SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/08\/2008 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\t Rule.\n<\/p>\n<p>Mr.H.M.Parikh, learned Advocate waives service of notice of Rule on<br \/>\nbehalf of the respondents. With the consent of the learned Advocates<br \/>\nappearing on behalf of the respective parties, the petition is taken<br \/>\nup for final hearing today.\n<\/p>\n<p>2.\t\tBy<br \/>\nway of this petition, the petitioners ?  original defendants have<br \/>\nprayed for an appropriate Writ, order to quash and setting aside the<br \/>\nimpugned order dated 29.04.2008 passed by the learned Additional<br \/>\nDistrict Judge &amp; Presiding Officer, Fast Track Court No.4, Anand<br \/>\nin Civil Misc.Appeal No.32 of 2008 by which the learned Appellate<br \/>\nCourt has allowed the said Appeal by quashing and setting aside the<br \/>\norder dated 27.03.2008 passed by the learned trial Court below Exh.5<br \/>\nin Regular Civil Suit No.22 of 2008.\n<\/p>\n<p>3.\t\tRespondents<br \/>\n?  herein ?  original plaintiffs had instituted Regular Civil Suit<br \/>\nNo.22 of 2008 in the Court of learned Civil Court, Khambhat for<br \/>\nperpetual injunction restraining the defendants and their servants or<br \/>\nagents from entering into suit property and disturbing the possession<br \/>\nof the plaintiffs. As per the plaintiffs they were the tenant of the<br \/>\npredecessor ?  in ?  title of the present petitioners ?  original<br \/>\nplaintiffs and they were running the hotel which is disputed property<br \/>\nin the name of Saraswaty Hotel since year 2002 and they have been<br \/>\npaying consideration to the tune of Rs.3000\/- per year to the said<br \/>\npredecessor-in-title.  In the said suit the plaintiffs submitted<br \/>\napplication for interim injunction Exh.5 praying for injunction<br \/>\nrestraining the defendants from disturbing the possession of the<br \/>\nplaintiffs. The learned trial Court initially granted order of<br \/>\nstatus-quo, however, subsequently after hearing the learned<br \/>\nAdvocates for the parties, the learned trial Court vide order<br \/>\ndated 27th March, 2008 dismissed application Exh.5. Being<br \/>\naggrieved and dissatisfied with the order passed by the learned trial<br \/>\nCourt below Exh.5 dismissing the application for interim injunction,<br \/>\nthe respondents herein ?  original plaintiffs preferred Civil<br \/>\nMisc.Appeal No.32 of 2008, which came to be heard, decided and<br \/>\ndisposed of by the learned Additional District Judge and Presiding<br \/>\nOfficer, Fast Track Court No.4, Anand who by impugned judgment and<br \/>\norder dated 29.04.2008 partly allowed the said appeal by quashing and<br \/>\nsetting aside the order passed by the learned trial Court passed<br \/>\nbelow Exh.5 by directing both the parties to maintain status-quo<br \/>\nwith respect to disputed property. Being and dissatisfied with the<br \/>\norder passed by the learned Appellate Court dated 29.04.2008 passed<br \/>\nin Civil Misc.Appeal No.32 of 2008, the petitioners ?  original<br \/>\ndefendants have preferred the present Special Civil Application under<br \/>\nArticle 227 of the Constitution of India.\n<\/p>\n<p>4.\t\tMr.Nikhil<br \/>\nKariel, learned Advocate for the petitioners ?  original defendants<br \/>\nhas submitted that the petitioners herein ?  Sejalben Rameshbhai<br \/>\nHalia and Rakesh Ramanbhai Patel are joint owners of the disputed<br \/>\nproperty and said property has been purchased by the petitioners from<br \/>\none Mrs.Girija Babulal Nair by registered sale deed dated 27.02.2004<br \/>\nand said Mrs.Girija Babulal Nair had purchased the said property from<br \/>\none Bharatsinh Amarsinh Chavda by registered sale deed dated<br \/>\n24.07.2002. It is submitted that present dispute is with respect to<br \/>\nplot of two vighas where a hotel is situated.  It is submitted that<br \/>\nrespondents herein claimed to be in possession of the disputed land<br \/>\nas tenant of Mrs.Girija Babulal Nair, however, no documentary<br \/>\nevidence and\/or other evidence has been produced by them in support<br \/>\nof their tenancy rights. It is submitted that original plaintiffs are<br \/>\nhead strong persons who had forcible entered into the hotel and were<br \/>\ntrying to extract some benefit from the petitioners. It is submitted<br \/>\nthat said two properties had been leased out by the petitioners after<br \/>\nthey had purchased the property from one Bhupatbhai Laxmandas<br \/>\nParsania vide agreement dated 22.12.2005. Said Bhupatbhai<br \/>\nLaxmandas Parsania was running hotel in the name of Shiv Krupa Hotel<br \/>\nand later on the said property was leased to one Vinodbhai Gagjibhai<br \/>\nBharward who had started running the hotel in the name of Saraswaty<br \/>\nhotel and vide notice dated 06.11.2006 Sub-Divisional<br \/>\nMagistrate, Petlad had called upon said Vinodbhai Gagjibhai Bharwad<br \/>\nto produce any license to run the hotel under the Bombay Police Act.