District Judge and Presiding Officer,<br \/>\nFast Track Court No. 5, Rajkot in Regular Civil Appeal No. 33 of 1994<br \/>\nwhereby, the said appeal was dismissed and the judgment and decree<br \/>\ndated 31.03.1994 passed by the learned 3rd Jt. Civil Judge<br \/>\n(S.D.), Rajkot in Regular Civil Suit No. 1053 of 1994 was confirmed.\n<\/p>\n<p>2.0\t\tThe<br \/>\nfacts in brief leading rise to the filing of the present appeal are<br \/>\nas under;\n<\/p>\n<p>2.1\t\tThe<br \/>\nrespondent, original plaintiff, is serving as a Conductor at the City<br \/>\nDepot, Rajkot, which is being managed by the appellant ?<br \/>\nCorporation. The respondent was served with a charge-sheet dated<br \/>\n12.09.1986 by the appellants alleging that on 14.05.1986 the<br \/>\nrespondent had misbehaved with one passenger. The respondent replied<br \/>\nto the said charge-sheet vide reply dated 19.11.1986.\n<\/p>\n<p>2.2\t\tBeing<br \/>\ndissatisfied by the said reply, the appellant ?  Corporation<br \/>\ninitiated departmental inquiry against the respondent. On completion<br \/>\nof the inquiry, the respondent was served with a show-cause Notice<br \/>\ndated 22.05.1987 calling upon the respondent to show cause as to why<br \/>\nhe should not be dismissed from the service.\n<\/p>\n<p>2.3\t\tOn<br \/>\nhaving come to know that a decision to dismiss the respondent from<br \/>\nservice has been taken by the appellants, the respondent filed a suit<br \/>\nbeing Civil Suit No. 551 of 1987 challenging the validity of the<br \/>\ninquiry and the order of dismissal passed by the appellants.\n<\/p>\n<p>2.4\t\tHowever,<br \/>\nthe said suit was dismissed by the Civil Court on the technical<br \/>\nground that the suit was premature since no final order with respect<br \/>\nto the dismissal of the respondent from service has been passed by<br \/>\nthe appellants. While passing the above order, the Court also<br \/>\nobserved that any order of dismissal or any other punishment, which<br \/>\nmay be passed, shall not be implemented for a period of fifteen days.\n<\/p>\n<p>2.5\t\tHowever,<br \/>\nsubsequently, vide order dated 04.09.1987, the respondent came to be<br \/>\ndismissed from the service. Being aggrieved by the aforesaid order,<br \/>\nthe respondent preferred a suit being Regular Civil Suit No. 1053 of<br \/>\n1994 before the Court of learned Jt. Civil Judge (S.D.), Rajkot. The<br \/>\ntrial Court, after hearing the parties and after considering the<br \/>\nevidence on record, decreed the suit in favour of the respondent and<br \/>\nheld that the departmental inquiry and the subsequent order of<br \/>\ndismissal passed by the appellants were bad in law and illegal.\n<\/p>\n<p>2.6\t\tAgainst<br \/>\nthe said order, the appellants preferred an appeal being Regular<br \/>\nCivil Appeal No. 33 of 1994 before the Court of learned Addl.<br \/>\nDistrict Judge and Presiding Officer, Rajkot. The lower appellate<br \/>\nCourt, after appreciating the evidence on record, dismissed the<br \/>\nappeal and confirmed the order passed by the trial Court. Hence, this<br \/>\nsecond appeal.\n<\/p>\n<p>3.0\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. The only contention raised by the learned Advocate for the<br \/>\nappellants is that the Civil Court has no jurisdiction to entertain a<br \/>\nsuit challenging the departmental proceedings and the subsequent<br \/>\norder of dismissal passed by a competent authority. The said<br \/>\ncontention raised by the appellants does not hold any ground in view<br \/>\nof the recent decision of the Hon&#8217;ble Apex Court in the case of<br \/>\nRajasthan S.R.T.C. &amp; Ors. v. Mohar Singh reported<br \/>\nin 2008(3) S.C. Pg. 230 wherein, it has been held that<br \/>\na Civil Court may have a limited jurisdiction in service matters and<br \/>\nit may not sit in appeal over the order passed in disciplinary<br \/>\nproceedings or on the quantum of punishment imposed and it may also<br \/>\nnot direct reinstatement in service having regard to Section 14(1)(b)<br \/>\nof the Specific Relief Act, 1963. But, it cannot be said to have no<br \/>\njurisdiction at all to entertain a suit and it is trite that where<br \/>\nthe right is claimed by the plaintiff in terms of a common law or<br \/>\nunder a statute, other than the one which created a new right for the<br \/>\nfirst time and when a forum has also been created for enforcing the<br \/>\nsaid right, the Civil Court shall also have jurisdiction to entertain<br \/>\na suit where the plaintiff claim benefit of a fundamental right, as<br \/>\nadumbrated under Article 14 of the Constitution of India or mandatory<br \/>\nprovisions of statute or statutory rules governing the terms and<br \/>\nconditions of service.\n<\/p>\n<p>4.0\t\tIn<br \/>\nthe case on hand, it is not in dispute that the order of dismissal<br \/>\ncame to be passed after the suit being Civil Suit No. 551 of 1987<br \/>\npreferred by the respondent challenging the validity of the<br \/>\ndepartmental inquiry and the order of dismissal that may be passed by<br \/>\nthe appellant ?  Corporation was dismissed on the technical ground<br \/>\nof being premature. Therefore, ultimately, when the order of<br \/>\ndismissal dated 04.09.1987 came to be passed, a right shall accrue on<br \/>\nthe respondent to choose a forum vis-a-vis the common law before<br \/>\nwhich he desires to redress his grievances.\n<\/p>\n<p>5.0\t\tHaving<br \/>\ngone through the record, it is evident that the action on the part of<br \/>\nthe appellant ?  authority is violative of the mandatory<br \/>\nrequirements of a statute or the statutory rules and the principles<br \/>\nof natural justice. Therefore, in such case, the Civil Court will<br \/>\nhave the jurisdiction to entertain the suit in view of the principle<br \/>\nlaid down in Rajasthan S.R.T.C. Case (supra).\n<\/p>\n<p>6.0\t\tIn<br \/>\nview of the above discussion, I am of the view that the Court below<br \/>\nwas completely justified in passing the impugned judgment and decree.<br \/>\nI am in complete agreement with the concurrent findings recorded by<br \/>\nboth the Courts below and hence, find no reasons to interfere in this<br \/>\nappeal.\n<\/p>\n<p>7.0\t\tFor<br \/>\nthe foregoing reasons, the Appeal is dismissed.
