Deendayal Upadhyaya Institute For The\n                                       Physically Handicapped\n\nDate of Hearing                :       20.04.2011\n\n                                          ORDER\n<\/pre>\n<p>       Shri Chandan Kumar Chandan, Ms. Ruchika Yadav, &amp; Ms. Priyanka Sarpal, the<br \/>\nappellants have filed this appeal dated 16.8.2010 before the Commission against Pt.<br \/>\nDeendayal Upadhyaya Institute for the Physically Handicapped (PDUIPH), New Delhi for<br \/>\nproviding incomplete and contradictory and false information to their RTI-request dated<br \/>\n26.5.2010, which came up for hearing on 20.04.2011. One of the appellants, Ms. Ruchika<br \/>\nYadav was present in person, whereas the respondents were represented by Shri S.C.<br \/>\nRanga, FAA, Ms. Tejender Kaur, PIO, Shri G.V. Gupta, Lecturer and Shri G. Pandian,<br \/>\nLecturer.\n<\/p>\n<p>2.     The appellants filed RTI-request dated 26.5.2010 seeking information on six RTI-<br \/>\nqueries &#8211;\n<\/p>\n<blockquote><p>       &#8220;(1) To whom Mr. S.C. Ranga, handed over charge of duties during the study leave; (2)<br \/>\n       To whom Mr. G.V. Gupta, handed over charge of duties during the study leave; (3) To<br \/>\n       whom Mr. G. Pandian, handed over charge of duties during the study leave; (4) To whom<br \/>\n       Mr. Rakesh Rawat, handed over charge of duties during the study leave; (5) Please<br \/>\n       provide the details about Mr. Inder Vijay Singh present in the bridge course classes<br \/>\n       during the period 22.8 to 31.8.2008; and (6) Please provide the copy of admit card which<br \/>\n       Mr. K. Ramprabhu has mentioned in his letter of 18.7.2007 addressed to Director.&#8221;\n<\/p><\/blockquote>\n<p>The PIO vide letter No. INF\/IPH\/RTI\/09-10\/204230\/395\/10 dated 17.6.2010 has provided<br \/>\npoint-wise reply to the appellants.\n<\/p>\n<p><span class=\"hidden_text\">                                              -2-<\/span><\/p>\n<p>                                                          Case No. CIC\/SS\/A\/2011\/000156<\/p>\n<p>3.     Aggrieved by the decision of PIO, the appellants preferred first-appeal on 1.7.2010<br \/>\nbefore FAA. The FAA vide order No. INF\/IPH\/RTI\/09-10\/230\/603\/10 dated 26.7.2010 has<br \/>\ndecided appellant&#8217;s first-appeal, with the observation that the factual position has been<br \/>\nstated by PIO. The information pertaining to point no. 5 regarding the presence of Shri<br \/>\nInder Vijay Singh in bridge course class has been reported as not traceable by Shri G.V.<br \/>\nGupta who is the deemed PIO of this information.\n<\/p>\n<p>4.     After hearing the parties and on perusal of the relevant documents on file, the PIO<br \/>\nis directed to search the attendance register and provide information to the appellants on<br \/>\nPoint No. 5 within two weeks of the receipt of this order.
