No.8605 of 2011\n                KISHORI YADAV, S\/o Late Nanhaku Yadav.\n                               Versus\n                         THE STATE OF BIHAR\n                              -----------\n<\/pre>\n<p>02.   25.03.2011            Heard learned counsel for the petitioner and the<\/p>\n<p>                   State.\n<\/p>\n<p>                            The petitioner seeks bail in a case instituted for<\/p>\n<p>                   the offences under Sections 25(1-B) A and 26 of the Arms<\/p>\n<p>                   Act.\n<\/p>\n<p>                            It has been submitted on behalf of the petitioner<\/p>\n<p>                   that the petitioner is in custody since 09.08.2010 for<\/p>\n<p>                   recovery of one country-made pistol and a live cartridge<\/p>\n<p>                   and has fair antecedents.\n<\/p>\n<p>                            Considering the same, let the petitioner, above<\/p>\n<p>                   named be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                   5,000\/- (Five Thousand) with two sureties of the like<\/p>\n<p>                   amount each or any other surety as fixed by the Court to<\/p>\n<p>                   the satisfaction of Sri S.K. Tiwari, Judicial Magistrate, 1st<\/p>\n<p>                   Class, Gaya (or his successor) in connection with Mofassil<\/p>\n<p>                   P.S. Case No. 121 of 2010 (Tr. No. 2029 of 2010) subject<\/p>\n<p>                   to the following conditions:- (i) That one of the bailors will<\/p>\n<p>                   be a close relative of the petitioner who will give an<\/p>\n<p>                   affidavit giving genealogy as to how he is related with the<\/p>\n<p>                   petitioner and the other bailor shall be the mother of the<\/p>\n<p>                   petitioner. The bailor will also undertake to inform the<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>           Court if there is any change in the address of the<\/p>\n<p>           petitioner. (ii) That the affidavit shall clearly state that<\/p>\n<p>           the petitioner is not an accused in any other case and<\/p>\n<p>           if he is he shall not be released on bail. (iii) That the<\/p>\n<p>           bailor shall also state on affidavit that he will inform the<\/p>\n<p>           court concerned if the petitioner is implicated in any other<\/p>\n<p>           case of similar nature after his release in the present case<\/p>\n<p>           and thereafter the court below will be at liberty to initiate<\/p>\n<p>           the proceeding for cancellation of bail on the ground of<\/p>\n<p>           misuse.      (iv)   That   the    petitioner   will   give   an<\/p>\n<p>           undertaking that he will receive the police papers on<\/p>\n<p>           the given date and be present on date fixed for charge<\/p>\n<p>           and if he fails to do so on two given dates and delays<\/p>\n<p>           the trial in any manner, his bail will be liable to be<\/p>\n<p>           cancelled for reasons of misuse.
