Justice K.T.SANKARAN\n\n Dated :17\/03\/2010\n\n O R D E R\n                         K.T.SANKARAN, J.\n                    ---------------------------------------------\n                         B.A.No.1549 of 2010\n                    ---------------------------------------------\n                Dated this the 17th day of March, 2010\n\n\n                                 O R D E R\n<\/pre>\n<p>       This is an application for bail under Section 439 of the Code<\/p>\n<p>of Criminal Procedure. The petitioner is accused No.1 in Cr.No.1<\/p>\n<p>of 2010 of the Excise Enforcement and Anti Narcotic Special<\/p>\n<p>Squad, Ernakulam.\n<\/p>\n<p>      2. The offence alleged against the petitioner is under Section<\/p>\n<p>20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act.<\/p>\n<p>      3.    The prosecution case is that on 5.2.2010, the petitioner<\/p>\n<p>and another were found in possession of 1.110 kgs. of ganja. The<\/p>\n<p>petitioner was arrested on 5.2.2010 and he was remanded to<\/p>\n<p>judicial custody.\n<\/p>\n<p>      4.    It is submitted by the learned counsel for the petitioner<\/p>\n<p>that the petitioner is not involved in any other case of similar<\/p>\n<p>nature. The quantity of ganja involved is slightly above the small<\/p>\n<p>quantity.\n<\/p>\n<p>      5.    Since the quantity of ganja involved is not a commercial<\/p>\n<p>quantity, the bar under Section 37(1)(b)(ii) of NDPS Act will not<\/p>\n<p>apply.\n<\/p>\n<p>      6.    Taking into account the fact that the petitioner is in<\/p>\n<p>judicial custody since 5.2.2010 and also taking note of the<\/p>\n<p><span class=\"hidden_text\">BA No.1549\/2010                     2<\/span><\/p>\n<p>contention that the petitioner is not involved in any other case of<\/p>\n<p>similar nature, I am inclined to grant bail to the petitioner on<\/p>\n<p>stringent conditions.\n<\/p>\n<p>      The petitioner shall be released on bail on his executing bond<\/p>\n<p>for Rs.25,000\/- with two solvent sureties for the like amount to the<\/p>\n<p>satisfaction of the Sessions Court, Ernakulam, subject to the<\/p>\n<p>following conditions:\n<\/p>\n<blockquote><p>      a)    The    petitioner     shall   report    before    the<br \/>\n            investigating officer between 9 A.M.         and 11<br \/>\n            A.M. on all Mondays and Thursdays for a period<br \/>\n            of one month and thereafter on all Mondays, till<br \/>\n            the final report is filed or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>      b)    The    petitioner     shall   appear    before    the<br \/>\n            investigating officer for interrogation as and<br \/>\n            when required;\n<\/p><\/blockquote>\n<blockquote><p>      c)    The petitioner shall not try to influence the<br \/>\n            prosecution   witnesses      or tamper      with  the<br \/>\n            evidence;\n<\/p><\/blockquote>\n<blockquote><p>      d)    The petitioner shall not commit any offence or<br \/>\n            indulge in any prejudicial activity while on bail;\n<\/p><\/blockquote>\n<blockquote><p>      e)    In case of breach of any of the conditions<br \/>\n            mentioned above, the bail shall be liable to be<br \/>\n            cancelled.\n<\/p><\/blockquote>\n<blockquote><p>      The Bail Application is allowed as above.<\/p><\/blockquote>\n<p>                                                   K.T.SANKARAN,<br \/>\n                                                       JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Mohanan vs State Of Kerala on 17 March, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 1549 of 2010() 1.
