Since statutory appeal filed as per Ext.P4, against<\/p>\n<p>Ext.P3 order imposing penalty under Section 47 (6) of the<\/p>\n<p>Kerala Value Added Tax Act, 2003 (KVAT Act), is pending<\/p>\n<p>consideration and disposal before the 4th respondent<\/p>\n<p>appellate authority, I am of the opinion that the writ petition<\/p>\n<p>can be disposed of directing that authority to consider and<\/p>\n<p>pass orders on the appeal on an early basis.<\/p>\n<p>      2.   Therefore the writ petition is disposed of directing<\/p>\n<p>the 4th respondent to consider and dispose of Ext.P4 appeal,<\/p>\n<p>after affording an opportunity of hearing to the petitioner, as<\/p>\n<p>early as possible, at any rate within a period of one month<\/p>\n<p>from the date of receipt of a copy of this judgment.<\/p>\n<p>      3.   It is stated that the petitioner had already<\/p>\n<p>furnished Bank Guarantee for the amount of penalty<\/p>\n<p>imposed, at the time when the goods were detained, for<\/p>\n<p>facilitating its release.
