We have  heard learned  counsel on both<br \/>\nsides .\n<\/p>\n<p>     Neat question of law raised by Mr. Dhruv Mehta, learned<br \/>\ncounsel\t for   the  appellant  is  whether  respondents\t are<br \/>\nabsorbed employees  within   the meaning  of Section 2(a) of<br \/>\nthe Goa,  Daman and  Diu (Absorbed Employees) Act, 1965 (for<br \/>\nshort, the  &#8216;Act&#8217;). The admitted position is that Goa, Daman<br \/>\nand Diu\t which hitherto\t under the  hold of  Portuguese, was<br \/>\nliberated on  December 20,  1961 and  integrated as  part of<br \/>\nIndian territory.  The posts in the Judicial Department were<br \/>\ncreated by  a Portuguese decree. All the respondents came to<br \/>\nbe appointed  on or after December 20, 1961, sometime in the<br \/>\nyear 1963.  The Commissioner  (Finance) of  Goa, Daman &amp; Diu<br \/>\nAdministration had  issued a  circular on September 15, 1962<br \/>\nprescribing pay-scales\tto various  posts. For\tthe posts in<br \/>\nthe Judicial  Department held  by the  respondents, the pay-<br \/>\nscale  was   Rs.335-525\/-.  Their   representation  to\t the<br \/>\nGovernment for\tfixation of  pay-scales prescribed  for\t the<br \/>\nposts  created\t by  the   Portuguese  Administration,\t was<br \/>\nconsidered and\tan order  came to be passed on September 20,<br \/>\n1989 under  which they\tare made  entitled to  the payscales<br \/>\ninitially prescribed  to the  posts under Portuguese decree.<br \/>\nBut,  subsequently,  the  Government,  having  realised\t the<br \/>\nmistake had cancelled the same by proceedings dated December<br \/>\n27, 1990. That order came to be challenged in the High Court<br \/>\nwhich has  held that  by operation  of Section 5 of the Goa,<br \/>\nDaman &amp;\t Diu Administration  Act, the respondents came to be<br \/>\ncontinued on  the posts\t created prior\tto December 20, 1961<br \/>\nand,  therefore,   they\t were\tentitled  to  the  payscales<br \/>\nprescribed for those posts. The said order of the High Court<br \/>\nwas made  in Writ  Petition No.77  of 1991, dated August 30,<br \/>\n1993 and  followed in  other cases  which are  the  subject-<br \/>\nmatter of these appeals.\n<\/p>\n<p>     The Act  defines &#8216;absorbed\t employees&#8217; in\tSection 2(a)<br \/>\nthus:\n<\/p>\n<blockquote><p>     &#8220;2(a). &#8216;absorbed employees&#8217; means a<br \/>\n     person who\t immediately before  the<br \/>\n     20th day  of  December,  1961,  was<br \/>\n     holding an absorbed post and who on<br \/>\n     and after\tthat date  either served<br \/>\n     or has  been serving in that or any<br \/>\n     other post\t in connection\twith the<br \/>\n     administration   of    the\t   Union<br \/>\n     Territory of  Goa, Daman,\t&amp; Diu or<br \/>\n     in any  of the  Departments of  the<br \/>\n     Central Government.&#8221;<\/p><\/blockquote>\n<p>     &#8220;Absorbed post&#8221;  defined under  section  2(b)  means  a<br \/>\ncivil  service\tor  post  which\t existed  under\t the  former<br \/>\nPortuguese Administration  in Goa,  Daman &amp;  Diu immidiately<br \/>\nbefore the 20th day of December, 1961.\n<\/p>\n<p>     Admittedly ,  after the  appointed day, rules have been<br \/>\nmade on\t December 27,  1965 under  which Rule  2(c)  defines<br \/>\n&#8216;appointed day&#8217;\t to be\tthe Ist day of February, 1966. Under<br \/>\nrule 2(e),  &#8220;existing pay&#8221;  means the  pay admissible  to an<br \/>\nabsorbed employees&#8217;  immediately before the appointed day by<br \/>\nway of basic pay and shall include complementary pay and the<br \/>\ncharge allowance granted under rule 15. &#8220;Absorbed Employees&#8221;<br \/>\nas again  defined means\t an absorbed  employee as defined in<br \/>\nclause (a)  of Section 2 of the Act and who on the appointed<br \/>\nday is\tserving either in connection with the administration<br \/>\nof the\tunion territory\t or in any department of the Central<br \/>\nGovernment. The explanation amplifies as to who are intended<br \/>\nto be absorbed employees. Rule 3 precribes revision of rates<br \/>\nof pay of absorbed posts thus:\n<\/p>\n<blockquote><p>     &#8220;As from  the appointed  day, every<br \/>\n     absorbed post  shall be  brought on<br \/>\n     such revised  scale of  pay as  the<br \/>\n     Central\tGovernment     or    the<br \/>\n     Administrator   with    the   prior<br \/>\n     approval of the Central Government,<br \/>\n     may by order determine.&#8221;<\/p><\/blockquote>\n<p>     Rule 4  deals with\t the fixation  of pay in the revised<br \/>\npay-scale with which we are not concerned in this case.\n<\/p>\n<p>     Thus a  reading  of  these\t relevant  provisions  would<br \/>\nclearly indicate  that a  person eligible for the benefit of<br \/>\nSection 5  of the  Administration Act  must be\tan  employee<br \/>\nexisting as  on December 20, 1961 on the post held under the<br \/>\nPortuguese Administration  and\twas  continuing\t as  on\t the<br \/>\nappointed day  under the rules. Such persons are eligible to<br \/>\nthe  benefit  of  Rule\t7  of  the  Rules.  Admittedly,\t the<br \/>\nrespondents came to be appointed after the Administrator had<br \/>\nissued the  circular for  the fixation\tof the\tscale of pay<br \/>\nreferred to  hereinbefore. Under  those circumstances,\tthey<br \/>\nare not eligible to the pay of the posts prescribed in the<br \/>\ndecree granted by the Portuguese Administration.\n<\/p>\n<p>     The  appeals  are\taccordingly  allowed.  However,\t the<br \/>\namounts paid  under  the  erroneous  orders  issued  by\t the<br \/>\nGovernment may\tnot be\trecovered from the respondents. This<br \/>\norder would  be worked\tout for\t the purpose  of fixation of<br \/>\ntheir pension.