<br \/>\nIt was further pointed out that since said hotel was being run<br \/>\nwithout any license by said Vinodbhai Gagjibhai Bharward, Sub<br \/>\nDivisional Magistrate vide order dated 14.11.2006 directed to<br \/>\nclose down the hotel. It is submitted that disputed property was not<br \/>\nin possession, occupation of the present respondents at all and in<br \/>\nview of the above respondents could not have been in possession of<br \/>\nthe hotel during that period and therefore, their contention that<br \/>\nthey were continuously in occupation of the hotel from 2002 onwards<br \/>\nis prima-facie proved to be false. It is submitted therefore,<br \/>\nthe Appellate Court has materially erred in directing both the<br \/>\nparties to maintain status-quo. It is submitted that by<br \/>\naforesaid order it is likely to further complicate the matter and<br \/>\neven further complication. It is submitted that on appreciation of<br \/>\nevidence the learned trial Court rejected the application Exh.5 which<br \/>\nwas not required to be interfered with by the learned Appellate<br \/>\nCourt. Therefore, it is requested to allow present Special Civil<br \/>\nApplication and quash and set aside the order passed by the learned<br \/>\nAppellate Court and to restore the order passed by the learned trial<br \/>\nCourt passed below Exh.5.\n<\/p>\n<p>5.\t\tThe<br \/>\npetition is opposed by Mr.H.M.Parikh, learned Advocate for the<br \/>\nrespondents ?  original plaintiffs. It is submitted that when the<br \/>\nrespondents ?  original plaintiffs are in possession of suit land \/<br \/>\nhotel in question and prima-facie believing the same when the<br \/>\nlearned Appellate Court has partly allowed the appeal by directing<br \/>\nboth the parties to maintain status-quo, it cannot be said<br \/>\nthat the learned Appellate Court has committed any error which calls<br \/>\nfor interference of this Court in exercise of powers under Article<br \/>\n227 of the Constitution of India. Therefore, it is requested to<br \/>\ndismiss the present Special Civil Application.\n<\/p>\n<p>6.\t\tHeard<br \/>\nthe learned Advocates appearing on behalf of the respective parties.\n<\/p>\n<p>7.\t\tAt<br \/>\nthe outset it is to be noted that the petitioners- original<br \/>\ndefendants are owners of the land in question. The respondents ?<br \/>\noriginal plaintiffs claim to be in possession of the suit land as<br \/>\ntenant of predecessor -in -title of Mrs.Girijaben Nair since 2002.<br \/>\nHowever, the plaintiffs have miserably failed to produce any<br \/>\nsupporting evidence to that effect. Not a single document has been<br \/>\nproduced in support of the tenancy rights of the plaintiffs. Even it<br \/>\nis the case of the plaintiffs that they were running hotel; they must<br \/>\nbe having valid license under the Bombay Police Act which is not<br \/>\nproduced by the plaintiffs. On the contrary it has come on record<br \/>\nthat even proceedings were initiated by the Sub-Divisional Magistrate<br \/>\nin the year 2006 against one Vinodbhai Gagjibhai Bharwad and order<br \/>\ncame to be passed by the Sub-Divisional Magistrate directing him to<br \/>\nclose down the hotel as he was not having license. Under the<br \/>\ncircumstances case on behalf of the plaintiffs that they are in<br \/>\npossession of the disputed land and running hotel since 2002 cannot<br \/>\nbe believed. Even on the basis of Panchnama it is not borne<br \/>\nout that the plaintiffs are in possession of the disputed land as<br \/>\nsought to be contended on behalf of the respondents ?  original<br \/>\nplaintiffs. Under the circumstances when the respondents ?  original<br \/>\nplaintiffs have failed to establish their possession and\/or under<br \/>\nwhat right they claim to be in possession of the land in question<br \/>\nand\/or they have failed to produce any evidence in support of their<br \/>\nclaim as a tenant, the learned Appellate Court has materially erred<br \/>\nin directing both the parties to maintain status-quo and<br \/>\ninterfering with the order passed by the learned Trial Court below<br \/>\nExh.5. Under the circumstances, impugned order passed by the learned<br \/>\nAppellate Court deserves to be quashed and the order passed by the<br \/>\nlearned trial Court passed below Exh.5 deserves to be restored.\n<\/p>\n<p>8.\t\tFor<br \/>\nthe reasons stated above, the petition succeeds. The impugned order<br \/>\ndated 29.04.2008 passed by the learned Additional District Judge &amp;<br \/>\nPresiding Officer, Fast Track Court No.4, Anand in Civil Misc.Appeal<br \/>\nNo.32 of 2008 is hereby quashed and set aside and the order dated<br \/>\n27.03.2008 passed by the learned trial Court below Exh.5 in Regular<br \/>\nCivil Suit No.22 of 2008 is hereby restored. Rule is made absolute to<br \/>\nthe aforesaid extent.
