Justice M.SASIDHARAN NAMBIAR\n\n Dated :17\/06\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n            ===========================\n           CRL.M.C.No. 1951       OF 2009\n            ===========================\n\n       Dated this the 17th day of June,2009\n\n                        ORDER\n<\/pre>\n<p>    Petitioner filed this petition under section 482<\/p>\n<p>of Code of Criminal Procedure    to quash Annexure IV<\/p>\n<p>F.I.R in Crime No.436\/2009 of Kundara Police Station<\/p>\n<p>contending that Annexure III complaint was lodged by<\/p>\n<p>the Kundara Grama Panchayat out of   political rivalry<\/p>\n<p>and no offence is made out and therefore the F.I.R is<\/p>\n<p>to be quashed.\n<\/p>\n<p>    2.   Learned counsel appearing for the petitioner<\/p>\n<p>was heard.\n<\/p>\n<p>    3.   The argument of the learned counsel is that<\/p>\n<p>there is no public well which was allegedly filled,as<\/p>\n<p>stated in Annexure III complaint or Annexure IV F.I.R<\/p>\n<p>and the case is registered malafide to harass the<\/p>\n<p>petitioner out of the political reasons and there is no<\/p>\n<p>material to show that there was a panachayat public<\/p>\n<p>well which was filled up and therefore the F.I.R is to<\/p>\n<p>be quashed.\n<\/p>\n<p>    4.    Annexure IV F.I.R was registered based on<\/p>\n<p>Annexure  III  complaint  filed  by  the  Secretary of<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.1951\/2009              2<\/span><\/p>\n<p>Kundara Grama Panchayat stating that on getting information<\/p>\n<p>that a Panchayat well was trespassed and filled up by<\/p>\n<p>persons under the leadership of the petitioner and on<\/p>\n<p>inquiry it was found to be correct and therefore      proper<\/p>\n<p>action is to be taken.\n<\/p>\n<p>      5. The question is whether Annexure III complaint if<\/p>\n<p>accepted      as correct,  an offence to be investigated is<\/p>\n<p>made out.\n<\/p>\n<p>      6. The police has registered the case under section 447<\/p>\n<p>of Indian Penal Code and Section     3 of the Prevention of<\/p>\n<p>Damage to Public Property     Act.  In the light of Annexure<\/p>\n<p>III complaint it is not possible to hold that the offence<\/p>\n<p>alleged is not to be investigated.      The question whether<\/p>\n<p>the well was in existence and if so whether it was filled<\/p>\n<p>up by the petitioner and if so whether petitioner committed<\/p>\n<p>the offence      are all matters  to be investigated by the<\/p>\n<p>Police.
