No.34506 OF 2005\n          ----------------------------------------\n            Dated, 16th day of July, 2009\n\n                        JUDGMENT\n<\/pre>\n<p>      The petitioner is a retired Sewing Teacher. She<\/p>\n<p>approached this Court praying inter alia to issue a writ<\/p>\n<p>of mandamus directing the respondents to grant the<\/p>\n<p>full time service    benefits as contemplated by     the<\/p>\n<p>Government       Order    viz., G.O.(Rt.)56\/71\/Gen.Edn.<\/p>\n<p>dated 19.5.1971. It is also prayed for a declaration<\/p>\n<p>that inaction on the part of the respondents in granting<\/p>\n<p>the benefits as per Ext.P1 Government Order is highly<\/p>\n<p>illegal and arbitrary. Another prayer is for a direction<\/p>\n<p>to pay compensation to the petitioner for the undue<\/p>\n<p>delay and inaction in implementing the orders in favour<\/p>\n<p>of the petitioner and failure in granting her service<\/p>\n<p>benefits. The fourth prayer is for a direction to the Ist<\/p>\n<p>respondent to issue       clarification to the Accountant<\/p>\n<p>General to approve the fixation of pay and pensionary<\/p>\n<p>claims of the petitioner.\n<\/p>\n<p>WPC 34506\/05<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>     2. I have heard the learned counsel for the petitioner<\/p>\n<p>and also the learned Government Pleader.<\/p>\n<p>     3.     As per Ext.P1 order, the respondents have<\/p>\n<p>admitted that the petitioner was eligible for full time<\/p>\n<p>benefit       from      1.6.1971      as      ordered      in<\/p>\n<p>G.O.Rt.No.56\/71\/S.Edn., dated 19.5.1971.          When the<\/p>\n<p>department has admitted her claim, as evidenced in Ext.P1<\/p>\n<p>order, it is further stated that due to oversight    she was<\/p>\n<p>not given the benefits before her retirement from service<\/p>\n<p>on 31.3.88. It is also stated that the Director of Public<\/p>\n<p>Instruction has recommended that the service put in by<\/p>\n<p>Smt. Stella Sneham from June 1971 may be treated as full<\/p>\n<p>time     for granting her pensionary benefits including<\/p>\n<p>D.C.R.G. The Department or the Government has, though<\/p>\n<p>admitted that the petitioner was       eligible for full time<\/p>\n<p>benefit from 1.6.71, no reason is assigned to deny the<\/p>\n<p>service and other monetary benefit till her retirement.<\/p>\n<p>Naturally, the petitioner was entitled to get all consequent<\/p>\n<p>monetary benefits including the salary.       But in Ext.P1<\/p>\n<p>WPC 34506\/05<br \/>\n<span class=\"hidden_text\">                                -:3:-<\/span><\/p>\n<p>order, nothing is mentioned about those aspects, but the<\/p>\n<p>only concession granted is that service put in by the<\/p>\n<p>petitioner as a Sewing Teacher from June 1971, is treated<\/p>\n<p>as full time for the purpose of granting her pensionary<\/p>\n<p>benefits including DCRG. This Court cannot tolerate the<\/p>\n<p>above arbitrary and illegal approach of the respondents<\/p>\n<p>in denying the      valuable  and    legitimate right of the<\/p>\n<p>petitioner for the emoluments consequent to the benefit<\/p>\n<p>given to the petitioner on the strength       of the above<\/p>\n<p>government order and also Ext.P1, especially, when the<\/p>\n<p>petitioner is   in no way responsible for the same and<\/p>\n<p>particularly when the respondents admitted their fault.<\/p>\n<p>      4. Now, this court cannot ignore the fact that the<\/p>\n<p>petitioner had already retired from service during the year<\/p>\n<p>1988 and thereafter 21 years have elapsed. Therefore, it<\/p>\n<p>is time for the respondents to correct their mistake by<\/p>\n<p>paying the monetary benefit to her in the light of the fact<\/p>\n<p>that, as per Ext.P1, the respondents admitted that the<\/p>\n<p>petitioner is eligible for full time benefit from 1.6.1971.<\/p>\n<p>WPC 34506\/05<br \/>\n<span class=\"hidden_text\">                                 -:4:-<\/span><\/p>\n<p>Hence, the monetary benefits for which the petitioner is<\/p>\n<p>entitled cannot be denied any further and the payment<\/p>\n<p>shall not be prolonged in view of the particular facts and<\/p>\n<p>circumstances involved in this case.<\/p>\n<p>      5.. In the result this writ petition is allowed directing<\/p>\n<p>the respondents to pay the entire monetary benefits due to<\/p>\n<p>the petitioner from June 1971 after calculating the same in<\/p>\n<p>accordance with the pay applicable to        full time Sewing<\/p>\n<p>Teacher, and on the basis of the recommendations of the<\/p>\n<p>Pay Commissions from time to time, and holding that the<\/p>\n<p>petitioner has no option in terms of the report of the Pay<\/p>\n<p>Commission and thus after finalising and quantifying the<\/p>\n<p>amount, the same shall be given to the petitioner within<\/p>\n<p>three months from the date of receipt of a copy of this<\/p>\n<p>judgment which will be produced by the petitioner before<\/p>\n<p>the Ist respondent. The first respondent is also directed to<\/p>\n<p>entrust the above responsibility exclusively with an officer<\/p>\n<p>not below the rank of a Deputy Director of Education or an<\/p>\n<p>officer equivalent to his rank considering the seriousness<\/p>\n<p>WPC 34506\/05<br \/>\n<span class=\"hidden_text\">                                -:5:-<\/span><\/p>\n<p>of the matter.
