H. BHATIA, J.\n<\/pre>\n<p>                                  DATE:- 3rd APRIL, 2009<\/p>\n<p>    ORAL JUDGMENT<\/p>\n<p>    1.           Heard learned counsel for the parties. The petitioner<\/p>\n<p>    was, admittedly, working as Head Mistress of Savitribai Fule<\/p>\n<p>    Vidyalaya, at Masod, dist. Wardha. The School is run by respondent<\/p>\n<p>    no. 2-Savitribai Fule, Shikshan Prasarak Mandal.       An enquiry was<\/p>\n<p>    initiated by the Management against the present petitioner and in all<\/p>\n<p>    twenty two charges were levelled against her. Enquiry Committee was<\/p>\n<p>    constituted consisting of representative of Management, representative<\/p>\n<p>    of delinquent Head Mistress and a State Awardee Head Master. After<\/p>\n<p>    enqiry, report was submitted by said Committee. As per that report,<\/p>\n<p>    representative of the Management on the enquiry committee held that<\/p>\n<p>    out of twenty two charges, one charge was not proved while twenty<\/p>\n<p>    one charges were proved. As per finding of the State Awardee Head<\/p>\n<p>    Master, out of twenty two charges, only nine charges were proved<\/p>\n<p>    while according to representative of the delinquent employee, no<\/p>\n<p><span class=\"hidden_text\">                                                    ::: Downloaded on &#8211; 09\/06\/2013 14:29:41 :::<\/span><br \/>\n                                       \u2702<\/p>\n<p>    charge was proved. On the point of punishment also members of the<\/p>\n<p>    enquiry committee could not come to any unanimous decision while<\/p>\n<p>    representative of the Management recommended that major penalty<\/p>\n<p>    should be imposed, the State Awardee Head Master recommended<\/p>\n<p>    that minor penalty should be imposed and consistent to his own<\/p>\n<p>    finding, representative of the delinquent employee came to the<\/p>\n<p>    conclusion that no penalty should be imposed. As such, majority of<\/p>\n<p>    enquiry committee members had agreed that nine charges were<\/p>\n<p>    proved. As the enqiry Committee could not prescribe any punishment<\/p>\n<p>    unanimously, report was submitted to the Management and after<\/p>\n<p>    looking into the report, the Management passed an order, reducing the<\/p>\n<p>    petitioner&#8217;s rank i.e. from the post of Head Mistress to the post of<\/p>\n<p>    Assistant Teacher. That order was challenged by the petitioner before<\/p>\n<p>    the School Tribunal in Appeal No. STN 26\/1999. After hearing the<\/p>\n<p>    parties, the School Tribunal dismissed the appeal by impugned<\/p>\n<p>    judgment dated 31.10.2000. That order is challenged in the present<\/p>\n<p>    petition.\n<\/p>\n<p><span class=\"hidden_text\">                                                   ::: Downloaded on &#8211; 09\/06\/2013 14:29:41 :::<\/span><\/p>\n<p>                                        \u2704<\/p>\n<p>    2.            Section 4 (6) of the Maharashtra Employees of Private<\/p>\n<p>    Schools (Conditions of Service) Regulation Act,1977 (For short the<\/p>\n<p>    &#8220;Act&#8221;) provides that no employee of the private school shall be<\/p>\n<p>    suspended, dismissed or removed or his services shall not be otherwise<\/p>\n<p>    terminated or he shall not be reduced in rank by the Management<\/p>\n<p>    except in accordance with the provisions of the Act and Rules made in<\/p>\n<p>    that behalf. The penalties are classified as minor penalties and major<\/p>\n<p>    penalties in Rule 31 of Maharashtra Employees of Private Schools<\/p>\n<p>    (Conditions of Service) Rules, 1981 (For short the &#8220;Rules&#8221;).            Minor<\/p>\n<p>    penalties are; (i) reprimand (ii) warning (iii) censure (iv) withholding<\/p>\n<p>    of an increment for a period not exceeding one year (v) recovery from<\/p>\n<p>    pay or such other amount as may be due to him of the whole or part of<\/p>\n<p>    any pecuniary loss caused to the Institution by negligence or breach of<\/p>\n<p>    orders. The major penalties are (i) reduction in rank (ii) termination<\/p>\n<p>    of service.