Justice K.P.BALACHANDRAN\n\n Dated :15\/10\/2008\n\n O R D E R\n                J.B.KOSHY &amp; K.P.BALACHANDRAN, JJ.\n                         --------------------------------------\n                        M.A.C.A.No.533 OF 2003\n                         -------------------------------------\n                         Dated 15th October, 2008\n\n                                  JUDGMENT\n<\/pre>\n<p>Koshy,J.\n<\/p>\n<p>            The first appellant\/claimant at the age of seven sustained<\/p>\n<p>injuries in a motor accident due to the negligence of the first respondent<\/p>\n<p>driver of the vehicle owned by the second respondent.                 He filed an<\/p>\n<p>application claiming Rs.3,00,000\/= as compensation.                  The Tribunal<\/p>\n<p>awarded only Rs.30,000\/=. Only quantum of compensation is disputed in<\/p>\n<p>this appeal. Ext.A3 wound certificate shows the following injuries:<\/p>\n<blockquote><p>            &#8220;(1) Bleeding from the Rt. Nostril.<br \/>\n            (2) Abrasion over the Rt. Cheek &#8211; 1&#8243;x1&#8221;<br \/>\n            (3) Emulsion of skin over the scalp (Rt)<br \/>\n            (4) Muco membranous             abrasion and lacerated<br \/>\n                wound near the nose measuring 2 = cm x 1=<br \/>\n                cm x muscle deep.\n<\/p><\/blockquote>\n<blockquote><p>            Impression : Rt. Parietal depressed fracture skull<br \/>\n            with   scalp    emulsion         with       facial  and lip<br \/>\n            lacerations.&#8221;\n<\/p><\/blockquote>\n<p>It is the case of the claimant that he lost his studies and apart from<\/p>\n<p>physical disability, mental disability also occurred.              He was under<\/p>\n<p>treatment for a long time. Ext.A6 disability certificate shows that there<\/p>\n<p><span class=\"hidden_text\">MACA.533\/2003                        2<\/span><\/p>\n<p>was 10% disability.          The above certificate was issued by<\/p>\n<p>Dr.S.C.Bantwal, M.S., M.Ch. (Neuro).          The certificate reads as<\/p>\n<p>follows:\n<\/p>\n<\/p>\n<blockquote><p>                   &#8220;He continues to have a neurological<br \/>\n            deficit by way of speech disorder, impaired<br \/>\n            higher mental function and gait      ataxia.  The<br \/>\n            percentage of total permanent disability can be<br \/>\n            put at 10%.&#8221;\n<\/p><\/blockquote>\n<p>But, the Medical Board certified by Ext.X1 certificate that there is no<\/p>\n<p>psychiatric disability. Therefore, no compensation was awarded for<\/p>\n<p>disability, but, for loss of amenities the Tribunal awarded Rs.6,000\/=.<\/p>\n<p>Considering the medical certificates and also considering the serious<\/p>\n<p>injuries sustained by the child at the tender age, we are of the opinion<\/p>\n<p>that another Rs.7,000\/= should be awarded for loss of studies and<\/p>\n<p>serious injuries and its consequences. Even though it is argued that<\/p>\n<p>the compensation awarded under other heads are also very meagre,<\/p>\n<p>considering the injuries and total compensation awarded, we are of<\/p>\n<p>the opinion that no enhancement is necessary under other heads.
