,&amp;Nbsp;
