Justice ANTONY DOMINIC\n\n Dated :18\/01\/2008\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                     ===============\n                  W.P.(C) NO. 2193 OF 2008 J\n               =====================\n\n          Dated this the 18th day of January, 2008\n\n                          J U D G M E N T\n<\/pre>\n<p>       This writ petition concerns to the appointment of an ARD<\/p>\n<p>notified by Ext.P1. Petitioner was one of the candidates who lost<\/p>\n<p>in the selection process and Ext.P2 is the order that was issued<\/p>\n<p>by the District Supply Officer where it has been found that the<\/p>\n<p>petitioner is not a resident of the area notified. Appeal filed by<\/p>\n<p>the petitioner before the District Collector was also unsuccessful.<\/p>\n<p>However, in the revision that was filed, petitioner succeeded.<\/p>\n<p>Dealing with the residence qualification of the petitioner,<\/p>\n<p>Revisional authority held that the petitioner is entitled to benefit<\/p>\n<p>of doubt. It is on that basis relief was granted.<\/p>\n<p>      2.   However, the aggrieved persons carried the matter in<\/p>\n<p>second revision before the Government and the Government in<\/p>\n<p>Ext.P5 set aside Ext.P4 order of the First Revisional Authority. In<\/p>\n<p>WPC 2193\/08<br \/>\n<span class=\"hidden_text\">                                 :2 :<\/span><\/p>\n<p>Ext.P5, Government have come to a finding that the petitioner is<\/p>\n<p>not &#8220;normally a resident of the locality&#8221; notified in Ext.P1. It is<\/p>\n<p>on that basis, appointment of the 1st respondent has been<\/p>\n<p>upheld.\n<\/p>\n<p>      3.   Counsel for the petitioner submits that he is a resident<\/p>\n<p>of the area notified and therefore he is eligible to be appointed. I<\/p>\n<p>am not in a position to accept his contention. In Ext.P2 order of<\/p>\n<p>the District Supply Officer, it has been found that the petitioner is<\/p>\n<p>not a resident of the area notified. This finding of the District<\/p>\n<p>Supply Officer has been confirmed in appeal by the District<\/p>\n<p>Collector in Ext.P3. However, concurrent findings thus arrived at,<\/p>\n<p>was reversed by the First Revisional Authority only giving benefit<\/p>\n<p>of doubt to the petitioner. In a matter like this, extension of the<\/p>\n<p>theory of benefit of doubt sounds strange and is quite<\/p>\n<p>uncommon. Be that as it may, it is seen from Ext.P5 order of the<\/p>\n<p>Government, where the issue of residence of the petitioner has<\/p>\n<p>been dealt with in the following terms:\n<\/p>\n<p>     The main issue to be settled and decided by the Govt.<\/p>\n<p>     is to ascertain unambiguously the residentiality of<br \/>\n     Sri.Padmakumar. Accordingly, a detailed local enquiry<br \/>\n     was    conducted    through     the   District   Collector,<br \/>\n     Thiruvananthapuram. As per the report received from<br \/>\n     the District Collector, Thiruvananthapuram read as<br \/>\n     eight paper above, it is revealed that Sri.Padmakumar<\/p>\n<p>WPC 2193\/08<br \/>\n<span class=\"hidden_text\">                               :3 :<\/span><\/p>\n<p>    is not &#8220;normally a resident of the locality&#8221;, the prime<br \/>\n    and    foremost   requirement    stipulated   in   Kerala<br \/>\n    Rationing Order.    Hence Sri.Padmakumar loses an<br \/>\n    important ground to back up his eligibility for being<br \/>\n    appointed as licensee, and his application is liable to be<br \/>\n    rejected.\n<\/p>\n<p>     Thus Government having conducted an independent enquiry<\/p>\n<p>through the Collector and have acted upon a report to the effect<\/p>\n<p>that petitioner was not a resident of the locality concerned.<\/p>\n<p>There is nothing on record to indicate that the findings rendered<\/p>\n<p>by the Supply Officer and confirmed by the District Collector and<\/p>\n<p>again confirmed by the Government is perverse for any reason.<\/p>\n<p>     If that be so, the writ petition merits only to be dismissed<\/p>\n<p>and I do so.\n<\/p>\n<\/p>\n<p>                                    ANTONY DOMINIC, JUDGE.\n<\/p>\n<p>Rp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court V.Padmakumar vs Smt.N.Sreekala on 18 January, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 2193 of 2008(J) 1.
