No.3249 of 2008\n                      -------------------------------------\n             Dated this the 2nd day of September, 2008\n\n                                  ORDER\n<\/pre>\n<p>      Petitioners face indictment in a prosecution under Section<\/p>\n<p>63 and 65 of the Copy Right Act and Sections 482 and 483 I.P.C.<\/p>\n<p>Cognizance has been taken on the basis of a final report<\/p>\n<p>submitted by the police after due investigation.               During the<\/p>\n<p>pendency of the proceedings, the defacto complainant and the<\/p>\n<p>petitioners have settled their disputes. The defacto complainant,<\/p>\n<p>who is arrayed as the 2nd respondent herein, has settled all his<\/p>\n<p>disputes with the petitioners\/accused. He has filed an affidavit<\/p>\n<p>to confirm that the dispute has been settled and the offences<\/p>\n<p>alleged have been compounded.                     The 2nd respondent has<\/p>\n<p>appeared through counsel to confirm such settlement.                 It is<\/p>\n<p>prayed that in view of the settlement and composition, powers<\/p>\n<p>under Section 482 Cr.P.C may be invoked as enabled by the<\/p>\n<p>dictum in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a> [2008<\/p>\n<p>A.I.R SCW 2287] and the surviving prosecution against the<\/p>\n<p>petitioners may be brought to premature termination.<\/p>\n<p>      2.    Notice was given to the learned Public Prosecutor.<\/p>\n<p>The learned Public Prosecutor after taking instructions submits<\/p>\n<p>that there has been a bona fide and genuine settlement and the<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No.3249 of 2008          2<\/span><\/p>\n<p>State does not want to oppose the prayer for quashing of<\/p>\n<p>proceedings.\n<\/p>\n<p>      3.   The offences alleged are not compoundable.           But<\/p>\n<p>notwithstanding the fact that that the offences are not<\/p>\n<p>compoundable, I am satisfied that the extraordinary inherent<\/p>\n<p>jurisdiction under Section 482 Cr.P.C as enabled by the dictum<\/p>\n<p>in <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a> can safely be<\/p>\n<p>pressed into service. The dispute is one which is purely personal<\/p>\n<p>between the petitioners and the 2nd respondent. No question of<\/p>\n<p>public policy or public interest is involved and I am satisfied that<\/p>\n<p>the prayer in this Crl.M.C can be allowed.<\/p>\n<p>      4.