\n<\/p>\n<p>    3.            For inflicting the major penalties, the procedure is laid<\/p>\n<p>    down under rules 33 to 37 of the Rules. Rule 37 (6) provides that<\/p>\n<p><span class=\"hidden_text\">                                                     ::: Downloaded on &#8211; 09\/06\/2013 14:29:41 :::<\/span><br \/>\n                                       \u260e<\/p>\n<p>    after obtaining explanation of delinquent employee and after<\/p>\n<p>    completion of enquiry, the enquiry committee shall communicate its<\/p>\n<p>    findings on the charges against the employee and its decision on the<\/p>\n<p>    basis of those findings to the Management for specific action to be<\/p>\n<p>    taken against the employee or the Head as the case may be. It also<\/p>\n<p>    provides that the decision of the enquiry committee shall be<\/p>\n<p>    implemented by the Management by issuing necessary orders within<\/p>\n<p>    seven days from the date of receipt of decision of the enquiry<\/p>\n<p>    committee. From this, it is clear that the decision about the penalty,<\/p>\n<p>    on the basis of the findings, has to be taken by the enquiry committee<\/p>\n<p>    itself and that decision has to be communicated to Management. The<\/p>\n<p>    Management has to implement that decision. The Act and the Rules<\/p>\n<p>    do not give powers to the Management to take decision as to what<\/p>\n<p>    punishment or penalty should be imposed on the basis of finding of<\/p>\n<p>    the enquiry committee.\n<\/p>\n<p>    4.           In the present case, as indicated above, there was no<\/p>\n<p>    unanimity amongst the members of the enquiry committee in respect<\/p>\n<p><span class=\"hidden_text\">                                                    ::: Downloaded on &#8211; 09\/06\/2013 14:29:41 :::<\/span><br \/>\n                                       \u2706<\/p>\n<p>    of findings as well as penalty. The representative of the Management<\/p>\n<p>    found that twenty one charges were proved while State Awardee Head<\/p>\n<p>    Master held that nine charges were proved. Admittedly those nine<\/p>\n<p>    charges were also included in the twenty one charges, which ware<\/p>\n<p>    found to be proved by representative of the Management. Therefore,<\/p>\n<p>    it can be held that out of three members of the enquiry committee,<\/p>\n<p>    two members were unanimous that those nine charges were proved.\n<\/p>\n<p>    So it may be held that, by majority of two against one it was held by<\/p>\n<p>    the enquiry committee that nine charges are proved. About the other<\/p>\n<p>    charges, which were proved according to the representative of the<\/p>\n<p>    Management, it must be held that the findings were defeated by two<\/p>\n<p>    against one.   The members of the enquiry committee also did not<\/p>\n<p>    come to a decision about penalty, which could be given. According to<\/p>\n<p>    representative of Management, major penalty should be given but it<\/p>\n<p>    was not acceptable to the other two members. The State Awardee<\/p>\n<p>    Head Master found that minor penalty should be imposed. In view of<\/p>\n<p>    this, the Management took upon itself to decide what penalty should<\/p>\n<p>    be imposed. Accordingly, punishment of reduction in rank from the<\/p>\n<p><span class=\"hidden_text\">                                                   ::: Downloaded on &#8211; 09\/06\/2013 14:29:41 :::<\/span><br \/>\n                                        \u271d<\/p>\n<p>    post of Head Mistress to the Assistant Teacher was awarded but this<\/p>\n<p>    could not have been done by the Management in view of the Rules.\n<\/p>\n<p>    5.           In Kashiram Rajaram Kathane ..vs.. Bhartiya R. B. Damle<\/p>\n<p>    Gram Sudhar Tatha Shikshan Prasar Society and others; 1997 (3) Mh.