JHAVERI)<\/p>\n<p>\t\tBy<br \/>\nway of this writ petition, the petitioners &#8211; original<br \/>\nrespondents have challenged the judgment and order dated 28.11.2003<br \/>\npassed by the Central Administrative Tribunal, Ahmedabad Bench,<br \/>\nAhmedabad in O.A. No.213 of 2003 whereby the Tribunal has allowed the<br \/>\noriginal application filed by the respondent herein only on the<br \/>\nground of non-payment of the subsistence allowance by the petitioners<br \/>\nto the respondent during the course of the departmental inquiry.\n<\/p>\n<p>2.\t\tWe<br \/>\nhave heard learned counsel Mr. Shakeel A. Qureshi for the petitioners<br \/>\nand learned counsel Mr. Anand L. Sharma appearing for the respondent.\n<\/p>\n<p>3.\t\tWe<br \/>\nhave gone through the impugned judgment of the Tribunal.  We are of<br \/>\nthe view that in view of the subsequent judgment of the Hon&#8217;ble<br \/>\nSupreme Court in the case of <a href=\"\/doc\/1354141\/\">Indra Bhanu Gaur v. Committee,<br \/>\nManagement of M. M. Degree College and others<\/a>, reported in 2004 (1)<br \/>\nS.C. SERVICE LAW JUDGMENTS 3, the view taken by the Tribunal is<br \/>\ncontrary to the law laid down by the Hon&#8217;ble Supreme Court.  In the<br \/>\nabove decision of the Hon&#8217;ble Supreme Court, in head note (B), it is<br \/>\nobserved as under :-\n<\/p>\n<p>&#8220;Non-payment<br \/>\nof subsistence allowance cannot vitiate the proceedings unless<br \/>\nprejudice is shown and established.  It has to be specifically<br \/>\npleaded or established as to in what way the affected employee is<br \/>\nhandicapped because of non-receipt of subsistence allowance.&#8221;\n<\/p>\n<p>4.\t\tIn<br \/>\nthe above view of the matter, the view taken by the Tribunal is<br \/>\ncontrary to the law laid down by the Hon&#8217;ble Supreme Court.  Hence,<br \/>\nthe impugned order is bad in law and is required to be quashed and<br \/>\nset aside.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe result, the petition is allowed.  The judgment and order dated<br \/>\n28.11.2003 passed by the Central Administrative Tribunal, Ahmedabad<br \/>\nBench, Ahmedabad in O.A. No.213 of 2003 is quashed and set aside.<br \/>\nThe matter is remanded back to the Tribunal to decide the Original<br \/>\nApplication on merits.  It is made clear that this Court has not<br \/>\nexpressed any opinion on the merits of the case and the Tribunal<br \/>\nshall reconsider the same depending on the merits of the case,<br \/>\nwithout being influenced by this order.  Rule is made absolute.  The<br \/>\nparties shall bear their own costs.\n<\/p>\n<p>\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t[V. M.
