KRISHNAN, J.\n                        ---------------------------\n                     CRL.A.NO.1088 OF 2003\n                        ------------------------------\n              Dated this the 23rd day of June, 2009\n\n                            JUDGMENT\n<\/pre>\n<p>      This is an appeal preferred against the conviction and<\/p>\n<p>sentence passed by the Sessions Judge, Fast Track Court No.I,<\/p>\n<p>Manjeri in S.C.No.361\/2001. Four accused were in the party<\/p>\n<p>array and the 4th accused died and the present appellants are<\/p>\n<p>accused 1 and 2 in the case before me. They were convicted<\/p>\n<p>under Section 56(d) of the Abkari Act and directed to pay a<\/p>\n<p>fine of Rs.2,000\/= and in default, to undergo imprisonment for<\/p>\n<p>six months. The police filed the charge sheet under Section<\/p>\n<p>55(h) of the Abkari Act.\n<\/p>\n<p>      2. I am not going into the factual metrics in detail for the<\/p>\n<p>reason    that  the   materials        available will show that the<\/p>\n<p>prosecution itself is void. Admittedly, the case was detected by<\/p>\n<p>a competent officer called the S.I of Police, but later,        the<\/p>\n<p>investigation as well as laying of the charge was done by the<\/p>\n<p>Assistant Sub Inspector of Police. Under the provisions of the<\/p>\n<p>Abkari Act by governmental notification, the Abkari officers<\/p>\n<p>shall be only the person not below the rank of a Sub Inspector<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><br \/>\nCRL.A.NO.1088\/03<\/p>\n<p>of Police.    A situation arose in <a href=\"\/doc\/858474\/\">Vikraman v. State of Kerala<\/a><\/p>\n<p>(2007 (1) KLT 1010) where,         the    Assistant Sub Inspector<\/p>\n<p>conducted later part of the investigation and laid the charge. A<\/p>\n<p>learned Single Judge of this Court held that it will not vitiate<\/p>\n<p>the trial. Later, the matter was referred to a Division Bench,<\/p>\n<p>which resulted in <a href=\"\/doc\/1381730\/\">Subash v. State of Kerala<\/a> (2008 (2) KLT<\/p>\n<p>1047).    The   question   whether    the decision rendered    in<\/p>\n<p>Vikraman&#8217;s case was right or not was considered by the<\/p>\n<p>Division Bench of this Court in the said decision in Paragraph-7<\/p>\n<p>of the judgment, which reads as follows:<\/p>\n<blockquote><p>               &#8220;7. <a href=\"\/doc\/858474\/\">In Vikraman v. State of Kerala<\/a><br \/>\n         (2007 (1) KLT 1010) it was held that the mere<br \/>\n         fact   that     the  Assistant    Sub   Inspector<br \/>\n         conducted later part of investigation and laid<br \/>\n         charge will not vitiate the trial. We are of the<br \/>\n         opinion that on the plain reading of Section 50<br \/>\n         of   the Abkari Act     the Magistrate has no<br \/>\n         jurisdiction to take cognizance of the case as<br \/>\n         the report was filed by a person other than<br \/>\n         an Abkari Officer. Hence, Vikraman&#8217;s case<br \/>\n         cannot be     acceptable as an       authoritative<br \/>\n         decision that    despite the mandate in S. 50<br \/>\n         Magistrate can take cognizance of a report<br \/>\n         filed by a person other than an Abkari officer.<\/p><\/blockquote>\n<p>         In this connection we also refer to S.199(1)<br \/>\n         and S.461(d) of Cr.P.C. An officer other than<br \/>\n         an Abkari Officer as defined in the Act cannot<br \/>\n         file a report even if investigation is conducted<br \/>\n         by an Abkari Officer. When a report by a<br \/>\n         specifically empowered officer is a condition<\/p>\n<p><span class=\"hidden_text\">                                  3<\/span><br \/>\nCRL.A.NO.1088\/03<\/p>\n<p>         precedent or taking cognizance of an offence,<br \/>\n         trial on a report by Assistant Sub Inspector of<br \/>\n         Police is void.&#8221;\n<\/p>\n<\/p>\n<p>     3. So, by the said decision, the dictum laid down in<\/p>\n<p>Vikraman&#8217;s      case is also overruled by the Division Bench.<\/p>\n<p>Going by the factual matrix of this case, it is very clear that<\/p>\n<p>further investigation and charge has been laid by the Assistant<\/p>\n<p>Sub Inspector, who is not an Abkari officer       as contemplated<\/p>\n<p>under the provisions of the Abkari Act.       Therefore, the whole<\/p>\n<p>thing is void and the prosecution cannot lie at all. In the<\/p>\n<p>Division Bench case, it was held that where it is only in the<\/p>\n<p>process of charge and not of trial, there was a direction to<\/p>\n<p>return those charges so that it can be filed by competent<\/p>\n<p>officer later. So far as this case is concerned, as per        the<\/p>\n<p>dictum laid in Subash&#8217;s case, it has to be held that the<\/p>\n<p>prosecution is void at the inception for lack of competency<\/p>\n<p>and jurisdiction.     Therefore,    the conviction and    sentence<\/p>\n<p>passed by the trial court is liable to be set aside and I do so.<\/p>\n<p>     4. In the result, the criminal appeal is allowed.        The<\/p>\n<p>conviction    and   sentence passed by the trial court       under<\/p>\n<p><span class=\"hidden_text\">                              4<\/span><br \/>\nCRL.A.NO.1088\/03<\/p>\n<p>Section 56(d) of the Abkari Act is set aside. The accused are<\/p>\n<p>found not guilty and are to be acquitted and are set at liberty<\/p>\n<p>forthwith.\n<\/p>\n<\/p>\n<p>                              M.N.