\n<\/p>\n<p>    L. J. 235, the Division Bench of this Court in para 6, observed as<\/p>\n<p>    under:-\n<\/p>\n<blockquote><p>              &#8220;6. In this case, a reading of Rule 37 (6) would<br \/>\n              show that the Committee constituted was the<\/p>\n<p>              enquiring authority as well as the final decision<br \/>\n              making authority in the sense that the management&#8217;s<br \/>\n              role was only to implement the decision of the<\/p>\n<p>              enquiry Committee.           Therefore, the role of the<\/p>\n<p>              Committee       cannot        be   treated      as       only<br \/>\n              recommendatory Thus, the Committee really is the<\/p>\n<p>              decision making authority who was to take evidence<br \/>\n              and adjudicate the matter.         When the nature of<br \/>\n              character of the Committee is so understood, the<br \/>\n              whole proceeding must be consistent with the<\/p>\n<p>              principles of natural justice.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">                                                      ::: Downloaded on &#8211; 09\/06\/2013 14:29:41 :::<\/span><\/p>\n<blockquote><p>                                        \u271e<\/p>\n<p>                  From this, it is clear that the enquiry committee is not<\/p>\n<p>    only the enquiring authority but also final decision making authority<\/p>\n<p>    and the decision of that enquiry committee has to be implemented by<\/p>\n<p>    the Management. The Management has no other role in the enquiry.\n<\/p><\/blockquote>\n<p>    6.            Section 4A of the Act, which is helpful in resolving the<br \/>\n    controversy involved in the matter, reads as follows :-\n<\/p>\n<blockquote><p>               &#8220;4A. (1) Notwithstanding anything contained in sub-\n<\/p><\/blockquote>\n<blockquote><p>               section (6) of section 4 or any other provisions of this<br \/>\n               Act or the rules made thereunder, where in any case<\/p>\n<p>               of alleged misconduct or misbehaviour of a serious<br \/>\n               nature or moral turpitude of an employee-<\/p><\/blockquote>\n<p>               (a) an enquiry is held by an enquiry Committee into<\/p>\n<p>               such allegations and the Director is of the opinion<\/p>\n<p>               that the enquiry Committee has unreasonably<br \/>\n               exonerated the employee, he may call for and<\/p>\n<p>               examine the record and proceeding of such enquiry<br \/>\n               for the purpose of satisfying himself as to the<br \/>\n               correctness of the decision on the basis of its<br \/>\n               findings, and may either annul, revise, modify or<\/p>\n<p>               confirm the said decision or may direct the Enquiry<br \/>\n               Committee to make further enquiry for taking such<br \/>\n               additional evidence as they may think necessary or<\/p>\n<p><span class=\"hidden_text\">                                                      ::: Downloaded on &#8211; 09\/06\/2013 14:29:41 :::<\/span><br \/>\n                              \u271f<\/p>\n<p>     he may himself take or authorise any other officer<\/p>\n<p>     not below the rank of the Education Officer to take<br \/>\n     such additional evidence; and while making an order<\/p>\n<p>     under this clause, if the director is satisfied that the<br \/>\n     charges of serious misconduct, misbehaviour or as<br \/>\n     the case may be, moral turpitude have been<\/p>\n<p>     substantially proved, he shall direct the Management<br \/>\n     to impose on such employee any of the penalties as<\/p>\n<p>     specified in sub-section (4):\n<\/p>\n<p>          Provided that, the Director shall not record any<\/p>\n<p>     order under this sub-section without giving the party<\/p>\n<p>     affected thereby and the Management an opportunity<br \/>\n     of being heard.