\/>\nrespondent\u00adBank.\n<\/p>\n<p>Admittedly \u00a0 petitioner \u00a0 took \u00a0 loan \u00a0 to \u00a0 the \u00a0 tune \u00a0 of \u00a0Rs. \u00a0 85000\/\u00ad\u00a0 in \u00a0 the \u00a0 year \u00a0 1998 \u00a0 for\u00a0<\/p>\n<p>purchase \u00a0 of \u00a0 Buffalo \u00a0 out \u00a0 of \u00a0 which \u00a0 petitioner \u00a0 has \u00a0 not \u00a0 paid \u00a0 substantial \u00a0 amount.\u00a0<\/p>\n<p>Petitioner \u00a0 submits \u00a0 that \u00a0 he \u00a0 is \u00a0 ready \u00a0 to \u00a0 deposit \u00a0 whole \u00a0 of \u00a0 the \u00a0 amount \u00a0 in \u00a0 easy\u00a0<\/p>\n<p>installment.\n<\/p>\n<p>At\u00a0this\u00a0stage\u00a0without\u00a0challenging\u00a0correctness\u00a0of\u00a0amount\u00a0sought\u00a0to\u00a0be\u00a0recovered\u00a0a\u00a0<\/p>\n<p>prayer \u00a0 has\u00a0 been \u00a0 made \u00a0 that \u00a0 if \u00a0 amount \u00a0 sought \u00a0 to \u00a0 be\u00a0 recovered \u00a0 is\u00a0 permitted \u00a0 to \u00a0 be\u00a0<\/p>\n<p>deposited\u00a0in\u00a0easy\u00a0instalments\u00a0deposit\u00a0of\u00a0entire\u00a0amount\u00a0can\u00a0be\u00a0made.\u00a0<\/p>\n<p>Accordingly\u00a0this\u00a0petition\u00a0is\u00a0disposed\u00a0of\u00a0with\u00a0the\u00a0following\u00a0directions:<\/p>\n<p>(i) \u00a0 Petitioner \u00a0 may \u00a0 deposit \u00a0 the \u00a0 entire \u00a0 amount \u00a0 sought \u00a0 to \u00a0 be \u00a0 recovered \u00a0 directly \u00a0 in\u00a0<\/p>\n<p>concerned\u00a0Bank\/Samiti\u00a0in\u00a0six\u00a0equal\u00a0instalments.\u00a0In\u00a0calculating\u00a0the\u00a0arrears\u00a0the\u00a0amount\u00a0<\/p>\n<p>(if\u00a0any)\u00a0already\u00a0paid\u00a0will\u00a0be\u00a0adjusted.\n<\/p>\n<p>(ii)The\u00a0first\u00a0instalment\u00a0may\u00a0be\u00a0deposited\u00a0within\u00a0two\u00a0months\u00a0from\u00a0today,\u00a0and\u00a0rest\u00a0of\u00a0<\/p>\n<p>instalments\u00a0be\u00a0deposited\u00a0at\u00a0the\u00a0interval\u00a0of\u00a0two\u00a0months.\u00a0These\u00a0deposits\u00a0may\u00a0be\u00a0made\u00a0<\/p>\n<p>before\u00a0the\u00a0Branch\u00a0of\u00a0the\u00a0Bank\u00a0from\u00a0where\u00a0the\u00a0loan\u00a0was\u00a0taken.\u00a0In\u00a0case\u00a0instalments\u00a0<\/p>\n<p>are\u00a0deposited\u00a0in\u00a0the\u00a0Bank\u00a0then\u00a0half\u00a0of\u00a0the\u00a0recovery\u00a0charges\u00a0only\u00a0be\u00a0recovered\u00a0from\u00a0<\/p>\n<p>the\u00a0petitioner.\u00a0\n<\/p>\n<p>(iii) \u00a0 During \u00a0 period \u00a0 the \u00a0 recovery \u00a0 proceedings \u00a0 will \u00a0 be \u00a0 kept \u00a0 in \u00a0 abeyance. \u00a0 In \u00a0 case\u00a0<\/p>\n<p>petitioner\u00a0defaults\u00a0in\u00a0depositing\u00a0any\u00a0of\u00a0the\u00a0instalments\u00a0within\u00a0the\u00a0above\u00a0stipulated\u00a0<\/p>\n<p>time\u00a0it\u00a0will\u00a0be\u00a0open\u00a0to\u00a0the\u00a0respondents\u00a0to\u00a0start\u00a0recovery\u00a0proceedings\u00a0again\u00a0by\u00a0taking\u00a0<\/p>\n<p>coercive\u00a0process\u00a0at\u00a0once\u00a0to\u00a0which\u00a0the\u00a0petitioner\u00a0undertakes\u00a0not\u00a0to\u00a0challenge.