No.20450 of 2011\n                                      Anand Kumar\n                                          Versus\n                                   The State Of Bihar\n                                        -----------\n<\/pre>\n<p>2   01.07.2011                Heard learned counsels for the petitioner and<\/p>\n<p>                 the State.\n<\/p>\n<p>                              The petitioner is apprehending his arrest in a<\/p>\n<p>                 case registered under Section 47a of the Excise Act.<\/p>\n<p>                              Huge quantity of country made liquor and<\/p>\n<p>                 foreign liquor were recovered. The recovery is made<\/p>\n<p>                 from two vehicles. The drivers of the vehicles were<\/p>\n<p>                 apprehended on the statement of the said drivers, the<\/p>\n<p>                 name of Satish Kumar Choudhary sprang up to the<\/p>\n<p>                 effect that it was Satish Kumar Choudhary who<\/p>\n<p>                 directed     to   unload   the   liquors.   Satish   Kumar<\/p>\n<p>                 Choudhary denied any contention with the place of<\/p>\n<p>                 unloading.\n<\/p>\n<p>                              It is alleged against these petitioner that they<\/p>\n<p>                 are the owners of the vehicles from which seizure has<\/p>\n<p>                 been made and they were not present on the place of<\/p>\n<p>                 seizure.\n<\/p>\n<p>                        It is submitted by the learned counsel for the<\/p>\n<p>             petitioners that for carrying the liquor, the drivers were<\/p>\n<p>             responsible as there is nothing on record to show that<\/p>\n<p>             petitioner, Bindeshwar Singh was aware about the<\/p>\n<p>             foreign liquor which was being transported on his<\/p>\n<p>             vehicle. So far other petitioner Anand Kumar is<\/p>\n<p>             concerned, it is contended by him that he has already<\/p>\n<p>             sold the vehicle to other persons but the owner book<\/p>\n<p>             was not transferred. Hence the vehicle was not in<\/p>\n<p>             control of the petitioner Anand Kumar.<\/p>\n<p>                       Considering the aforesaid facts, let the above<\/p>\n<p>             named petitioner, be released on anticipatory bail, in<\/p>\n<p>             the event of his arrest or surrender before the learned<\/p>\n<p>             Court below within a period of 12 weeks from today,<\/p>\n<p>             on furnishing bail bond of Rs. 10,000\/- (ten thousand)<\/p>\n<p>             with two sureties of the like amount each to the<\/p>\n<p>             satisfaction of the learned     Judicial Magistrate, 1 st<\/p>\n<p>             Class, Samastipur in connection with Excise Case No.<\/p>\n<p>             30\/2010, subject to the conditions as laid down under<\/p>\n<p>             Section 438(2) Cr.P.C.\n<\/p>\n<p>                                           (Dinesh Kumar Singh, J.)<br \/>\nAmrendra\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Anand Kumar vs The State Of Bihar on 1 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