\n<\/p>\n<p>     (b) the Management has either neglected or refused<\/p>\n<p>     to hold an        enquiry against such employee in<\/p>\n<p>     accordance with the provisions of this Act and the<br \/>\n     rules made in that behalf, the Director shall direct<br \/>\n     the Management to initiate action within thirty days<\/p>\n<p>     from the receipt of such directions for holding<br \/>\n     enquiry into the allegation against such employee<br \/>\n     and to complete the same in accordance with such<\/p>\n<p>     provisions and rules.\n<\/p>\n<p>     (2) Where there is a failure on the part of the<br \/>\n     Management to initiate action as directed under<\/p>\n<p><span class=\"hidden_text\">                                            ::: Downloaded on &#8211; 09\/06\/2013 14:29:41 :::<\/span><br \/>\n                             \u2720\u261b\u2721<\/p>\n<p>     clause (b) of sub-section (1) to hold an enquiry and<\/p>\n<p>     to complete the same within the period prescribed<br \/>\n     under the rules the Director may himself hold or<\/p>\n<p>     direct any officer not below the rank of Education<br \/>\n     Officer to hold, such enqury.\n<\/p>\n<p>     (3) While holding an enquiry the Director or the<\/p>\n<p>     officer authorised by him shall follow the same<br \/>\n     procedure as is followed by the enquiry Committee<\/p>\n<p>     under the rules made under this Act as if the Director<br \/>\n     or the officer so authorised were an Enquriy<\/p>\n<p>     Committee for the purpose of holding such enquiry.\n<\/p>\n<p>     (4) On holding such enquiry by the Director himself<br \/>\n     or on receipt of the report of the Enquiry officer, if<br \/>\n     the Director is satisfied that the charges of serious<\/p>\n<p>     misconduct, misbehaviour or, as the case may be,<\/p>\n<p>     moral turpitude have been substantially proved, he<br \/>\n     shall, by an order in writing, direct the management<br \/>\n     that a penalty of dismissal, removal from service,<\/p>\n<p>     termination of service, or as the case may be,<br \/>\n     reduction in rank as he may, in the circumstances of<br \/>\n     the case deem fit, be imposed on the employee<\/p>\n<p>     concerned:\n<\/p>\n<p>         Provided that, no such order shall be passed by<br \/>\n     Director unless the employee and the Management<\/p>\n<p><span class=\"hidden_text\">                                          ::: Downloaded on &#8211; 09\/06\/2013 14:29:41 :::<\/span><br \/>\n                                       \u261e <\/p>\n<p>              concerned are given a reasonable opportunity of<\/p>\n<p>              showing cause against the proposed order.<br \/>\n              (5) The order of the Director under clause (a) of<\/p>\n<p>              sub-section (1) or sub-section (4) shall be binding on<br \/>\n              both the Management and the employee and the<br \/>\n              same shall be complied with by the Management<\/p>\n<p>              within such period as may be specified by the<br \/>\n              Director.&#8221;\n<\/p>\n<p>    7.<\/p>\n<p>                 From clause (a) of sub section (1) of section 4A, it<\/p>\n<p>    becomes clear that were there are allegations of misconduct or<\/p>\n<p>    misbehavour of serious nature by an employee and an enquiry has<\/p>\n<p>    been held and enquiry committee has unreasonably exonerated the<\/p>\n<p>    employee, the Director of Education may call the record and if<\/p>\n<p>    necessary give directions to the enquiry committee to make further<\/p>\n<p>    enquiry by taking additional evidence or he may himself take<\/p>\n<p>    additional evidence or may direct the Education Officer to take<\/p>\n<p>    additional evidence and if he finds that the charges of serious<\/p>\n<p>    misconduct misbehaviour or moral turpitude have been substantially<\/p>\n<p>    proved, he shall direct the Management to impose on such employee<\/p>\n<p><span class=\"hidden_text\">                                                   ::: Downloaded on &#8211; 09\/06\/2013 14:29:41 :::<\/span><br \/>\n                                       \u270c\u261b\u270d<\/p>\n<p>    any of the penalties as specified in sub section (4). Proviso to sub<\/p>\n<p>    section (4) also provide that no such order shall be passed by Director<\/p>\n<p>    unless employee and the Management are given                     reasonable<\/p>\n<p>    opportunity of showing cause against the proposed order. Sub Section<\/p>\n<p>    (5) provides that the order passed by Director shall be binding on<\/p>\n<p>    both, Management as well as employee and that order has to be<\/p>\n<p>    complied with by the Management.