Justice K.HEMA\n\n Dated :16\/07\/2010\n\n O R D E R\n                              K.HEMA, J.\n                           ------------------\n                       B.A. No. 3428 of 2010\n                     -----------------------------\n               Dated this the 16th day of July, 2010\n\n\n                              O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.\n<\/p>\n<p>      2.   The alleged offences are under Sections    341, 324,<\/p>\n<p>308 read with Section 34 of the Indian Penal Code. According to<\/p>\n<p>prosecution, on 23.04.2010 at about 10.45 P.M., petitioners (A1<\/p>\n<p>and A2) intercepted the car driven by the de facto complainant<\/p>\n<p>and assaulted him using iron pipe and iron rod. Third accused<\/p>\n<p>was also attacked him and the de facto complainant sustained<\/p>\n<p>injuries and thereby, the accused committed the above offences.<\/p>\n<p>      3. Learned counsel for petitioners submitted that de facto<\/p>\n<p>complainant and his associates are goondas in the locality. They<\/p>\n<p>have, in fact, attacked the petitioners, who are accused nos. 1<\/p>\n<p>and 2 and they had also gone to the hospital on sustaining<\/p>\n<p>injuries. At the instance of the de facto complainant, offence<\/p>\n<p>under Section 308 of the Indian Penal Code is included and<\/p>\n<p>there is no allegation          against second accused that he<\/p>\n<p>committed any overt acts. The injury sustained by the de facto<\/p>\n<p><span class=\"hidden_text\">B.A. No. 3428 \/ 2010              2<\/span><\/p>\n<p>complainant are minor and hence petitioner may be granted<\/p>\n<p>anticipatory bail, it is submitted.\n<\/p>\n<p>      4. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that as per the allegations made in the F.I. Statement,<\/p>\n<p>both petitioners assaulted by de facto complainant using iron<\/p>\n<p>pipe and iron rod. There are corresponding injuries also, on the<\/p>\n<p>de facto complainant. He was admitted in the hospital. He<\/p>\n<p>sustained fracture to the mandible and other multiple lacerated<\/p>\n<p>wounds on the head. He had history of vomiting and other<\/p>\n<p>injuries also. This is not a fit case to grant anticipatory bail, it is<\/p>\n<p>submitted.\n<\/p>\n<p>      5. On hearing both sides and on going through the<\/p>\n<p>documents produced Annexure-2(A) and (B) and the wound<\/p>\n<p>certificate issued to the de facto complainant, and on considering<\/p>\n<p>the various facts and circumstances, I find that the nature of the<\/p>\n<p>allegations made against petitioners are serious. Though the de<\/p>\n<p>facto complainant is stated to be a goonda, he sustained various<\/p>\n<p>lacerated wounds on his head, and other parts of the body<\/p>\n<p>including a fracture to the mandible. But, the petitioners had only<\/p>\n<p>complaints of body pain, as revealed from the documents<\/p>\n<p><span class=\"hidden_text\">B.A. No. 3428 \/ 2010              3<\/span><\/p>\n<p>produced. In such circumstances, I do not think that this is a fit<\/p>\n<p>case to grant anticipatory bail. Petitioners are bound to surrender<\/p>\n<p>and co-operate with the investigation.\n<\/p>\n<p>                   No further application for anticipatory<\/p>\n<p>             bail by petitioners in this crime will be<\/p>\n<p>             entertained by this court hereafter.\n<\/p>\n<p>       Petition is dismissed.\n<\/p>\n<\/p>\n<p>                                              K.
