(2) 854\n 1985 SCC  (4) 234\t  1985 SCALE  (2)786\n\n\nACT:\n     Indian Penal  Code 1860,  Section 161  &amp; Prevention  of\nCorruption Act 1947, section 5(1)(d) and 5(2).\n     Police constable  - Acceptance  of bribe  - Charge of -\nDemand and  acceptance of bribe - Denial of - Claim of bribe\namount being  inserted in  pocket - Defence plea accepted by\nTrial Court  and acquitted  - Conviction  by  High  Court  -\nWhether valid.\n\n\n\nHEADNOTE:\n     The appellant  who was  a Police  Constable was charged\nunder section  161 IPC and section 5(1)(d) read with section\n5(2)  of   the\tPrevention  of\tCorruption  Act,  1947.\t The\nprosecution case  was that  the appellant  demanded a sum of\nRs. 50\tfrom PW\t 1 who was a taxi driver and in the habit of\nparking the taxi where parking was prohibited. PW 1 informed\nthe Anti-Corruption  staff, a  trap was laid and five Rs. 10\ncurrency notes\twere treated  with  phenolphthalien  powder,\nmade over  to PW  1 to\tbe paid as bribe. PW 9 the Inspector\nsupervised the\ttrap. After the currency notes were received\nby the\tappellant PW  9 and  others recovered the money from\nhim. The  currency notes  were dipped  into the\t mixture  of\nsodium\tCarbonate  and\tthe  same  turned  rosy\t in  colour.\nSimilarly the  pocket of  one shirt of the appellant and his\nfingers were put to test and these too turned rosy.\n     The defence  of the appellant was a total denial of the\nbribe having  been demanded  and taken\tand he stated in the\nstatement under\t sec. 313  Cr.\tP.C.  that  the\t amount\t was\ninserted into his left hand side pocket by PW 1.\n     In the  Trial Court  it was  contended on behalf of the\nappellant that\tPWs.  3\t and  8\t the  Panch  witnesses\twere\ninterested in  PW 1  and that PW 1 was previously working in\nthe Police  and had  been removed  from service.  The  Trial\nJudge  disbelieved   the  prosecution\tevidence   regarding\nacceptance of  Rs. 50\/-\t by the\t appellant, and accepted the\ndefence stand  that the currency notes\thad been inserted by\nPW 1  into the\tpocket of  the appellant,  and acquitted the\nappellant.\n855\n     In appeal\tby the\tState, the  High Court held that the\nappellant was a policeman who was about to retire in a short\ntime, that he had been in service for more than 30 years and\nthat it\t is not\t possible to  believe that a policeman would\nnot come  to know  if someone  inserts currency notes in his\nleft hand  side pocket,\t and reversed the order of acquittal\npassed by the Trial Court and convicted the appellant.\n     Allowing the appeal,\n^\n     HELD: 1.  The Trial Court had accepted the defence plea\nof possibility\tof insertion  of the  currency notes without\nthe appellant  knowing about it. The High Court reversed the\ntrial court  in this  regard by merely drawing a presumption\non the\tbasis of  the appellant having been a policeman. The\nappellant was  already nearing the age of superannuation and\nhad been  more than 30 years in service. The High Court lost\nsight of  the fact  that the  appellant may  have  lost\t his\nagility and that the currency notes could have been inserted\nwithout the appellant knowing about it. [857 G-858 A]\n     2. Very clever people who are young and agile are often\nvictimised by  pick-pockets and\t only when  their  valuables\nhave been  lost the  fact is noticed by them. The process in\nthe instant  case, is the reverse one. Instead of the pocket\nbeing picked,  currency notes  have been  inserted into\t it.\n[858 B]\n     3. The  allegation that PWs. 3 and 8 were interested in\nPW 1  has not  been carefully examined by the High Court yet\nthe conclusion\tof the\ttrial court has been disturbed. PW 7\nwas admittedly\tpresent at the spot and he has categorically\nspoken that  when the  appellant's fingers were put into the\nmixture they did not turn rosy. The trial court had referred\nto this\t fact and  relied upon\tit. That  evidence which had\nbeen  accepted\tprobabilities  the  defence  plea  that\t the\ncurrency notes had not been received by the appellant in his\nleft hand  and, therefore,  the insertion  of the notes into\nthe pocket  of the  appellant by  some other person was more\nprobable. This\tis the\tdefence plea which has been accepted\nby the\ttrial court,  and reversal  by the  High  Court\t was\ntherefore not warranted. Dholakia and R.N. Poddar for the Respondent.