No.19317 of 2010\n                     RAMPREVESH URAON SON OF RAMCHANDRA URAON\n                                             Versus\n                                      STATE OF BIHAR\n                                           -----------\n<\/pre>\n<p>5.   20.7.2010               Heard learned Counsel for the petitioner and the State.<\/p>\n<p>                             The petitioner seeks bail in a case instituted for the<\/p>\n<p>                 offence under Sections 3\/4 of the Explosive Substance Act and 17<\/p>\n<p>                 of the C.L.A. Act.\n<\/p>\n<p>                             The prosecution case is that the petitioner and the co-<\/p>\n<p>                 accused were arrested on suspicion and disclosed that a mile had<\/p>\n<p>                 been led in the Ariel and on their pointing out the mile was defused.<\/p>\n<p>                             The submission is that the petitioner is in custody since<\/p>\n<p>                 10.10.2008 and he has no criminal antecedents.<\/p>\n<p>                             In view of such, let the petitioner above named be<\/p>\n<p>                 released on bail on furnishing bail bond of Rs.5,000\/- (Five<\/p>\n<p>                 thousand) with two sureties of the like amount each to the<\/p>\n<p>                 satisfaction of F.T.C.5, Kaimur at Bhabua in Sessions Trial No.27<\/p>\n<p>                 of 2009 arising out of Adhaura P.S.case No.19 of 2008, subject to<\/p>\n<p>                 the conditions (i) That one of the bailors shall be the local since the<\/p>\n<p>                 petitioner belongs to Rohtas at Sasaram district and the other<\/p>\n<p>                 bailor shall be the father of the petitioner. The bailor will undertake<\/p>\n<p>                 to furnish information to the court about any change in the address<\/p>\n<p>                 of the petitioner, (ii) that the affidavit shall clearly state that the<\/p>\n<p>                 petitioner is not an accused in any other case and if he is he shall<\/p>\n<p>                 not be released on bail, (iii) that the bailor shall also state on<\/p>\n<p>                 affidavit that he will inform the court concerned if the petitioner is<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>            implicated in any other case of similar nature after his release in<\/p>\n<p>            the present case and thereafter the court below will be at liberty to<\/p>\n<p>            initiate the proceeding for cancellation of bail on the ground of<\/p>\n<p>            misuse and (iv) that the petitioner will be well represented on each<\/p>\n<p>            date and if he fails to do so on two consecutive dates, his bail will<\/p>\n<p>            be liable to be cancelled.\n<\/p>\n<p>                         The Magistrate concerned before releasing the<\/p>\n<p>            petitioner on bail will confirm that the petitioner is not an accused in<\/p>\n<p>            any other case.\n<\/p>\n<\/p>\n<p>                                   ( Anjana Prakash, J. )<\/p>\n<p>Narendra\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ramprevesh Uraon vs State Of Bihar on 20 July, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
