The State of Bihar.\n                                                             ---Opposite Parties\n                                  ----------------------------------\n<\/pre>\n<p>10.   13.9.2011              This application has been filed for initiating a<\/p>\n<p>                  proceeding for contempt for the alleged wilful disobedience of the<\/p>\n<p>                  order dated 12.7.2006 passed in CWJC No.11092 of 2005.<\/p>\n<p>                             This Court disposed of the said writ application<\/p>\n<p>                  directing the respondent-Board to make the necessary payment of<\/p>\n<p>                  the entitlement of the petitioner on account of pensionary dues and<\/p>\n<p>                  the gratuity and leave encashment, subject to any decision that<\/p>\n<p>                  may be taken by the Board to initiate proceedings under rule 43(b)<\/p>\n<p>                  of the Bihar Pension Rules.\n<\/p>\n<p>                             Show cause and supplementary show cause have been<\/p>\n<p>                  filed on behalf of the opposite party-Board stating therein that the<\/p>\n<p>                  order of this Court has been complied with and necessary<\/p>\n<p>                  payments    have    been    made    as   detailed   in   the     show<\/p>\n<p>                  cause\/supplementary show cause.\n<\/p>\n<p>                             Learned counsel for the petitioner submits that while<br \/>\n<span class=\"hidden_text\">                             -2-<\/span><\/p>\n<p>      initiating a proceeding under rule 43(b) of the Bihar Pension Rules<\/p>\n<p>      against the petitioner, the Board as a measure of punishment<\/p>\n<p>      ordered for permanent withholding of 5% of his pension. As<\/p>\n<p>      submitted, the said order has been assailed by the petitioner in this<\/p>\n<p>      Court through the writ petition, which was disposed of with<\/p>\n<p>      certain directions.\n<\/p>\n<p>                Be that as it may, on perusal of the show cause and<\/p>\n<p>      supplementary show cause, since it appears that the order of this<\/p>\n<p>      Court has been substantially complied with, I am not inclined to<\/p>\n<p>      proceed with the matter further.