<br \/>\n     The order of the Court was delivered by<br \/>\n     A.N. SEN,\tJ. This\t appeal by special leave is directed<br \/>\nagainst the judgment of the Gujarat High Court reversing the<br \/>\nacquittal of  the appellant.  The appellant  was  tried\t for<br \/>\noffences punishable  under section  161 of  the Indian Penal<br \/>\nCode and  section 5(1)(d) read with s. 5(2) of Act. No. 2 of<br \/>\n1947, on the allegation of having received Rs. 50 as bribe.\n<\/p>\n<p>     The  appellant  was  a  police  constable\tand  at\t the<br \/>\nrelevant time,\ton 29.11.73, he was posted at S.T. Bus Stand<br \/>\nat Bhaber.  PW 1, the informant was plying a taxi and was in<br \/>\nthe habit  of parking  the taxi by the side of the bus stand<br \/>\nwhere such  parking was\t prohibited. It\t is the\t prosecution<br \/>\ncase that  PW 1 used by pay Rs. 5 per month to the appellant<br \/>\nas a  consideration for not prosecuting him for such illegal<br \/>\nparking. It  is the  further case  of the prosecution that a<br \/>\nfew days  before 29.11.73,  the appellant told the informant<br \/>\nthat  he  should  pay  him  (appellant)\t a  sum\t of  Rs.  60<br \/>\nrepresenting the payment for a whole year @ Rs. 5 per month,<br \/>\nas he  was in need of money, and it was finally settled that<br \/>\nif the\tamount was  paid in  lump the  informant would get a<br \/>\nrebate of  Rs. 10  and he  would have to pay Rs. 50 only. On<br \/>\nthe information given by PW. 1 to the Anti-Corruption staff,<br \/>\na trap\twas laid.  Five 10  currency notes were treated with<br \/>\nphinolphthalein powder\tand made  over to PW 1 to be paid as<br \/>\nbribe. PW.  9, the Inspector supervised the trap. PWs. 3 and<br \/>\n8 were\tcalled as  Panches. At\tabout 8\t in the\t morning  on<br \/>\n29.11.73, PW.  1 met the appellant near Jalaram hotel. PW. 9<br \/>\nand his companions remained at a distance of about 150 feet.<br \/>\nPWs. 1\tand 3  went into the hotel along with the appellant.<br \/>\nAccording to  PW. 1  he took out the five 10 rupees currency<br \/>\nnotes and  paid them to the appellant who received the notes<br \/>\nin his\tleft hand  and put  them into the side pocket of his<br \/>\nkhaki shirt.  Thereupon as previously arranged, PW. 3 placed<br \/>\norders in  loud voice  for pondas.  At this  state PW. 9 and<br \/>\nothers came  up to the appellant and recovered the money. It<br \/>\nis said that the currency notes were dipped into the mixture<br \/>\nof  Sodium   Carbonate\tand  same  turned  rosy\t in  colour.<br \/>\nSimilarly the  pocket of  the shirt  and the  fingers of the<br \/>\nappellant were put to test and these too turned rosy.\n<\/p>\n<p>     The defence was a total denial of the bribe having been<br \/>\ndemanded and  taken. The  appellant  stated  under  s.\t313,<br \/>\nCrl.P.C.\n<\/p>\n<p><span class=\"hidden_text\">857<\/span><\/p>\n<p>that &#8220;at  about 9.30 A.M. when I was writing my diary in the<br \/>\nhotel, Ramji  (PW. 1)  came in the hotel and sat by my side.<br \/>\nRamji then  asked whether  I knew  the death of one woman. I<br \/>\ntold him  that I do not know any thing about it though I had<br \/>\ngone to the hospital to bring the medicine. Then he took tea<br \/>\nand got up. The Mankadia Saheb, Patel Saheb and Morarji came<br \/>\nthere, when I was standing up to go to the bus stand then on<br \/>\nRamjibhai making  some sign, Mankadia Saheb asked me to take<br \/>\nout those  notes but  I refused to do so and, therefore, Mr.<br \/>\nPatel took out those notes and counted&#8230;.&#8221;\n<\/p>\n<p>     On behalf\tof the\tappellant,  it\thad  been  contended<br \/>\nbefore the trial Court that PWs. 3 and 8 the Panch witnesses<br \/>\nwere interested in PW. 1 and PW. 1 was previously working in<br \/>\nthe police  and had  been removed  from service.  It  is  on<br \/>\naccount of  this interestedness\t that these Panches were not<br \/>\nreliable. The  learned\ttrial  Judge  did  not\tbelieve\t the<br \/>\nprosecution evidence  regarding acceptance  of Rs. 50 by the<br \/>\nappellant and  accepted the  defence stand that the currency<br \/>\nnotes had  been inserted  by PW.  1 into  the pocket  of the<br \/>\nappellant. The\tentire evidence\t had been taken into account<br \/>\nby the learned trial Judge in reaching his conclusion and he<br \/>\nacquitted the appellant of both the charges levelled against<br \/>\nhim.