<\/p>\n<p>(iv)\u00a0Petitioner\u00a0may\u00a0file\u00a0an\u00a0application\u00a0for\u00a0supply\u00a0of\u00a0statement\u00a0of\u00a0account\u00a0alongwith\u00a0the\u00a0<\/p>\n<p>duly\u00a0 stamped \u00a0 self \u00a0 addressed \u00a0 envelope. \u00a0 In \u00a0 case \u00a0 any\u00a0 such \u00a0 application \u00a0 is\u00a0 filed, \u00a0 the\u00a0<\/p>\n<p>concerned\u00a0branch\u00a0of\u00a0the\u00a0Bank\u00a0will\u00a0give\u00a0the\u00a0same\u00a0to\u00a0the\u00a0petitioner\u00a0after\u00a0deposit\u00a0of\u00a0first\u00a0<br \/>\n instalment\u00a0within\u00a0fifteen\u00a0days.\u00a0\n<\/p>\n<p>(v)\u00a0This\u00a0order\u00a0will\u00a0not\u00a0affect\u00a0any\u00a0auction\u00a0if\u00a0it\u00a0has\u00a0already\u00a0taken\u00a0place.\u00a0In\u00a0that\u00a0event\u00a0the\u00a0<\/p>\n<p>petitioner \u00a0 may\u00a0 take \u00a0 appropriate \u00a0 legal \u00a0 proceedings\u00a0 to \u00a0 set \u00a0 aside \u00a0 the \u00a0 auction \u00a0 under\u00a0<\/p>\n<p>U.P.Z.A\u00a0&amp;\u00a0L.R.\u00a0Act\u00a0and\u00a0Rules\u00a01952\u00a0or\u00a0file\u00a0a\u00a0suit\u00a0in\u00a0accordance\u00a0with\u00a0law.<\/p>\n<p>(vi)\u00a0It\u00a0is\u00a0clarified\u00a0that\u00a0this\u00a0order\u00a0will\u00a0be\u00a0operative\u00a0and\u00a0will\u00a0not\u00a0come\u00a0in\u00a0way\u00a0of\u00a0recovers\u00a0<\/p>\n<p>process\u00a0in\u00a0any\u00a0manner,\u00a0if\u00a0any,\u00a0other\u00a0writ\u00a0petition\u00a0has\u00a0been\u00a0filed\u00a0before\u00a0this\u00a0Court\u00a0<\/p>\n<p>against\u00a0the\u00a0recovery\u00a0proceeding\u00a0for\u00a0the\u00a0loan\u00a0amount.\u00a0\n<\/p>\n<p>(vii) \u00a0 Property \u00a0 (agricultural \u00a0 land\/tractor) \u00a0 belonging \u00a0 to \u00a0 the \u00a0 petitioner, \u00a0 if \u00a0 attached \u00a0 in\u00a0<\/p>\n<p>connection \u00a0 with \u00a0 recovery \u00a0 proceedings, \u00a0 will \u00a0 be \u00a0 released \u00a0 by \u00a0 the \u00a0 concerned \u00a0 Tahsil\u00a0<\/p>\n<p>authority\u00a0(unless\u00a0it\u00a0has\u00a0been\u00a0auctioned)\u00a0after\u00a0deposit\u00a0of\u00a0first\u00a0instalment\u00a0and\u00a0further\u00a0<\/p>\n<p>moment\u00a0first\u00a0instalment\u00a0is\u00a0paid\u00a0the\u00a0applicant\u00a0shall\u00a0also\u00a0be\u00a0released.\u00a0<\/p>\n<p>(viii)\u00a0if\u00a0any\u00a0fact\u00a0given\u00a0from\u00a0the\u00a0side\u00a0of\u00a0the\u00a0petitioner\u00a0is\u00a0found\u00a0to\u00a0be\u00a0incorrect\u00a0by\u00a0bank\u00a0<\/p>\n<p>authorities.\u00a0It\u00a0will\u00a0be\u00a0open\u00a0for\u00a0them\u00a0to\u00a0move\u00a0an\u00a0application\u00a0for\u00a0modification\/recall\u00a0of\u00a0<\/p>\n<p>the\u00a0order.\n<\/p>\n<p>With\u00a0the\u00a0aforesaid\u00a0writ\u00a0petition\u00a0stands\u00a0disposed\u00a0of.\n<\/p>\n<p>Order
