State of Raj. &amp; Ors.\n<\/p>\n<pre>Date Of Order     ::     22\/10\/2010\n\nHon'ble Mr. Justice Ajay Rastogi \n\nMr. Anoop Dhand, for petitioner.\n<\/pre>\n<p>\t\tThe petitioners claim themselves to be the local residents of Gram Panchayat Mandawara and their basic grievance is that letter of administration and financial sanction dt.21.04.2010 (Annx.9) which has been issued by Zila Parishad, Sikar for construction of Bharat Nirman Rajeev Gandhi Sewa Kendra at Gram Panchayat level at place village Khori is contrary to the policy decision of the government.\n<\/p>\n<p>\t\tCounsel submits that since present village Sarpanch of Gram Panchayat Mandwara is residing in village Khori, she by misrepresentation got administration and financial sanction for construction of  Bharat Nirman Rajeev Gandhi Sewa Kendra at village Khori and in such circumstances, the sanction order issued by Zila Parishad, Sikar dt.21.04.2010 requires interference by this Court.\n<\/p>\n<p>\t\tThe submission made is wholly without substance for the reason that these all are policy decisions of the Government where to construct their building and it is always expected from the Government that while taking decision to choose the place for construction, merits and demerits must have been taken note of and in absence of any malice being imputed against the authority, it cannot be considered to be arbitrary which may require interference by this Court. Apart from it permission for construction has been sanctioned for Gram Panchayat Mandwara of which petitioners are residents.
