DABHI, APP, for the Respondents\n \n\n \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 17\/01\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>\t\tThe<br \/>\napplicant &#8211; convict prisoner, who, by judgement and order dated<br \/>\n16.5.2006 rendered in Sessions Case No. 26 of 2006 passed by learned<br \/>\nSessions Judge, Dahod, has been convicted for the offence punishable<br \/>\nunder Section 302 etc. of the Indian Penal Code and sentenced to life<br \/>\nimprisonment , has filed this application through jail praying to<br \/>\nenlarge him on temporary bail for a period of 30 days to enable him<br \/>\nto perform the marriage ceremony of his son which is scheduled on<br \/>\n25.1.2011 and 26.1.2011.\n<\/p>\n<p>2.\t\tWe<br \/>\nhave gone through the application and the supporting documents that<br \/>\nform part of the application and have considered the submissions<br \/>\nadvanced by Mr. Dabhi, learned APP, for the respondent State of<br \/>\nGujarat. We have also gone through the jail remarks sheet forwarded<br \/>\nby the jail authority.\n<\/p>\n<p>3.\t\tUpon<br \/>\nperusal of the jail remarks sheet, we find that the applicant has<br \/>\nundergone more than 5 years  imprisonment. During the said period, he<br \/>\nwas released on temporary bail on one occasion and enjoyed furlough<br \/>\nleave on two occasions. On all the occasions, he has surrendered in<br \/>\ntime. His conduct in jail is good. There is no jail punishment.<br \/>\nBesides this, on perusal of the copy of the invitation card it is<br \/>\nseen that the marriage of his son will be performed on 25.1.2011 and<br \/>\n26.1.2011.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of this, we deem it expedient to consider the plea of the<br \/>\napplicant-convict prisoner to release him on temporary bail for a<br \/>\nperiod of 15 days from the date of his actual release.\n<\/p>\n<p>5.\t\tFor<br \/>\nthe foregoing reasons, the application succeeds and it is allowed<br \/>\naccordingly. The applicant-convict prisoner FATESINH<br \/>\nMAGANBHAI is ordered to be<br \/>\nreleased on temporary bail for a period of 15 days from the date of<br \/>\nhis actual release on executing a personal bond of Rs. 5,000\/- before<br \/>\nthe jail authority on usual terms and conditions. The applicant shall<br \/>\nsurrender to the jail authority on completion of 15 days from the<br \/>\ndate of his release without fail. During the period of temporary<br \/>\nbail, the applicant shall not abuse the liberty granted to him and<br \/>\nshall maintain law and order.\n<\/p>\n<p>\t\tRule<br \/>\nis made absolute accordingly.\n<\/p>\n<p>\t\t\t\t\t\t\t\t(A.M.\n<\/p>\n<p>KAPADIA, J)<\/p>\n<p>   (BANKIM N.
