Subhash Chandra Agarwal, J.\n<\/p>\n<p>       This Habeas Corpus Petition has been filed for setting-aside<br \/>\nthe order of detention passed against the petitioner Sonu under<br \/>\nSection 3 (2) of the National Security Act dated 21.2.2009 by<br \/>\nDistrict Magistrate, Bareilly.\n<\/p>\n<p>       The detention order was passed on the grounds that on<br \/>\n8.1.2009 at 8 a.m., in pursuance of a secret information, the Police<br \/>\nof P.S. Prem Nagar, district Bareilly, arrested six persons including<br \/>\nthe writ petitioner standing in-front of Kudeshiya Phatak, Nainital<br \/>\nRoad, Bareilly. 44 currency notes of Rs.100\/- denomination were<br \/>\nrecovered from the possession of the petitioner. Similarly, fake<br \/>\ncurrency notes were also recovered from other 5 persons arrested<br \/>\non the spot. On interrogation, it was revealed that fake currency<br \/>\nnotes were being printed at the house of Mahendra Pal Gangwar in<br \/>\nvillage Simra Keshavpur, Police Station Faridpur, district Bareilly<br \/>\nwith the help of computer, scanner etc. Police raided the house of<br \/>\nMahendra Pal Gangwar, arrested him and on search, computer<br \/>\nmonitor and other articles including half printed notes were also<br \/>\nrecovered. As a result of these activities, a feeling of doubt and<br \/>\ninsecurity was developed in the public mind in respect of genuine<br \/>\ncurrency notes and country&#8217;s economy was also prejudicially<br \/>\naffected. District Magistrate apprehended that the bail might be<br \/>\ngranted to the petitioner by the Court and there was apprehension<br \/>\nthat the petitioner would again involve himself in the aforesaid<br \/>\ncriminal activities affecting public servies and economy of the<br \/>\nNation, hence it was thought necessary to preventively detain the<br \/>\npetitioner.\n<\/p>\n<p>       We have heard Dr. Arun Srivastava, learned counsel for the<br \/>\npetitioner, Sri Sudhir Mehrotra, learned counsel for the respondent<br \/>\nnos. 2 to 4 and Sri D.K.Tiwari, learned counsel for respondent no.1<br \/>\n<span class=\"hidden_text\">                                                                    2<\/span><\/p>\n<p>Union of India.\n<\/p>\n<p>       The learned counsel for the petitioner has confined himself<br \/>\nto one submission that the representation of the petitioner dated<br \/>\n6.3.2009 which was submitted to various authorities including the<br \/>\nCentral Government through jailor, was considered with inordinate<br \/>\ndelay by the Central Government.\n<\/p>\n<p>       It was pointed out that the District Magistrate forwarded the<br \/>\npetitioner&#8217;s representation with his comments on 22.3.2009, to the<br \/>\nState Government after obtaining the comments from the D.I.G.<br \/>\nPolice, Bareilly. It was submitted that the State Government<br \/>\nreceived the representation on 23.3.2009 and even rejected the<br \/>\nsame on 25.3.2009. This shows that the State Government<br \/>\ndisposed of the representation of the petitioner with utter<br \/>\npromptness.\n<\/p>\n<p>       In the counter affidavit filed on behalf of Union of India by<br \/>\nthe under Secretary, Ministry of Home and Affairs, Government of<br \/>\nIndia, it was submitted that the representation of the petitioner was<br \/>\nreceived by the Ministry of Home Affairs on 30.3.2009. The<br \/>\nrepresentation of detenue was processed on 9.4.2009 at the levels<br \/>\nof under Secretary, Consultant and Joint Secretary and was placed<br \/>\nbefore the Union Home Secretary who considered the case of the<br \/>\ndetenue on 16.4.2009 and the representation of the petitioner was<br \/>\nrejected. The decision of the Central Government was sent by a<br \/>\nwireless message dated 17.4.2009 to Government of U.P and<br \/>\nSuperintendent District Jail, Bareilly, U.P informing that the<br \/>\nrepresentation of the petitioner was considered and rejected by the<br \/>\nCentral Government on 16.4.2009.\n<\/p>\n<p>       It was further submitted by the learned counsel for the<br \/>\nrespondent no.4 that there was no delay in processing the<br \/>\nrepresentation of the petitioner.\n<\/p>\n<p>       The representation of the petitioner was received by the<br \/>\nCentral Government on 30.3.2009 and after processing, was put<br \/>\nup before Home Secretary on 15.4.2009. No satisfactory<br \/>\nexplanation for this delay of 15 days has been furnished by the<br \/>\nrespondent no.4. Counter affidavit filed by Union of India reveals<br \/>\nthat despite representation of the petitioner having been received<br \/>\non 30.3.2009, nothing was done till 9.4.2009. The processing of the<br \/>\nrepresentation started on 9.4.2009. There is no explanation on<br \/>\nrecord to explain the delay from 30.3.2009 to 9.4.2009.\n<\/p>\n<p><span class=\"hidden_text\">                                                                    3<\/span><\/p>\n<p>       <a href=\"\/doc\/468004\/\">In Rajammal V. State of Tamil Nadu, AIR<\/a> 1999 SC 684<br \/>\nwhere consideration of the representation had been delayed<br \/>\nmerely because the Minister was on tour, it was held to be an<br \/>\nunjustified ground for permitting violation of the fundamental rights<br \/>\nof liberty of a citizen guaranteed under Article 21 of the<br \/>\nConstitution, as the said file could easily have been forwarded to<br \/>\nthe Minister. The said decision mentions that &#8220;absence of Minister<br \/>\nat the Headquarters is not sufficient to justify the delay, since the<br \/>\nfile could be reached to the Minister with utmost promptitude in a<br \/>\ncase involving the vital fundamental right of the citizen.&#8221;\n<\/p>\n<p>       The absence of dealing clerk of NSA Desk in February, 2009<br \/>\ndue to long leave and delay in consideration of NSA matters was<br \/>\nvery seriously viewed by another Bench of this Court in Pranshu<br \/>\nDutt Dwivedi Vs. Superintendent District Jail, Fatehgarh,<br \/>\nFarrukhabad and others, 2009 (67) ACC 83.\n<\/p>\n<p>       We find that this inordinate delay of 15 days in disposal of<br \/>\nthe representation of the petitioner by the Central Government has<br \/>\nnot been adequately and reasonably explained by the Central<br \/>\nGovernment. We are conscious of the fact that the allegations<br \/>\nagainst the petitioner are of a very serious nature but when it is<br \/>\ndecided to preventively detain a person by depriving him of his<br \/>\nright of personal freedom, the due process of law has to be<br \/>\nobserved. The manner in which the representation of the petitioner<br \/>\nremained pending before the Central Government cannot be<br \/>\njustified. In these circumstances, we have no option but to quash<br \/>\nthe continued detention of the petitioner.\n<\/p>\n<p>       The writ petition is allowed.
