Petitioner had availed a loan from the 2nd respondent<\/p>\n<p>Bank to the tune of Rs.14,50,000\/- for establishing a printing<\/p>\n<p>press. Repayment of the loan was defaulted after payment of<\/p>\n<p>some of the installments, allegedly due to loss suffered in the<\/p>\n<p>business. The 2nd respondent Bank issued Ext.P1 demand notice<\/p>\n<p>requesting to pay the entire arrears amounting to Rs.23,79,095\/-.<\/p>\n<p>Through Exts.P2 and P3, the petitioner had requested the Bank<\/p>\n<p>to consider settlement under the &#8216;One time settlement Scheme&#8217;<\/p>\n<p>and also requested to drop all further coercive steps facilitating<\/p>\n<p>the petitioner to pay off the liability within a reasonable period.<\/p>\n<p>It is evident from Ext.P4 that the Bank had initiated proceedings<\/p>\n<p>under the provisions of the SARFAESI Act and symbolic<\/p>\n<p>possession of the property mortgaged for securing the loan had<\/p>\n<p>already been taken over under Section 13(4) of the said Act. On<\/p>\n<p>receipt of Ext.P4 the petitioner further submitted Ext.P5 seeking<\/p>\n<p>time for payment of the balance amount.\n<\/p>\n<p>      2.   Heard the learned counsel for petitioner and Standing<\/p>\n<p>Counsel appearing for the respondent Bank. It is submitted that<\/p>\n<p><span class=\"hidden_text\">W.P.(C).23894\/09-F              2<\/span><\/p>\n<p>the arrears due in the loan account as on 24.8.2009 is<\/p>\n<p>Rs.38,36,628\/- along with future interest. It is further submitted<\/p>\n<p>that eventhough there is no existing scheme for One time<\/p>\n<p>settlement, the matter can be considered for settlement, on<\/p>\n<p>allowing possible waiver of interest, provided the petitioner<\/p>\n<p>makes a considerable payment immediately. Having considered<\/p>\n<p>the entire facts and circumstances of the case I am inclined to<\/p>\n<p>direct consideration of settlement of the arrears, on condition of<\/p>\n<p>the petitioner making a substantial payment.<\/p>\n<p>     3.     Accordingly the writ petition is disposed of directing<\/p>\n<p>the petitioner to make payment of an amount of Rs.7 lakhs on or<\/p>\n<p>before 15.10.2009, and to submit a representation to the 2nd<\/p>\n<p>respondent Bank seeking settlement of the balance on allowing<\/p>\n<p>waiver of interest to the extent possible. The respondent Bank<\/p>\n<p>shall thereupon take a final decision in the matter permitting<\/p>\n<p>waiver of interest to the allowable extent and providing<\/p>\n<p>reasonable installment facility for payment of the balance<\/p>\n<p>amount.        The decision taken in this regard shall be<\/p>\n<p>communicated to the petitioner providing reasonable time for<\/p>\n<p>effecting payment of such installments. All further proceedings<\/p>\n<p>pursuant to Ext.P4 notice shall be kept in abeyance till such<\/p>\n<p>decision is taken by the Bank.