\n<\/p>\n<p>    8.            Admittedly nine charges viz. charge nos. 2, 6 (6.2), 7<\/p>\n<p>    (7.1 &amp; 7.2), 10, 11, 12, 13, 18, 21 (21.2, 21.3, 21.4, 21.5, 21.6, 21.7<\/p>\n<p>    and 21.8) are proved as per the majority decision and according to the<\/p>\n<p>    opinion of representative of the Management, these charges are so<\/p>\n<p>    serious that major penalty of reduction in rank should be awarded. In<\/p>\n<p>    my considered opinion, when the enquiry committee could not come<\/p>\n<p>    to any conclusion and could not decide as to what penalty should be<\/p>\n<p>    imposed, it is a fit case where Director should invoke his powers under<\/p>\n<p>    Section 4A of the Act and after hearing the Management as well as the<\/p>\n<p>    employee, he shall take a decision and the penalty may be awarded.\n<\/p>\n<p><span class=\"hidden_text\">                                                     ::: Downloaded on &#8211; 09\/06\/2013 14:29:41 :::<\/span><\/p>\n<p>                                        \u270e\u2711\u270f<\/p>\n<p>    Learned counsel for the parties inform that powers of the Director are<\/p>\n<p>    delegated to the Deputy Director of Education. Learned counsel for<\/p>\n<p>    both the parties agree that this will be the only appropriate direction<\/p>\n<p>    in the given circumstances. It appears that the School Tribunal did not<\/p>\n<p>    consider this aspect and dismissed the appeal.        In my considered<\/p>\n<p>    opinion, the School Tribunal was not right in dismissing the appeal<\/p>\n<p>    straightway without considering this legal position and, therefore, it is<\/p>\n<p>    necessary to set aside the order passed by the Management as well as<\/p>\n<p>    the impugned judgment passed by the School Tribunal.\n<\/p>\n<p>    9.            For the aforesaid reasons, writ petition is allowed. The<\/p>\n<p>    impugned order passed by the Management reducing the petitioner in<\/p>\n<p>    rank i.e. from the post of Head Mistress to Assistant Teacher, is hereby<\/p>\n<p>    set aside. The impugned judgment passed by the School Tribunal in<\/p>\n<p>    appeal No. STN 26\/1999 dated 31.10.2000 is also hereby set aside.\n<\/p>\n<p>    The matter be referred to the Director of Education to take a decision<\/p>\n<p>    about penalty to be awarded to the petitioner as per provisions of<\/p>\n<p>    Section 4A of the Act, in the light of above observations.\n<\/p>\n<p><span class=\"hidden_text\">                                                      ::: Downloaded on &#8211; 09\/06\/2013 14:29:41 :::<\/span><\/p>\n<p>                                        \u2712\u2714\u2713<\/p>\n<p>                  The Director\/Dy. Director of Education, shall take a<\/p>\n<p>    decision about penalty on the basis that nine charges, enumerated<\/p>\n<p>    above, have been proved by majority of two against one by the enquiry<\/p>\n<p>    committee. No other point shall be allowed to be raised by any of the<\/p>\n<p>    parties before the Director\/Dy. Director.\n<\/p>\n<p>                  The Director\/Deputy Director shall take decision within<\/p>\n<p>    two months from the date when the parties appear before him. The<\/p>\n<p>    parties shall appear before the Deputy Director at Nagpur on<\/p>\n<p>    20.04.2009.\n<\/p>\n<p>                  The petitioner is presently working as Assistant Teacher<\/p>\n<p>    in view of the penalty imposed by the Management.                 She shall<\/p>\n<p>    continue to discharge her functions as such till the decision of Deputy<\/p>\n<p>    Director and the decision of the Deputy Director shall be binding on<\/p>\n<p>    both the parties.\n<\/p>\n<p>                  Rule made absolute accordingly.