\n<\/p>\n<p>     This judgment of acquittal was assailed by the State in<br \/>\nappeal before  the High\t Court. Dealing with the question as<br \/>\nto whether  the currency notes could have been inserted into<br \/>\nthe appellant&#8217;s pocket, the High Court observed:<br \/>\n&#8220;On our\t part we  find it extremely difficult to accept this<br \/>\nversion. The  respondent was  a policeman  who was  about to<br \/>\nretire in a short time. He had been in service for more than<br \/>\n30 years.  Even if  one is  extremely credulous,  it is\t not<br \/>\npossible to  believe that a policeman would not come to know<br \/>\nif some\t one sitting  at a  distance of\t 6&#8221; inserts currency<br \/>\nnotes in  his left  hand side  pocket. To us it appears that<br \/>\nsuch a\tfeat cannot  be achieved.  Even\t if  attempted,\t the<br \/>\nrespondent would have come to know about it.\n<\/p>\n<p>     The trial\tCourt  had  accepted  the  defence  plea  of<br \/>\npossibility of\tinsertion of  the currency notes without the<br \/>\nappellant knowing  about it.  The High\tCourt  reversed\t the<br \/>\ntrial Court  in this  regard by merely drawing a presumption<br \/>\non the\tbasis of  the appellant having been a policeman. The<br \/>\nappellant was  already nearing\tthe age of superannuation as<br \/>\nfound by  the High Court and had been for more than 30 years<br \/>\nin service.  The High Court obviously lost sight of the fact<br \/>\nthat the appellant may have lost his agility<br \/>\n<span class=\"hidden_text\">858<\/span><br \/>\nand in\tthe peculiar circumstances indicated above the notes<br \/>\ncould have  been inserted  without the appellant knowing it.<br \/>\nVery clever  people  who  are  young  and  agile  are  often<br \/>\nvictimised by  pick-pockets and\t only when  their  valuables<br \/>\nhave been lost the fact is noticed by them. The process here<br \/>\nis the\treverse one.  Instead of  the pocket  being  picked,<br \/>\ncurrency notes\thave been  inserted into it. The view of the<br \/>\ntrial Court  should not\t have been  discarded merely  on the<br \/>\nbasis of  what has  been extracted  by\tus  above  from\t the<br \/>\njudgment of the High Court.\n<\/p>\n<p>     The allegation that PWs. 3 and 8 were interested in PW.<br \/>\n1 has  not been carefully examined by the High Court yet the<br \/>\nconclusion of  the trial Court has been disturbed. PW. 7 was<br \/>\nadmittedly present  at the  spot and  he  has  categorically<br \/>\nspoken that  when the  appellant&#8217;s fingers were put into the<br \/>\nmixture they did not turn rosy. The trial Court had referred<br \/>\nto this\t fact and  relied upon\tit. That  evidence which had<br \/>\nbeen accepted,\tprobabilities  the  defence  plea  that\t the<br \/>\ncurrency notes had not been received by the appellant in his<br \/>\nleft hand  and, therefore,  the insertion  of the notes into<br \/>\nthe pocket  of the  appellant by  some other person was more<br \/>\nprobable. This\tis the\tdefence plea which had been accepted<br \/>\nby the\ttrial Court.  We are inclined to think that reversal<br \/>\nby the High Court was not warranted.\n<\/p>\n<p>     We\t accordingly   allow  this  appeal,  set  aside\t the<br \/>\njudgment of  the High  Court and  restore  the\tjudgment  of<br \/>\nacquittal passed  by the  Trial Court. The bail bonds of the<br \/>\nappellant are discharged.\n<\/p>\n<p>     The appellant was serving as a constable and was due to<br \/>\nsuperannuate on\t 10.9.1979. There  is nothing  on record  to<br \/>\nshow as\t to what  happened  to\thim  when  the\tjudgment  of<br \/>\nacquittal was  set aside. We, however, hope and believe that<br \/>\nthe reversal of the judgment of the High Court by us will be<br \/>\ntaken due  note of  and such  relief  as  the  appellant  is<br \/>\nentitled to  in regard\tto his\tservice benefits,  would  be<br \/>\nextended to him without any delay.\n<\/p>\n<p>N.V.K.\t  Appeal allowed.\n<\/p>\n<p><span class=\"hidden_text\">859<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Salimkhan Sardarkhan vs State Of Gujarat on 18 September, 1985 Equivalent citations: 1986 AIR 307, 1985 SCR Supl.
